SUMMARY/BACKGROUND
Eight (8) bids were received on July 11, 2025, for the 2025 Sidewalk Improvements project,
which work consists of Village -wide sidewalk removal and replacement, HMA driveway
removal and replacement, as well as all appurtenant construction.
TCD Concrete Works, Inc. submitted their low bid in the amount of $123,736.00, which is
below the Engineer's estimate of $165,045.00. Shortly after the bid opening concluded, we
were made aware that TCD Concrete Works, Inc. is a non -union contractor. To work for a
Municipality in the State of Illinois, TCD Concrete Works, Inc. does not have to be a union
contractor, they just need to pay prevailing wages and submit weekly certified payrolls. There
were some concerns that a protest would be installed near Village Hall, so TCD was told that
they need to give guarantees that a protest display would not appear in the Village of Lemont.
TCD has an agreement with the Cement Mason Union 502 and has also been given
assurances from Laborers Unionl52.
ANALYSIS
The 2025 Sidewalk Improvements Project is included in the 5-year Captial Improvement Plan
and $150,000 has been included in the FY26 Budget for this project.

IMPROVEMENTS PROJECT
WHEREAS the Village of Lemont requires that the 2025 Sidewalk Improvements Project
be completed; and
WHEREAS, the Village seeks to utilize the services of TCD Concrete Works, Inc. for
such work; and
WHEREAS, TCD Concrete Works, Inc., 306 Fairmont Ct. St. Charles, IL 60175
submitted the lowest qualified bid for such work in the amount of $123,736.00.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows:
SECTION 1:
The agreement attached hereto as Exhibit A is hereby approved.
SECTION 2:
The Village Administrator is hereby authorized to execute the agreement and to make
minor changes to the document prior to execution that do not materially alter the Village's
obligations, to execute any other agreements and documentation as well as to take any other steps
necessary to carry out this resolution.
SECTION 3:
This Resolution shall be in full force and effect from and after its passage and approval as
provided by law.

1. THIS AGREEMENT, made and concluded the day of between the Village of
Lemont, acting by and through the Village Administrator as the party of the first part, and
TCD Concrete Works Inc.306 Fairmont Ct., St. Charles, IL 60175, his/their executors,
administrators, successors or assigns, known as the party of the second part.
2. WITNESSETH: That for and in consideration of the payments and agreements
mentioned in the Proposal hereto attached, to be made and performed by the party of the first
part and according to the terms expressed in the Bond referring to these presents, the party of
the second part agrees with said party of the first part at his/their own proper cost and expense
to do all the work, furnish all the materials and all labor necessary to complete the work in
accordance with the Plans and Specifications hereinafter described, and in full compliance with
all of the terms of this agreement and the requirements of the Engineer under it.
3. AND, it is also understood and agreed that the Notice to Contractors, Special Provisions,
Proposal and Contract Bond hereto attached, and the Plans as prepared by HR Green, Inc. and
designated as 2025 Sidewalk Improvements Project all essential documents of this Contract,
and are a part hereto.

TCD Concrete Works, Inc. submitted their bid in the amount of $123,736,00, which is below the Engineer's
Estimated cost of $165,045.00. Shortly after the bid opening concluded, we were made aware that TCD Concrete
Works, Inc., is a non -union contractor. To work for a municipality in the State of Illinois, TCD Concrete Works,
Inc., does not have to be a union contractor, they just need to pay prevailing wages and submit weekly certified
payrolls. That said, we were concerned that a protest would be installed near Village Hall, so TCD was told that
they needed to give guarantees that a protest display would not appear in the Village of Lemont. TCD has an
agreement with the Cement Mason Union 502 and has been given assurances from Laborers Union 152. See
attached for the Cement Mason Union documentation. Given that it is legal to work in the State of Illinois as a
non -union contractor and TCD has received assurances from both the Cement Masons and Laborers, we
recommend that the contract be awarded to TCD Concrete Works, they are qualified to perform this work in the
amount of $123,736.00.
If the Board is uncomfortable with non -union contractors, we can take that under advisement for all future projects
and proceed to award this contract to J&J Newell Concrete Contractors, Inc. in the amount of $139,020.00.

This Agreement is entered into by and between Cement Masons and Plasterers Local Nos. S, 11, and M2, affiliated with the Northern
Illinois District Council of the Operative Plasterer: and Cement Masons International Association, AFL-00 (collectively referred to
as the" Union") and:

WHEREAS, tine Employer has entered into various collective bargaining agreements with the Northern Illinois District Council of the
Operative Plasterers and Cement Masons International Association of the United States and Canada covering geographical areas
including, the counties of, In their entirety, in die state of Illinois, Lee, Whiteside, Ogle, Carroll, JoDavies, Stephenson, McHenry,
Kane, Kendall, Delkalb, Lake, Grundy, Will, Winnebago, Boone, LaSalle, Bureau, Putnam, UuPage, Cook, Kankakee, and Iroquois,
and the counties of, in their entirety, in the state of lowa, Dubuque, Delaware, Alamakee, Jackson, Clayton, and the eastern half of
Jones.
THEREFORE, it is hereby AGREED as follows
The Employer recognizes the Union as the exclusive majority representative oral] employees covered by this Agreement in
the bargaining unit set forth in this agreement pursuant to section 9(a) ofthe Labor -Management Relations Act. This
majority status has been established by the Union's unequivocal demand for recognition as majority representative, the
Employers unequivocal granting recognition of the Union's majority 9(a) status based on the union having shown or having
offered to show an evidentiary basis of the Unions majority support. Section 9(a) status may have resulted based on a
National Labor Relations Board certification that the Union is a majority rep- presentative of the bargaining unit covered by
this agreement.
The Employer agrees to be bound to all master Collective Bargaining Agreements between the Union and the various
Employer Associations in the geographical jurisdiction ofthe Union, and hereby incorporated herein with the same force
and effects as if herein set forth in full, with respect to wages, hours of work, and fringe benefits, and all other terms and
conditions of employment for all afore said Cement Mason, Plasterer, and Shop Hand employees who are, have been, or
will become employed by the employer. The employer affirms the collective bargaining agreements between the union and
the associations as applicable to it with all amendments thereto. The terms of this agreement shall control in the event of a
conflict with the Associations Agreements.
The Employer agrees to pay the amounts which it is obligated to pay under the aforementioned master Collective
Bargaining Agreements to the Welfare, Defined Benefit and Defined Contribution Pension Plans and all other fringe benefit
funds named therein to become bound by and to be considered a party to the Trust Agreements upon which the funds are
based: and acknowledges and agrees to be bound to by any and all separate agreements with the Trustees ofthe various
Hands, or any Agreements with the officials oftite union, as if it has a signed the original copies ofthe Trust instruments and
any amendments thereto. The Employer ratifies and confirms the appointment of all the Employer Tn istees who shalt,
together with their Successor Trustees, designated in the manner provided in said Agreements and Declarations of Trust and
jointly with an equal number of Trustees appointed by the Union, carry out the terms and conditions of the Trust
Agreements.
The Employer further affirms and represents that all prior contributions to the varinua funds were made by duly authorized
agents of the Employer at the proper rates for the appropriate periods of time; and that by making said prior contributions,
the Employer evidenced the intent to be hound by the terms ofthe Trust Agreements and Collective Bargaining Agreements
which were operative at the time the contributions were made, acknowledges the report form to be sufficient instrument in
writing to bind the Employer to the applicable agreements. The Employer further agrees that the Trustees may, at any time
have an audit made of the payroll records ofthe Employer in connection with said contributions and/or reports. Where an
audit discloses a difference between hours actually worked by an employee and hours reported to the Funds by the
Employer and where such audit discloses any willful violation orally ofthe requirements ofthe Trust Agreements, the
officers, and directors ofthe Employer, if a corporation, or the owner or partners of the Employer, as applicable, shall be
personally liable for any underpayment or other pecuniary Joss to the Fund as a result of such conduct.
Employers covered by this Memorandum of Agreement shall retain all the work traditionally performed by Cement Masons.
Plasterers and Shop Hands, The Employer agrees that it will not cause any such traditionally performed work to be done at a
construction site by employees other than those covered by this Memorandum of Agreement, except with the prior written
consent of the Union, Any Employer who contracts out or sublets any part orthe work coming within the jurisdiction of the
Union shall act as guarantor of each subcontractor for payment of employees' wages and fringe benefits, including
reasonable attorney's fees incurred in enforcing the provisions here of Notwithstanding any agreement to the contrary the
Employers violation of any provision of flu; paragraph will give the Union the right to take any lawful action, including all
remedies at law or equity.
In the event orally change., in ownership, management, or operation of tho Employer's business, by sale or otherwise, it is
agreed that as a condition of such transfer or change it shall he provided in the instrument effecting the change that the new
owner and management shalt be fully bound by the terns and conditions of this Agreement. This Agreement is applicable to
all successors, transferors, and assigns of the Employer, whether corporate or otherwise.
The individual signing this Agreement agrees to be personally, jointly, and severally liable with the Employer for any failure
to pay wages or contributions, or to accurately report hours to the fringe benefit funds as required by this Agreement.
This document is the complete written agreement between the parties and can only be amended in writing by the parties. No
other oral, representation shall be binding on either parry, nor shall any party rely upon such oral statements that vary the
terms ofthe written Agreement.
The Employer and the Union agree that die territorial jurisdiction of the Union shalt be covered by all Master Agreements
between the Union and the various contractor associations as follows:
a, Cement Masons Local Union 502 shall have jurisdiction over the county of Cook in the state of (tlinois.
b. Plasterers Local Union 5 shall have jurisdiction over the counties of Cook, DuPage, DeKalb, Grundy, Kane, Kendall, LaSalle,
Livingston, McHenry, and Will Counties in their entirety in the state of Illinois,
c. Cement Masons and Plasterers Local 11, Arca 587 shall have jurisdiction over the counties of Lec, Whiteside, Ogle, Carroll,
Jo Davies, Stephenson in their entirety in the state of Illinois. The counties of Dubuque, Delaware, Allamakee, Jackson,
Calyton, and .tones in their entirety in the state of Iowa,
d. Cement Masons and Plasterers Local I I Area 638 shall have jurisdiction uvar the counties of MoHonry, Kona, Kandull, and
Dekalb in their entirety in the state of Illinois.
e, Cement Masons and Plasterers Local 11, Area 362 shall have jurisdiction over the county of Lake in its entirety in the state of
Illinois.
f. Cement Masons and Plasterers Local 11, Area 161 shall have jurisdiction over the counties of Grundy and Will in their
entirety in the state of Illinois.
g. Cement Masons and Plasterers Local 11, Area 382 shall have jurisdiction over the counties of Winnebago and Boone in their
entirety in the state of lliinois,
h. Cement Masons and Plasterers Local 11, Area 297l858 shall have jurisdiction over the counties of LaSalle, Bureau, and
Pumam in their entirety in the state of Illinois.
I. Cement Masons and Plasterers Local 11, Area 37 shall have jurisdiction over the counties of Kankakee and Iroquois in their
entirety in the state of Illinois.
The parties do hereby adopt the latest Master Agreements, and all approved amendments thereto and any future Master
Agreements and Amendments thereto between the Union and the various Employer Associations or any successor
association(s), signatory with Local Unions 5 11, and 502 ofthe Northern Illinois District Council of Plasterers and Cement
Masons International Association of the United States and Canada. The parties do hereby adopt the terms and conditions of
any and all TnLst Fund Agreements recognized in said Agreements, accepting and ratifying the appointment ofthe Employer
Trustees and their successors and agree to be bound by all terms and conditions thereof for the duration ofsuch Collective
Bargaining Agreement and any future Agreements and for the period of any subsequent extensions including any
amendments which may be subsequently made
Either party desiring to amend or terminate the Collective Bargaining Agreements adopted in this Memorandum of
Agreement must notify the other in writing at least sixty (60) days and not more than ninety (90) days prior to the expiration
of the Collective Bargaining Agrcement(s) which it seeks to amend or terminate.

WHEREAS, the Northern Illinois District Council of the Operative Plasterers' and Cement Masons' International Association,
consisting of Local Unions No. 502, 5, 363, 638, and 161, have agreed to a reciprocity agreement in which wages, fringe benefits and
dues structure shall be paid pursuant to the wage and benefit structures of the home Local.
WHEREAS, the Employer acknowledges his Collective Bargaining Agreement with various locals and wishes to participate in this
reciprocity agreement in order to have a uniformity of reporting wages and benefits for its members in all areas worked within the
District Council, it is hereby agreed that the employer will comply with the terms of the Collective Bargaining Agreement.
WHEREAS, the Employer agrees that all other terms of the Collective Bargaining Agreement of the Local Union in which work is
performed shall be complied with, it is therefore agreed that the signatory Employer may pay wages pursuant to the terms of the
employee members home Local and to pay fringe benefits directly to the home local acknowledging the terms of the home Local of
the employees and that any check -off system shall be of the rate of the home Local.

After extensive collective bargaining negotiations, Local 502 and various employer associations concluded a new Collective
Bargaining Agreement that became effective on Tune I, 2021 through May 31, 2026. It is a five-year agreement. We enclosed herein
a copyof that CRA.
All signatory contractors must abide by all terms of the CBA. There are no exceptions, and no work rules are allowed which vary
from the terms set out in the Union Agreement. The majority of contractors do follow the prescribed work rules. Those that do not
are attempting to compete to their advantage on an uneven playing field. Local 502 will not permit any contractors to undermine fair
competition by requiring members to work under rules that are different from the rules set out in the CBA.
Union business agents, foreman and members all monitor compliance with union work rules. Be advised that any violation of the
union's work rules, whether flagrant or not, will result in litigation against the violating contractor. Fair competition and not litigation
is our goal. Call a business agent or our office if you have any questions as to whether your practice is in violation of Local 502 work
rules.

NOTICE TO EMPLOYERS
Dear Employers;
Many of you have requested the opportunity to contribute benetits on your own behalf to our Welfare and Pension Plans. Some of
you simply because you have recognized the quality of our Plans and some of you have wished to maintain a cuutiuuity of benetits.
In fact, in 1955, the Trustees passed a resolution allowing employer contributions, provided that the employer contributed a
minimum of twelve hundred hours (1,200) per year on his own behalf. This, of course, would be regardless of the fact that the
employer might have worked less than that number of hours per year. Later, you were notified that contributions were not
acceptable for employers.
in order to provide benefits for those working at the trade, the Trustees have passed the following resolution:
1. An owner/employer of a corporation who is active at the trade may participate in the plan of benefits. Note that you must
he incorporated. Partners and sole proprietors may not contribute under any circumstances.
2. If any owner/employee is not active at the trade, but wishes to be covered, you must contribute benefits on all non -
bargaining employees who are not otherwise covered by a bargained -for Collective Bargaining Agreement.
That means that, if you are not active at the trade, you must contribute for your secretary or bookkeeper or anyone else who is not
a member or a multi -employer bargained for agreement such as the Cement Masons' fringe benefit funds.
That category of non -bargained individuals must be contributed for on an hourly basis; and, in fact, every non -bargained
employee who works twenty (20) hours a week or more is considered a full-time employee and must be contributed on a forty
hour a week basis, fifty-two (52) weeks a year.
This does not affect your Cement Finishers, only non -bargained, if you wish to participate and are not active in the trade
3. Contributions for an owner -employee must be for a minimum of twelve hundred (I200) hours per
year, Note that the provision is a minimum of twelve hundred hours a year. If you work more than
twelve hundred hours, you must contribute the higher.
4. The Trustees will allow the minimum of twelve hundred hours or more to be retroactive for ten (10)
years. Therefore, iFyou qualify and wish to participate, your records will be reviewed to determine as
to whether or not additional contributions must be made.

APPLICATION FOR PARTICIPATION OWNER -EMPLOYEE OF A CORPORATION
It is understood that the undersigned Employer is a duly licensed corporation.
That the said Employer agrees that in die case of a principal stockholder or owner which is active in the trade, that the said
corporation will contribute for said employees for a minimum of twelve hundred hours (1,200) per year in equal monthly
contributions, except that if the participating stockholder -employee works more than twelve hundred hours (1,200) per year, that the
contributions shall be made for all tours worked, fifty-two weeks (52) per year.
The undersigned Employer further agrees that in those cases in which a stockholder -owner wishes to participate as an employee of
said Corporation and is not active at the trade, then said employer agrees to contribute benefits on behalf of all non -bargained
employees who are not otherwise covered by a bargained for agreement.
Said Employer agrees that if required to contribute for non -bargained employees, contributions shall be made for all employees
working twenty hours (20) per week or more, or far an employee working 1,000 hours a year except that contributions shall be made
for a minimum of forty (40) hours per week, fifty two weeks (52) a year.
The Employer acknowledges that he has an affirmative responsibility to notify the Trust Funds as to whether or not the stockholder -
owner is an active participant in the trade and to notify the Funds at any time said stockholder -owner is no longer an active
participant in the trade.
The Employer hereby agrees to pay the Cement Masons' Institute, Local 502's various Fringe Benefit Funds, for all eligible
employees employed by the Employer, at the contribution rate as called for in the collective bargaining agreement was reached in
area wide negotiations and further, the Employer agrees to be bound by the provisions of the current collective bargaining agreement
with all amendments thereto as negotiated from year to year.
The Employer hereby agrees that he will be bound by the provisions of the Agreement and Declaration of Trust, establishing the
various Fringe Benefit Funds of the Cement Masons' Local 502 and by the Rules and Regulations of the Fund as the said Agreement
and declaration and rules time to time amended.
The Employer further agrees that in those instances in which air employee of a corporation who is an owner or principal stockholder
has participated into the Fund, that said Employer agrees that a minimum of twelve hundred hours (1,200) of contributions must have
made for ten years (t 0) prior to June 1979, or the date of the signing of this agreement, whichever is later. In order to receive any
prior credits toward vesting.
It is further understood that the Trustees may terminate this Agreement at any time it is deemed necessary in the sole discretion of
the Trustees or determined to be in violation of any Federal or State Statute.

SECTION 12.
Bonding to Guarantee Wage Payments & Benefit Contributions
Paragraph I. Amounts. All Employers, regardless of their affiliation with any professional or Industrial Association, employing ten (10) men or less
shall procure, carry, maintain, and deposit with the Union Office a surety bond in the amount of Twenty-five Thousand Dollars ($25,000.00) to guarantee
the wages and benefit contributions due under the terms of this agreement.
All employers employing more than ten (10) men shall procure, carry, maintain, and deposit with the Union Office a surety bond in the amount of Filly
Thousand Dollars $50,000.00 to guarantee the wages and benefit contributions due under the terms of this agreement.
Paragraph 2. Variances. Any Employer who requests permission to satisfy the bonding requirements of this section by posting a bond in the amount
less than that set forth above, shall make written application to the Union for such permission. If the Union, upon consideration of the Employer's
application for a reduced bond, elects to approve same, it may permit bonding in the amount of Ten Thousand Dollars ($10,000.00).
Paragraph 3. Delinquencies. Any Employer who is tound to be in violation of the wage and benefit contribution rates as provided by this agreement or
amendments hereto shall deposit with the offices of the Union or the Trust, as applicable, an additional surety bond of double the normal bond to
guarantee the payment of such wages and benefit contributions.
Any Employer delinquent in benefit contributions to the'frust Funds for sixty (60) days or more or found to be defaulted in his payments as a result of an
audit shall deposit with the Trust Office and additional sum of not less than Eight Thousand Dollars ($8,000.00) by certified check or cash or an amouIPt
equal to three (3) months regular contributions, as required by the Trustees, or whichever amount is greater, within the sole discretion of the Trustees.'.

Illinois, Cook, Lake, Kane, Will and DuPage Counties.
The Northern Illinois District Council of Operative Plasterers' & Cement Masons' International Association has agreed by
motion to allow employers employing its members to pay wages according to the home local and to pay benefits directly to the
home local of each cement finisher.
The home local shall be defined as the local that the member holds a membership in good standing.
The dues' structure shall be that of the home local hereinafter whether this memorandum is signed or not.

NOTICE 10 ALL CEMENT MASONS CONTIRACTORS
Please be advised that a special meeting of the Pension, Welfare, Retiree Welfare, Apprentice and Educational and Savings Trust
Funds, the Trustees of each of these Funds in accordance with each respective trust agreement, unanimously adopted resolutions
setting forth the enforcement procedures for the collection of delinquent contribution payments, therefore, the collection
program is as follows:
A late payment charge of 15% will be assessed against all delinquent contribution payments. All payments due each of said
funds should become due and payable in the respective Trustees offices on the 151h day following the preceding month. For the
purpose of this program, the Contractor shall be given an additional 15-day grace period. Accordingly, Contractors shall be
required to make payment 30 days after the close of the previous month. Thereafter, if payment is not received in the Trustees
offices on the said 3011 day, the 15Mh late payment charge will be sent to the Contractor immediately upon determination of the
amount of the delinquent contribution.
Said resolutions further provide that all Contractors shall be audited at least once every three years as well as at such times as
claims or other information has brought to light the possible delinquency in contributions of a Contractor. If an audit is
conducted pursuant to either auditing program or delinquent payment or payments are uncovered, the Contractor shall pay all
costs of said audit. IFno delinquency is uncovered, the respective Funds shall absorb the cost of the audit.
Your cooperation will be deeply appreciated in the enforcement of this entire program.

IMPORTANT NOTICE TO ALL CONTRACTORS
Section 11, Paragraph 1 (a) of Current Agreement
For the purposes of reciprocity within the Northern Illinois District Council of the operative
Plasters' and Cement Masons' International Association consisting of Local Unions Nos. 502,
5, and the areas 161, 362, 638, of the International Local No. 11, there shall be a home local
or area for each member.
The term "home local union" is defined as the local union or area in which an individual is
a member in good standing or is dispatched from.
All authorized check -off, working dues, fringe benefits, training and savings funds small be
paid to the person's home local union in the same manner and in the same amounts as if the
hours of work had been performed within the jurisdiction of the Cement Masons Home Local
regardless of where the work was actually performed.
Section 6, Paragraph 4: New Equipment. Whenever a paving machine, concrete spreading machine,
mechanical straight edge, multiple troweling machine, or similar type machine or any other
new equipment or procedure is to be used on any type of work covered by this Agreement, which
in the opinion of the Union could adversely affect the job security of employees covered by
this Agreement, a prejob conference will be held. (This includes the Laser Screed.)
