O-29-25 Amending Title 17 of the Lemont Municipal Code, The418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jamie Tate, Community Development THROUGH: Jason Berry, CEcD, AICP, Economic & Community Development Director SUBJECT: An Ordinance Amending Title 17 of the Lemont Municipal Code, The Lemont Unified Development Ordinance of 2008 DATE: June 9, 2025 SUMMARY/BACKGROUND The proposed update to the Unified Development Ordinance (UDO) adds a definition of 'architectural metal', 'solar energy systems' and 'wind power device'. They were never defined in the UDO. Solar energy systems and wind power devices have been separated in the accessory use table as recommended by the Planning and Zoning Commission. The proposed amendment will allow sheds to be in the Institutional (INT) up to 320 square -feet in area, when sheds in residential zoning districts can be a maximum of 160 square -feet in area. Lastly, the proposed amendment modifies prohibited building materials, allowing architectural metal on non -street facing facades up to a total of 25% of a wall. ANALYSIS Comprehensive Plan The UDO amendments are consistent with the Lemont 2030 Comprehensive Plan, which encourages annual review and updates to ensure the UDO remains relevant and effective. Planning & Zoning Commission (PZC) A public hearing to discuss the amendments was held at the PZC meeting on May 7, 2025 and the PZC voted (4-0) to recommend approval of the UDO amendments with additions and modifications incorporated into the ordinance. Commitee of the Whole The Commitee of the Whole reviewed and discussed the proposed UDO amendments at the meeting held on May 19, 2025. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Approval of attached ordinance. BOARD ACTION REQUESTED A motion to approve the attached ordinance. ORDINANCE NO. Zq'2- AN ORDINANCE AMENDING TITLE 17 OF THE LEMONT MUNICIPAL CODE, THE LEMONT UNIFIED DEVELOPMENT ORDINANCE OF 2008 (Definitions, Sheds and Materials in INT) WHEREAS, the Village of Lemont approved Ordinance 0-07-08 adopting the Lemont Unified Development Ordinance of 2008 (hereinafter "the Unified Development Ordinance") with an effective date of March 15, 2008; and WHEREAS, on May 7, 2025 the Lemont Planning & Zoning Commission, in accordance with the requirements of the Illinois Combined Statutes and the Unified Development Ordinance, conducted a public hearing for the proposed amendments to the zoning and land use regulations of the Unified Development Ordinance; and WHEREAS, notice of the aforesaid public hearing was made in the manner provided by law; and WHEREAS, the Lemont Planning & Zoning Commission found that the proposed amendments are consistent with the purposes of the Unified Development Ordinance and voted (4-0) to recommend their approval with modifications incorporated into the language. NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Cook, DuPage and Will Counties, Illinois, as follows: SECTION ONE: The foregoing findings and recitals are hereby adopted as Section 1 of this Ordinance and are incorporated by reference as if set forth verbatim herein. SECTION TWO: Section 17.02 ("Definitions") of Article II ("Zoning") of Title 17 ("Unified Development Ordinance") of the Village Zoning Code is hereby amended with additions shown in underlined text, to be placed in alphabetical order, and deletions shown in s'�-i'��� in alphabetical order to provide as follows: ARCHITECTURAL METAL. A high-auality, factory -finished metal product specifically designed for use as a visible architectural element on a building's exterior. Architectural metal includes materials such as formed panels, soffits, fascia, louvers, screens, and trim that contribute to the design character, and durability of the facade. All architectural metal must have a consistent finish (i.e. woodgrain), texture, and color, and must be treated or coated to resist corrosion, fading, and weathering. SOLAR ENERGY SYSTEM. An accessory structure or device designed to collect, convert, store or distribute solar energy for heating, cooling, lighting or electrical generation. This includes but is not limited to photovoltaic panels, solar thermal collectors, inverters, and mounting systems. Solar energy systems may be ground -mounted or building -mounted and are subject to applicable setback height and placement standards in this ordinance. WIND POWER DEVICE. An accessory structure or system designed to convert wind energy into mechanical or electrical power. This includes wind turbines, towers, blades, generators and associated equipment. Wind power devices may be mounted on buildings or installed as freestanding structures and are subject to applicable height, setback, and placements standards of this ordinance. SECTION THREE: The Lemont, Illinois Municipal Code ("Village Code"), as amended, is further amended in Title 17, Unified Development Ordinance Chapter, with additions shown in underlined text, to be placed in alphabetical order, and deletions shown in str4kethfougk to Chapter 17.06.030 Accessory Uses and Table 17-06-02, of the Village Code as follows: 17.06.030. — Accessory Uses. E. Detached Garages and Sheds. 1. In R and INT districts, detached garages and sheds shall be accessory uses only; they shall not be constructed prior to the establishment of a permitted principal use on the lot. 2. Detached garages and sheds shall be built at least three feet from all lot lines, unless specifically allowed otherwise by this ordinance. Additionally, detached garages and sheds shall be at least 10 feet from the principal structure unless the detached garage or shed meets or exceeds the Village building code standards for attached garages concerning fire protection rating, footing, and foundation. 3. Detached garages and sheds in R and INT districts and detached garages and sheds that are accessory to residential uses shall have a maximum height of 15 feet. Parking structures in the Downtown District are subject to the height limits of the zoning district. Detaebed gafages and sheds in all ether- distr-iets shall have -a f.., height f30 feet. SECTION FIVE: The Lemont, Illinois Municipal Code ("Village Code"), as amended, is further amended in Title 17, Unified Development Ordinance Chapter, with additions shown in underlined text, to be placed in alphabetical order, and deletions shown in stfikethr-eugh to Chapter 17.21.040 Prohibited Materials, of the Village Code as follows: 17.21.040. — Prohibited Materials. A. The use of metal exterior panels on building elevations is prohibited.. with the following exception: 1. Architectural metal can be used for up to 25% of each building elevation wall not facing a public street in the INT District. Plain, unfinished, corrugated, or industrial -grade metal is not permitted. SECTION SIX: That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION SEVEN: Should any Section or provision of this Ordinance be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the Ordinance as a whole or any part thereof other than the part declared to be invalid. SECTION EIGHT: This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
