SUMMARY/BACKGROUND
Three (3) proposals were received on October 17, 2025 as lump sum, including the cost to
include all materials, equipment, and labor to furnish and install the baffle per engineer's
plans. The low proposal amount was submitted by Austin Tyler Construction, Inc. in the
amount of $33,950.00.
ANALYSIS
The I&M Canal CSO Outfall 002 Baffle Wall project is consistent with the IEPA mandate and
deadline of December 31, 2025. This project may be completed and on time and within the
CIP budget of $37,500 upon acceptance of the low bid.

RESOLUTION NO. R--25
A RESOLUTION AUTHORIZING THE I&M CANAL CSO OUTFALL 002 BAFFLE
WALL
WHEREAS it has become necessary for the I&M Canal CSO Outfall 002 Baftflc Wall;
and
WHEREAS, in connection with the work to be conducted on the I&M Canal CSO Outfall
002 Baffle Wall, the Village has researched and evaluated available options and contractors; and
WHEREAS, upon review by Village staff, it was concluded that the greatest benefit to
the Village will be realized by waiving the bidding process and accepting the proposal for I&M
Canal CSO Outfall 002 Baffle Wall with Austin Tyler Construction, Inc., 23343 South Ridge
Road, Ellwood, IL 60421, in an amount not to exceed $33,950.00; and
WHEREAS, Section 5/8-9-1 of the Illinois Municipal Code (65 ILCS 5/8-9-1) allows the
Board of Trustees of the Village ("Village Board"), upon a vote of two-thirds of the trustees then
holding office, to waive the requirements for competitive bidding; and
WHEREAS, The Village Board has determined that it is advisable, necessary, and in the
best interest of the Village to waive competitive bidding and authorize the I&M Canal CSO
Outfall 002 Baffle Wall for $33,950.00.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows:
SECTION 1:
Incorporation Recitals. The foregoing findings and recitals are hereby adopted as Section
One of this Resolution and are incorporated by reference as if set forth verbatim herein.
SECTION 2:
Waiver of Public Bid Requirements and Authority to Purchase. The Village Board hereby
waives the competitive bidding requirements otherwise applicable to the I&M Canal CSO Outfall
002 Baffle Wall by Austin Tyler Construction, Inc. at a price not to exceed $33,950.00 as Exhibit
A.
SECTION 3:
The Village Administrator or his designee is hereby authorized to execute any documents
and take any other steps necessary to complete the I&M Canal CSO Outfall 002 Baffle Wall by
Austin Tyler Construction, Inc. at a price not to exceed $33,950.00 and to otherwise carry out this
Resolution.
SECTION 4:
This Resolution shall be in full force and effect from and after its passage and approval as
provided by law.

captioned project. Three (3) proposals were received as lump sum, including the cost to include all materials,

We have analyzed the proposal documents and found Austin Tyler Construction, Inc. of Elwood, Illinois to be the
lowest qualified bidder. The total is below the $37,500 that was budgeted for in the CIP. HR Green, Inc.
recommends awarding the contract to Austin Tyler Construction, Inc. using the price as shown above and in the
attached proposal. As a lump sum contract, the final project amount will be as agreed upon, and quotes from
contractors are typically valid for at least 30 days upon receipt.
