SUMMARY/BACKGROUND
Marth Construction, in coordination with Castletown Homes and on behalf of Equestrian
Meadows Development Company LLC, has submitted a formal request to transition the
Equestrian Meadows subdivision into its two-year maintenance period. The request included
engineering backup, a Bill of Sale for completed improvements, and was reviewed and
recommended by the Village's acting engineer.
Following site inspection and review, the public improvements have been deemed
substantially complete and in accordance with Village specifications. Accordingly, the Village
Engineer recommends reducing the Letters of Credit to reflect the maintenance obligation.

A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS
AND REDUCING THE LETTERS OF CREDIT FOR
EQUESTRIAN MEADOWS SUBDIVISION PHASES I & II
WHEREAS, certain real property has been dedicated to the Village, as depicted in
Equestrian Meadows Phases I & II (attached hereto as Exhibit A), for the purpose of public
infrastructure; and
WHEREAS, pursuant to the Lemont Unified Development Ordinance of 2008
("UDO"), an owner or developer of a subdivision is required to deposit certain security or
evidence thereof with the Village of Lemont to guarantee the installation of public
improvements; and
WHEREAS, in the matter of the Equestrian Meadows subdivision located north of
McCarthy Road and west of Rell Road in Lemont, Irrevocable Letter of Credit #2016001135,
issued by Old National Bank in the original amount of $1,867,933.00 and Irrevocable Letter
of Credit #6590123279, issued by Heartland Bank and Trust Company in the original amount
of $492,769.54 were deposited with the Village of Lemont to guarantee completion of
subdivision improvements; and
WHEREAS, Marth Construction, in conjunction with Castletown Homes, on behalf
of Equestrian Meadows Development Company LLC, requested acceptance of public
improvements in the Equestrian Meadows Phases I & II Subdivision and provided a Bill of
Sale for said public improvements (attached hereto as Exhibit B); and
WHEREAS, Bruce A. Hill, P.E., of HR Green, Inc., on behalf of the Village,
reviewed the developer's request for reduction and determined that the public improvements
have been completed in accordance with approved plans and specifications, and recommends
the reduction and initiation of the two-year maintenance period; and
WHEREAS, pursuant to the UDO, the initiation of the two-year subdivision
maintenance period shall commence upon the passage of this resolution;
NOW, THEREFORE BE IT RESOLVED by the Village President and Board of
Trustees of the Village of Lemont, Cook, Will, and DuPage Counties, Illinois, as follows:
SECTION 1; RECITALS
That the above recitals and legislative findings are found to be true and correct and
are hereby incorporated herein and made a part hereof, as if fully set forth in their entirety.
SECTION 2:
That the required two-year maintenance period shall hereby commence and shall
expire two years from the date of passage of this Resolution.
SECTION 3:
That the public improvements in Equestrian Meadows Phases I & II are hereby
accepted and:
• Irrevocable Letter of Credit #2016001135 is hereby reduced to $124,174.01
• Irrevocable Letter of Credit #6590123279 is hereby reduced to $42,849.50

BILL OF SALE
KNOW ALL MEN BY THESE PRESENTS, that Equestrian Meadows Development LLC,
an Illinois Corporation (hereinafter referred to as the "Developer"), in consideration of TEN
DOLLARS ($10.00) and other valuable consideration, does hereby grant, sell, transfer, and deliver
unto the VILLAGE OF LEMONT, an Illinois municipal corporation, the goods, chattels and other
items of personal property in connection with the EQUESTRIAN MEADOWS SUBDIVISION,
Phase 1 and Phase 2 namely:
All public improvements located within the Equestrian Meadows Subdivision, Phase 1 and
Phase 2 located generally north of McCarthy Road and west of Bell Road in the Village of
Lemont, such public improvements including but not limited to all sanitary sewer and
water lines, all storm sewer lines, all streets and street improvements, all curbing, all
sidewalks, all streetlights, signs, and parkway trees.
The object of this Bill of Sale is to grant, sell transfer, and deliver to the Village, with the
exceptions noted, the ownership of all items of personality that comprise the sanitary sewer, water
distribution system, storm sewer system, the street system and other public improvements
installed by the Developer to date within the Equestrian Meadows Subdivision, Phase 1 and Phase
2, located in the Village of Lemont, IL 60439.
FURTHER BE IT KNOWN: That the Developer does hereby covenant that it is the lawful
owner of the heretofore described goods, chattels, and personality; that such items are free from all
encumbrances; that it has the right to sell the same as aforesaid; and that it warrants and will
defend the act of said Corporation.
