As part of a cleanup of open permit records during the Village's transition to the OpenGov system, staff identified two nonconforming site elements: a side yard patio encroaching into the required 5- foot setback, and a driveway widened with asphalt beyond the maximum allowed width. The applicant is seeking variations to bring both conditions into conformance and allow final closure of the outstanding building permit. ANALYSIS There is no evidence of adverse impact to neighboring parcels, and total lot coverage remains below the allowable 65% threshold for the R-4A district. The improvements are consistent with the property's residential use and character, and approval will allow closure of an open permit record. Consistency with Village Policy STAFF RECOMMENDATION Approval of the requested variations. BOARD ACTION REQUESTED Motion to adopt the ordinance. ORDINANCE NO. 0 AN ORDINANCE GRANTING VARIATIONS TO §17.06.030, §17.07.020, AND ENGINEERING DETAIL LS-6 OF THE LEMONT UNIFIED DEVELOPMENT ORDINANCE (804 Warner Variations) WHEREAS, Manus McClafferty (hereinafter referred to as "the Petitioner") is the owner of the property at 804 Warner Avenue in Lemont, Illinois (PINs 22-29-1 13-012 & 22-29-1 13- 010) (hereinafter referred to as the "Subject Property"), legally described in Exhibit A; and WHEREAS, the Petitioner applied pursuant to the provisions of the Lemont Municipal Code, Title 17, Unified Development Ordinance ("UDO"), seeking variations from § 17.06.030 and Table 17-06-02 (accessory structures), § 17.07.020 (driveway width), and Engineering Detail LS-6 (maximum driveway width at property line) to allow for an existing side yard patio and asphalt driveway extension as depicted in Exhibit B; and WHEREAS, the Lemont Planning and Zoning Commission conducted a public hearing on the request on July 2, 2025, and voted 5-0 to recommend approval of the requested variations; and WHEREAS, a notice of the aforesaid public hearing was made in the manner provided by law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village have reviewed the matter herein and have determined that the requested variation is in the best interest of public health, safety, and welfare of the residents of the Village of Lemont, and hereby adopts the finding of facts as set forth in Exhibit C. NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois as follows: SECTION ONE: The foregoing findings and recitals are hereby adopted as Section 1 of this Ordinance and are incorporated by reference as if set forth verbatim herein. SECTION TWO: The following variations from the UDO are hereby granted for the Subject Property at 804 Warner Avenue: 1. A variation from § 17.06.030 and Table 17-06-02 to allow a side yard patio to be located less than five feet from the property line and aligned with the front fagade of the principal structure; 2. A variation from § 17.07.020 to allow a residential driveway wider than 22 feet within the R-4A zoning district; 3. A variation from Engineering Detail LS-6 to allow a residential driveway width exceeding 22 feet at the property line (approximately 30 feet wide). SECTION THREE: Conditions. The following conditions apply: 1. Unless otherwise approved by the Village Board, the Subject Property shall be developed and maintained in accordance with the Lemont, Illinois Municipal Code and this Ordinance. 2. The improvements shall substantially conform to the site configuration shown in the Plat of Survey and photographs submitted with the application. SECTION FOUR: The Village Clerk is directed to publish this Ordinance in pamphlet form in accordance with applicable law. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval, and publication as provided by law. Based upon the evidence and testimony presented during the public hearing, the Lemont Village Board of Trustees finds the following: 1. The Lemont 2030 Comprehensive Plan's future land use ►nap designates the subject site as Infill Residential (INF). 2. The subject property is within the R-4A zoning district. The requested variation adequately meets the standards for granting variations within the Unified Development Ordinance.
