O-51-25 Amending Title 13 (Public Utilities) and Title 17 (UnifiedTEMONT TO: Village Board Meeting 418 Main Street I Lemont, IL 60439 FROM: Jason Berry, Community Development THROUGH: Bruce Hill, Village Engineer SUBJECT: An Ordinance Amending Title 13 (Public Utilities) and Title 17 (Unified Development Ordinance) of the Municipal Code of the Village of Lemont DATE: October 27, 2025 SUMMARY/BACKGROUND Village staff periodically recommends updates to the Municipal Code, including the Public Utility and Unified Development Code sections, to maintain clear, consistent engineering standards that ensure safe, well -designed development and infrastructure. ANALYSIS Updates included in the attached Ordinance include: • Section 13.04.030 - Water service taps. An update allowing both compression and flared water service taps as recommended by the PW Department. • Section 17.23.020 F. Sets clear process for the requirements to reduce letters of credit (LOC) and other modifications to ensure payment to contractors and suppliers. • Section 17.23.020 K. New developments are required to digitally submit as -built infrastructure information in format compatible with Village GIS. • Section 17.26.140. This section updated to define Village's current LED lighting standards replacing outdated lighting standards and types. • Section 17.29.020. Wet detention requirements. Additional design criteria detail is recommended for developments proposing wet bottom detention basins. • Section 17.27.030. Large developments must show 100-year flood limits on plans. Planning & Zoning Commission (PZC) The PZC held a public hearing on September 3, 2025, and voted to recommend approval. Committee of the Whole (COW) The COW reviewed the proposed changes at the meeting held on September 15, 2025. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Staff recommends approval of the attached ordinance. BOARD ACTION REQUESTED A motion to approve the attached ordinance. ORDINANCE NO. n ^ Jr I `/ � AN ORDINANCE AMENDING TITLE 13 (PUBLIC UTILITIES) AND TITLE 17 (UNIFIED DEVELOPMENT ORDINANCE) OF THE MUNICIPAL CODE OF THE VILLAGE OF LEMONT WHEREAS, the Village of Lemont, Counties of Cook, Will and DuPage, Illinois ("the Village") is a municipality in the State of Illinois with full powers to enact ordinances and adopt resolutions for the benefit of the residents of the Village; and, WHEREAS, the President and Board of Trustees of the Village of Lemont (the "Corporate Authorities") may from time to time amend the text of the Village Code when it is determined to be in the interest of the residents of the Village; and, WHEREAS, on September 3, 2025 the Lemont Planning & Zoning Commission, in accordance with the requirements of the Illinois Combined Statutes and the Unified Development Ordinance, conducted a public hearing for the proposed amendments to the zoning and land use regulations of the Unified Development Ordinance; and WHEREAS, notice of the aforesaid public hearing was made in the manner provided by law; and WHEREAS, the Lemont Planning & Zoning Commission found that the proposed amendments are consistent with the purposes of the Unified Development Ordinance and voted to recommend their approval with modifications incorporated into the language; and WHEREAS, the Corporate Authorities find that it is in the best interest of the Village to amend the Village Code provisions in Title 13, Chapter 13.04, and Title 17, Chapters 17.23, 17.26, 17.27, and 17.29, respectively. NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Cook, Will, and DuPage Counties, Illinois, as follows: SECTION ONE: The foregoing findings and recitals are hereby adopted as Section 1 of this Ordinance and are incorporated by reference as if set forth verbatim herein. SECTION TWO: The Lemont, Illinois Municipal Code ("Village Code"), as amended, is further amended in Title 13, Public Utilities, with additions shown in underlined text, and deletions shown in stfi� to Section 13.04.030. — Installation to be supervised by director of public works; at cost of property owner or applicant, of the Village Code as follows: 13.04.030. Installation to be supervised by director of public works; at cost of property owner or applicant. (a) All service pipes from the mains to the premises served shall be installed by and at the cost of the owner of the property to be served, or the applicant for the service. Such installation shall be under the supervision of the director of public works. (Code 1964, § 11.201; Code 1988, § 13.04.030) (b) Both compression -type and flared (or flare -type) water service taps shall be permitted for connections to the public water main, provided they meet applicable AWWA standards and are installed in accordance with the manufacturer's recommendations. All fittings and materials shall be compatible with the service pipe material and rated for the working pressure of the distribution system. Taps shall be secure, watertight, and accessible for maintenance. SECTION THREE: The Lemont, Illinois Municipal Code ("Village Code"), as amended, is further amended in Title 17, Unified Development Ordinance, with additions shown in underlined text, and deletions shown in st,,:l�� to Section 17.23.020. — Site Development Permits, of the Village Code as follows: 17.23.020. — SITE DEVELOPMENT PERMITS. F. Financial Assurances for Site Development. 2. Reductions in the amount of a letter of credit or other financial guarantee may be approved per resolution by the Village Board, upon recommendation by the Village Engineer and Planning and Economic Development Director. Such recommendation shall be based on the percentage of completed infrastructure improvements as verified by the Design Engineer and confirmed by the Village Engineer. The developer may obtain a revised letter of credit or renew the existing letter of credit in accordance with the following limitations: Upon completion of 25% of the required infrastructure improvements, the letter of credit may be reduced to 90% of the original approved amount, provided the completed work has been verified and accepted by the Village Engineer. Upon completion of 50% of the required infrastructure improvements, the letter of credit may be reduced to 65% of the original approved amount, subject to the same verification and approval. Upon completion of 75% of the required infrastructure improvements, the letter of credit may be reduced to 40% of the original approved amount, subject to the same verification and approval. Upon 100% completion of all required infrastructure improvements, and final approval by the Village Engineer, the letter of credit may be reduced to the required two-year maintenance guarantee amount only. In no case shall the letter of credit be reduced below the required maintenance balance plus 115% of the value of any outstanding work, as determined by thq Village Engineer. All reductions are subject to Village Board approval and compliance with applicable conditions of the development agreement. As a condition for any reduction in the amount of a posted Letter of Credit related to construction or development activities, the General Contractor and any Subcontractor(s) involved in the scope of work for which the reduction is requested must submit a duly executed and notarized Waiver of Lein. This waiver shall affirm that all payments due for labor, materials, equipment, and services provided up to the date of the requested reduction have been satisfied in full, and that no liens or claims exist or will be asserted against the property of the Letter of Credit. Failure to provide a compliant Waiver of Lien shall result in the denial of the requested reduction. SECTION FOUR: The Lemont, Illinois Municipal Code ("Village Code"), as amended, is further amended in Title 17, Unified Development Ordinance, with additions shown in underlined text, and deletions shown in st .:'�� to Chapter 17.23. — Site Development Procedures, of the Village Code as follows: 17.23.100. — AS -BUILT DIGITAL SUBMITTAL REQUIREMENTS. A. Purpose. The Village of Lemont digital submission requirements specify the format of all digital data submitted in accordance with the Village of Lemont subdivision ordinance which calls for plats and plans submitted for new subdivisions to be compatible with the village's geographic information system GIS). It is the intent of these requirements to: 1. Assist in the implementation of the village's GIS through the inclusion of new developments/subdivisions requiring building permits and other services related to the associated public improvements made to the new subdivision/development. 2. To provide data that meets accuracy standards required for new parcels and infrastructure improvements consistent with the village's geodetic control network. 3. To provide information necessary to maintain the computer -aided dispatch system for emergency 911 calls (future). B. When Required. 1. After Final Plans are approved but before construction can begin. 2. Following the completion of all construction, including Punch List. C. Approval Process. 1. As -Built Survey Required. a. One (1) digital version of a final as -built topographical survey of the lot grading in a readable format shall be submitted by electronic transmission to and approved by both the building commissioner and village engineer. Such survey shall also be prepared and sealed by an Illinois registered land survey 2 Final as -built surveys shall show the following information and meet the following minimum requirements (additional detail may be required for each individual property): a. Said survev shall be orepared, signed, sealed, and certified by a professional land surveyorgistered in the state of Illinois. b. Said survey shall be titled "Plat Of Survey, Final As -Built Survey c. Such survey shall be in a readable digital format and transmitted by electronic transmission to the Village. d. The legal description permanent index number, and street address shall be shown on such survey. e. The scale of such required as -built survey shall be one -inch equals twenty feet (1" = 20')(architectural scales are not acceptable). f. All information shall be legible. g. A certificate of occupancy will not be issued until all required soil erosion measures are in place and grass or other suitable ground cover is growing and cuttable and is at least 70% established, or if in the form of sod, in a firm and healthy condition. h. FEMA flood zone limits in accordance with the elevation certificate instructions per the FEMA National Flood Insurance Program. i. One (1 ) digital version of the sealed original and one (1) copy of the as - built survey shall be submitted by electronic transmission to the Village. 3. Said survey shall indicate all of the following locations: a Property lines with bearings and dimensions (include arc length, radius, PC, PT, and included angle for curves). b. Lot corners (shall be monumented and indicate monument type). c. Building setback lines and buildinglines nes (located with dimensions from lot lines). d. All easements and the respective purpose of each such easement shall be identified. e. Impervious areas on lot including driveways (include type of surface), sidewalks patios and retaining walls (with upper and lower grades, and material). f. Topography at one foot (1') contour spacing, including swales, shoulders, roadway culverts driveway culverts (for culverts include material, existence of FES size elevation of inverts, and grades above culvert), required for the subject property and within the entire width of any adjacent right of way. g. Utilities including septic area, necessarily accessible components of septic system water well (with 75-foot radius), gas service electrical service, and private drain lines (including sump pit). h. Floodplain or floodway elevations and delineation in one -foot (1') intervals (if applicable). i. Wetland delineation. 4. The elevations shown on said survey shall include: a. Benchmark description and elevation (from approved permit site plan). b. All elevations shall be to NAVD88 datum. c. Elevation of the following: (1) Street centerline, shoulders, and swales at front property corners and at minimum fifty foot (50')spacing (indicate if roadway elevations are finish, binder, or aggregate surface). (2) All lot corners and property lines at minimum fifty foot (50') spacing. (3) All building top of foundations, sill of lookouts, sill of walkouts, garage floor, and sill of lowest opening into foundation. (4) Grades adjacent to the foundation including driveway at garage. (5) Grades on and around septic area to show adequate drainage away from area. (6) Bridge ledges. (7) All impervious grading features. (8) All necessarily accessible components of the septic system. (9) Grading of lot shall be shown as as -built contours on pervious areas. For gradients of less than two percent (2%), six-inch (6") contours shall be shown; for gradients of more than two percent (2%), one foot W) contours shall be shown. (10) Information shall be included to indicate whether the elevations are on finished sodded surface or on finish graded topsoil. 5. A final occupancy permit shall not be issued if the property is not in compliance with the approved foundation plat of survey, the approved site plan, the approved septic plan, the approved final lot grading plan, the approved final "as built" survey, and the approved final engineering for the subdivision. D. Final Plans. 1. The plat, and plans will be approved through the Village Code Chapter 17- 23.20 process. Once final plans are approved and issued for construction the Village shall receive: a. PDF copies of the plans b. One complete set of 36" x 24" plans (paper prints) c. Digital Data Submissions in accordance with this document. E. Record Drawings. 1. Prior to the initial acceptance of improvements, but after the completion of all work (including Punch List), one complete set of 36" x 24" record drawings (paper prints) shall be delivered to the COMMUNITY for Review. 2. Following that review any pdates required will be made until deemed acceptable. Once approved the Village shall receive: a. PDF copies of the record drawings b. Digital Data Submissions in accordance with this document F. Data Delivery. 1. The data of impacted features (added, moved, removed, adjusted, etc.) shall be submitted in an ESRI File Geodatabase (g_db) with editor tracking enabled. 2. All data collected or adjusted for positional accuracy shall be snapped to adjacent features in accordance with the Village's standards and requirements. 3. All data will be collected using the NAD 1983 State Plane Illinois East FIPS 1201 US Feet Projection and NAVD88 vertical datum. G. Data Required. Prior to the project start date, vendor and GIS will align on data collection and delivery format. 1. The following feature classes are required for submission: a. Roadway b. Sidewalk c. Building d. (2) Luminaire shall have a nominal Correlated Color Temperature (CCT) of 4000K f 120 with no exceptions and shall have an external label per the American National Standards Institute (ANSI) C 136.15 and an interior label per ANSI C136.22. (3) Color RenderingIndex ndex (CRI) of the LED source shall not be less than 70. (4) Luminaire shall be capable of ±5 degrees of tilt, minimum, for leveling adjustment. (5) Luminaire shall be provided with the capability optional field installed backlight suppression control. (6) Luminaire shall be a Type II distribution. Nonconforming Luminaires: Existing exterior lighting luminaires in service on the effective date of this Section shall be exempt from the standards of this Section and shall be considered legally nonconforming. Such fixtures may be repaired and maintained however, if any legal nonconforming luminaire is moved, requires replacement due to age inaccessible parts such as lamps lens or ballast or damaged by any means to an extent that its replacement is required. The replacement luminaire shall comply with this Section. For development activity involving improved property, luminaires shall be required to comply with this Section when the floor area of any building or structure or parking areas, or any combination thereof, is increased by twenty —percent (20%) or greater. SECTION SIX: The Lemont, Illinois Municipal Code ("Village Code"), as amended, is further amended in Title 17, Unified Development Ordinance, with additions shown in underlined text, and deletions shown in str4kethr-ough to Section 17.29.020. — Storm Water Management Design Standards, of the Village Code as follows: 17.29.020. — Design Standards. G. Wet Detention. A detention basin designed with the intention of holding water on a permanent or nearly permanent basis. Unlike naturalized detention basins, wet detention basins have generally steeper slopes, usually employ riprap for erosion control, and generally do not incorporate emergent vegetation at the edge of the basin, and do not incorporate a combination of vegetated and open waters in the basin area. m�wet detention -shall -not exeeed-S1I:1V. Wet retention basins are allowed for private use only including private maintenance, or as otherwise approved by the Village. 2. These side slopes shall be stabilized with rip -rap, retaining walls or other approved permanent methods of stabilization. Stabilization design plans must be submitted to the Village Engineer for review. Any necessary circulation systems, including filters, aerators, etc. must be submitted for review and approval by the Village. 3. Eight (8) foot wide ledge at eighteen (18) inches below the normal water level. 4. Maximum side slopes of 2:1 below the two (2) foot ledge below normal water level. 5. A minimum of twenty-five (25) percent of the retention basin area shall be at least ten 00 feet deep at the normal water level, for all basins intended to support fish. Alternative designs for wet -bottom basins may be considered by the Village Engineer on a case -by -case basis. 6. The minimum volume below the normal -water level shall be equivalent to the 2-year, 24-hour volume of rainfall. 7. Wet detention ponds shall be designed to be attractive to adjacent lots. Ponds in residential areas with over two (2) feet of standing water or more than 2 hours of drainage) shall include protection around the pond perimeter. The protection may consist of fencing or plantings of trees and bushes,• in some cases flat slopes or shallow beaches extending at least 20 feet from the pond perimeter are acceptable. 8. All wet detention basin standards shall also meet and exceed the applicable minimum countywide standards as set by the MWRDGC. SECTION SEVEN: The Lemont, Illinois Municipal Code ("Village Code"), as amended, is further amended in Title 17, Unified Development Ordinance, with additions shown in underlined text, and deletions shown in stfiketh..^,,,a, to Section 17.29.030. — Storm Water Drainage System, of the Village Code as follows: Section 17.29.030 ("Storm Water Drainage System") of the Lemont, Illinois Municipal Code is hereby added, with additions in underlined text to read as follows: 17.29.030. STORM WATER DRAINAGE SYSTEM. G. 100-Year Stormwater Inundation Exhibits. 1. For larger developments, as defined below, the development's licensed design engineer shall submit a 100-year storm hydrologic and hydraulic analysis including inundation mapping; exhibits of all overland flow routes, detention facilities, and outfalls, as part of the engineering_ _ plan submittal. 2. A 100-year storm inundation exhibit shall be required for: a. Non-residential developments (Downtown District, Business Manufacturing other) with a total parcel size of 1.0 acre or greater; and, b. Residential developments of 2.0 acres or greater. SECTION EIGHT: That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION NINE: Should any Section or provision of this Ordinance be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the Ordinance as a whole or any part thereof other than the part declared to be invalid. SECTION TEN: This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
