SUMMARY/BACKGROUND
The current NPDES Permit IL0039551 requires the Village to investigate, correct, and restore
operation to the 12-inch siphon pipe under the I & M Canal by December 31, 2025. This
project was included in the Revised Long -Term Control plan as outlined by the IEPA and
included in the FY26 Budget. Staff obtained two quotes for this project. The low quote in the
amount of $68,000.00 was submitted by Underground Pipe Solutions, 8113 46th Street, Lyons
IL 60534. The vendor has done similar work for the Village in the past that is deemed
satisfactory.

A RESOLUTION AUTHORIZING THE CLEANING AND TELEVISING OF THE 12-
INCH SIPHON PIPE UNDER THE I&M CANAL
WHEREAS it has become necessary for the Cleaning and Televising of the 12-inch
Siphon Pipe Under the I&M Canal; and
WHEREAS, in connection with the work to be conducted on the 12-inch Siphon Pipe
Under the I&M Canal, the Village has researched and evaluated available options and contractors;
and
WHEREAS, upon review by Village staff, it was concluded that the greatest benefit to
the Village will be realized by waiving the bidding process and accepting the proposal for
Cleaning and Televising the 12-inch Siphon Pipe Under the I&M Canal with Underground Pipe
Solutions, 8113 461h Street, Lyons, IL 60534, in an amount not to exceed $68,000.00; and
WHEREAS, Section 5/8-9-1 of the Illinois Municipal Code (65 ILCS 5/8-9-1) allows the
Board of Trustees of the Village ("Village Board"), upon a vote of two-thirds of the trustees then
holding office, to waive the requirements for competitive bidding; and
WHEREAS, The Village Board has determined that it is advisable, necessary, and in the
best interest of the Village to waive competitive bidding and authorize the Cleaning and
Televising of the 12-inch Siphon Pipe Under the I&M Canal for $68,000.00.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows:
SECTION 1:
Incorporation Recitals. The foregoing findings and recitals are hereby adopted as Section
One of this Resolution and are incorporated by reference as if set forth verbatim herein.
SECTION 2:
Waiver of Public Bid Requirements and Authority to Purchase. The Village Board hereby
waives the competitive bidding requirements otherwise applicable to the Cleaning and Televising
the 12-inch Siphon Pipe under the I&M Canal by Underground Pipe Solutions at a price not to
exceed $68,000.00 as Exhibit A.
SECTION 3:
The Village Administrator or his designee is hereby authorized to execute any documents
and take any other steps necessary to complete the Cleaning and Televising of the 12-inch Siphon
Pipe Under the I&M Canal by Underground Pipe Solutions at a price not to exceed $68,000.00
and to otherwise carry out this Resolution.
SECTION 4:
This Resolution shall be in full force and effect from and after its passage and approval as
provided by law.

SUBJECT: BYPASS PUMPING, DEWATERING, CLEANING & CLOSED CIRCUIT TV
INSPECTION OF 30" SIPHON SEWER
We propose to furnish the necessary labor, supervision and equipment to perform a closed-circuit color TV
inspection of sewer as described in the Scope of Work below. This proposal includes preparatory cleaning with
high velocityjetting equipment. Computerized log sheets describing observations noted during the inspection will
be firnished along with the recorded video tape/DVD(s).
SCOPE OF WORK
Bypass pump, dewater, clean and televise approximately 20OLF of 30" siplion sewer line located near 102
Stephens St, Lemont, IL 60439.
PURCHASER WILL FURNISH
Water for our high velocity jetting equipment; any special permits or fees, access to all manholes and sewer lines;
and a dump site (if required) for disposal of debris removed from the sewers and/or manholes during cleaning;
additional traffic control should it be necessary to provide more than standard traffic cones and truck -mounted
arrow boards, at no additional charge to us. A representative from HR Green is required to be on site at the time
of scheduled work.
PRICE
Charges for the above services will be computed at the rate of the LS bypass equipment charge of $15,200.00
and crew hourly rate of $1,400.00/hr., portal to portal, including water fill -up and disposal at an approved dumpsite
from our office in Chicago, with a four-hour minimum charge including pre -trip inspection of our truck and travel
time. Disposal of debris (if any) will be charged at $125.00/ton if no dump site is provided. Work is estimated at
three to five 8-10 hour workdays, including travel, to complete. Price includes: CCTV camera rig, Jetter/Vactor
combo Truck, Two (2) 3,500 gallon water tankers, pick up tuck w/tow behind air compressor, 6" pump, suction
and discharge hoses, air hoses, one 30" Pneumatic Plug, 5-person crew. Not to exceed amount without customer
approval- is estimated at five 8-hour working days ($56,000.00), including travel, and lump sum bypass
equipment charge ($15,200.00), totaling the amount of $71,200.00 NTE.

GENERAL TERMS AND CONDITIONS
General Conditions: 'These general conditions are incorporated by reference into the proposal and arc part of the
Agreement under which services are to be performed by the Contractor for the Customer. Contractor will follow
Cuslonncr's instructions both verbal and written at all times.
Customer Provided Labor: Where the Customer provides labor for lute Contactor, line Customer will indemnify
the Contactor for liability, loss or expense for work related injuries to those laborers not provided by the Contractor.
The Customer agrees to waive all rights of subrogation against the Contractor arising out of the work in this
Agrecmcnl. The Customer agrees to comply, with all local, state and federal regulations, including regulations
governing issues pertaining to the environment, employee safety and health, public safety, and vehicular safety, such
as those regulations enforced by the United Slalcs Occupational Safety and Health Administration, Environnnental
Protection Agency, Mine Safety and Health Administration and Deparhnent of Transportation. This includes all
training of customer's employees and provision of suitable and safe equipment, as required by the applicable
governmental regulations.
Customers Responsibilities: Customer will provide mechanical services. Operation and control of Customer's
equipment is the Customer's responsibility. If Contactor cannot continue its work due to circumstance caused or
allowed by Customer and of which Contractor was not apprised prior to starting the work, an hourly fee will be
charged.
Non-Sollettation of National Power- Rodding (NPR) Personnel: At no lino while this Agreement is in effect nor
within one (1) year innmcdiately following completion of li►e Work shall Custoner solicit directly or indirectly any
employee or former employee of NPR who performed or supervised the Work, provided that Customer shall not be
prevented from soliciting such employees through general advertisements not targeted at such employees.
Damage Limitations: Under no circumstances will the Contractor be responsible for indirect, incidental or
consequential damages. The Contractor also is not responsible for the rendering of or failure to render architectural,
engineering or surveying professional services.
Pre-existing Conditions: The Contractor will not be responsible for liability, loss or expense (including damage
caused by the backup of basement sewers) where the primary cause of the claim or damage is pre-existing
conditions including faulty, inadequate or defective design, construction, maintenance or repair of property or
contamination of the subsurface where the condition existed prior to the start of the Contractor's work. Customer is
responsible for loss of set -vice equipment caused by the pre-existing conditions at the job site.
Environmental Conditions: The debris is represented to Contactor to be non -hazardous, requiring no manifesting
or special permitting. The Customer will be responsible for any additional costs or claims associated with the
treatment, storage, disposal of the removed debris, or breach of the above representation, at any lime during or after
the completion of this project.
IndeunIflea tion: The Customer and the Contractor will each indemnify the other in proportion to relative fault for
liability, loss and expense incurred by the other party resulting from a negligent act or omission in performance of
work under this Agreement. The Customer also will indemnify Contractor for liability, loss and expense resulting
from Contractor's services if the Contactor is acting at the direction or instruction of the Customer, or where the
primary cause of any damages is due to information provided by the Customer.
Credit Policy: Regular Perms are Net 30 Days. If any invoice is not paid in accordance with its terms, the customer
agrees that there shall be added thereto, and the customer agrees to pay to contractor, a late charge at the rate of
1.5% per month on the unpaid balance, plus all costs, including reasonable attorney fees, incurred by the contractor
in collection of any invoice not paid in accordance with its terns.
Entire Agreement: This proposal together with any written documents which may be incorporated by specific
reference herein constih►tes the entire agreement between the parties and supersedes all previous communications
between them, either oral or written. The waiver by Contractor of any term, condition or provision herein stated
shall not be construed to he a waiver of any other term, condition or provision hereof.
