O-43-25 Granting a Variation to §17.07.010 and Table 17-07-01 of theTO: Village Board Meeting FROM: Jamie Tate, Community Development THROUGH: Jason Berry, CEcD, AICP, Economic & Community Development Director SUBJECT: An Ordinance Granting a Variation to §17.07.010 and Table 17-07-01 of the Lemont Unified Development Ordinance (917 East Variation) DATE: August 25, 2025 SUMMARY/BACKGROUND Robert & Dawn Davis, the property owners of 917 East Street, have applied for a variation to allow an attached covered deck to encroach into the rear setback leaving approximately 23- feet to the property rather than the minimum of 30-feet. The property is zoned R-4A and the existing home was placed on the lot approximately 32-feet from the rear property line, leaving little to no room for an attached structure to meet the minimum required rear setback. ANALYSIS Comprehensive Plan The subject property is within the Infill Residential (INF) future land use designation in the Lemont 2030 Comprehensive Plan. Planning & Zoning Commission (PZC) A public hearing was held at the PZC meeting on August 6, 2025 and the PZC recommended (6-0) to approve the requested variation. Committee of the Whole (COW) The variation request was presented to the COW at the meeting held on August 18, 2025. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Staff recommends approval of the attached ordinance. BOARD ACTION REQUESTED A motion to approve the attached ordinance. J ORDINANCE NO.6 AN ORDINANCE GRANTING A VARIATION TO §17.07.010 AND TABLE 17-07-01 OF THE LEMONT UNIFIED DEVELOPMENT ORDINANCE (917 East Street Variation) WHEREAS, Robert & Dawn Davis (hereinafter referred to as "the Petitioners") arc the owners of the property at 917 East Street in Lemont, Illinois (PIN 22-29-232-017) (hereinafter referred to as the "Subject Property"), legally described in Exhibit A; and WHEREAS, the Petitioner applied pursuant to the provisions of the Lemont Municipal Code, Title 17, Unified Development Ordinance ("UDO"), seeking a variation from § 17.07.010 and Table 17-07-01 (Lot & Dimensional Standards) to allow for an attached roof over a deck to encroach in the rear setback as depicted in Exhibit B; and WHEREAS, the Lemont Planning and Zoning Commission conducted a public hearing on the request on August 6, 2025, and voted 6-0 to recommend approval of the requested variation; and WHEREAS, a notice of the aforesaid public hearing was made in the manner provided by law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village have reviewed the matter herein and have determined that the requested variation is in the best interest of public health, safety, and welfare of the residents of the Village of Lemont, and hereby adopts the finding of facts as set forth in Exhibit C. NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois as follows: SECTION ONE: The foregoing findings and recitals are hereby adopted as Section 1 of this Ordinance and are incorporated by reference as if set forth verbatim herein. SECTION TWO: The following variation from the UDO is hereby granted for the Subject Property at 917 East Street: 1. A variation from § 17.07.010 and Table 17-07-01 to allow an attached roof over a deck to encroach approximately seven (7) feet into the required rear yard setback, leaving a setback of approximately twenty-three (23) feet from the rear property line to the edge of the attached roof. SECTION THREE: Conditions. The following conditions apply: 1. Unless otherwise approved by the Village Board, the Subject Property shall be developed and maintained in accordance with the Lemont, Illinois Municipal Code and this Ordinance. 2. The improvements shall conform to the site configuration shown in the Roof Deck Drawing (Exhibit B). SECTION FOUR: The Village Clerk is directed to publish this Ordinance in pamphlet form in accordance with applicable law. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval, and publication as provided by law. Based upon the evidence and testimony presented during the public hearing, the Lemont Village Board of Trustees finds the following: The Lemont 2030 Comprehensive Plan's future land use map designates the subject site as Infill Residential (INF). 2. The subject property is within the R-4A zoning district. 3. The requested variation adequately meets the standards for granting variations within the Unified Development Ordinance.
