O-35-25 Granting Variations From §17.06.030, §17.07.010, Table 17-07-01, and §17.07.020 of the Lemont Unified Development Ordinance for0-3��-d; 418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jamie Tate, Community Development THROUGH: Jason Berry, CEcD, AICP, Economic & Community Development Director SUBJECT: An Ordinance Granting Variations From §17.06.030, §1 7.07.010, Table 17- 07-01, and §17.07.020 of the Lemont Unified Development Ordinance for 210 Cass Street, Lemont, IL DATE: June 23, 2025 SUMMARY/BACKGROUND The applicant and property owner, Michelle Coco, is requesting zoning variations to allow construction of a new two-story single-family home with an attached side -loaded garage at 210 Cass Street. The property is zoned R-4A and currently includes a two-story, approximately 1,000 sq. ft. detached garage, which is proposed to remain. Variations are requested to: • Allow both an attached and a detached garage on the same lot. • Reduce the required east side yard setback from 7.92 feet to 5 feet. • Permit access to both garages from Cass Street rather than the alley. ANALYSIS Comprehensive Plan The subject property is within the Infill Residential future land use designation in the Lemont 2030 Comprehensive Plan. Planning_& Zoning Commission (PZCI A public hearing to discuss the requested variations was held at the PZC meeting on June 4, 2025. The PZC voted (4-0) to recommend approval with conditions that have been incorporated into the attached ordinance. Committee of the Whole (COW) The proposal was discussed at the COW meeting held on June 17, 2025. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Approval of attached ordinance. BOARD ACTION REQUESTED Motion to approve attached ordinance. ORDINANCE NO. ®- 3 +� AN ORDINANCE GRANTING VARIATIONS FROM §17.06.030, §17.07.010, TABLE 17- 07-01, AND §17.07.020 OF THE LEMONT UNIFIED DEVELOPMENT ORDINANCE FOR 210 CASS STREET, LEMONT, ILLINOIS (210 Cass Variations) WHEREAS, Michelle Coco (hereinafter referred to as "the Petitioner") is the owner of the property at 210 Cass Street in Lemont, IL (PIN# 22-20-319-003-0000) (hereinafter referred to as the "Subject Property"), legally described in Exhibit A; and WHEREAS, the Petitioner applied pursuant to the provisions of the Lemont, Illinois Municipal Code, Title 17 Unified Development Ordinance ("UDO") seeking a variation to § 17.06.030, § 17.07.010, Table 17-07-01 and § 17.07.020 from the UDO to allow for a new detached single-family home with a side -loaded attached garage with a reduced side yard setback and retaining the existing detached garage and providing driveway access to Cass Street in the R- 4A zoning district, as depicted in Exhibit B; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois conducted a public hearing on June 4, 2025 and voted 4-0 to recommend approval of the requested variations with conditions incorporated into this ordinance; and WHEREAS, a notice of the aforesaid public hearing was made in the manner provided by law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village have reviewed the matter herein and have determined that the requested variation is in the best interest of public health, safety, and welfare of the residents of the Village of Lemont, and hereby adopts the finding of facts as set forth in Exhibit C. NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois as follows: SECTION ONE: The foregoing findings and recitals are hereby adopted as Section 1 of this Ordinance and are incorporated by reference as if set forth verbatim herein. SECTION TWO: The following variations from the UDO are hereby granted: 1. § 17.06.030 —Allow the existing detached garage to remain with anew side -loaded attached garage. 2. § 17.07.010 and Table 17-07-01 —Reduce the required side yard setback along the eastern property line from 7.92 feet to 5 feet. 3. § 17.07.020 —Allow garage access from the existing driveway to Cass Street rather than from the adjacent alley. SECTION THREE: Conditions. The following conditions apply: 1. Unless otherwise approved by the Village Board, the Subject Property shall be developed and maintained in accordance with the Lemont, Illinois Municipal Code and this Ordinance. 2. The existing detached garage shall not be used for habitation or any commercial activity and shall remain accessory in use. 3. The detached garage shall incorporate exterior materials and finishes consistent with the new home. The detached garage improvements will be a part of the new home permit and occupancy shall not be granted on any permit until detached garage improvements are completed. 4. All mature landscaping and trees, particularly parkway trees, shall be preserved and protected throughout the duration of construction. SECTION FOUR: That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. Based on the evidence presented at the public hearing and the record of proceedings, the Village Board of Trustees finds that the requested variations meet the standards for granting zoning variations as set forth in § 17.04.150 of the Lemont Unified Development Ordinance. In making this determination, the Board considered, among other factors: 1. The presence of unique physical characteristics affecting the property; 2. The property's existing conditions and structures; 3. The extent to which the request aligns with the purposes and intent of the UDO; 4. The relationship of the proposed relief to the character of surrounding development; and 5. The designation of the subject property as Infill Residential (INF) in the Lemont 2030 Comprehensive Plan. The Village Board finds that the variation standards have been sufficiently addressed in the application and testimony, and incorporates these findings into the ordinance.
