SUMMARY/BACKGROUND
The attached annexation agreement pertains to the 15.9-acre property at 12100 Bell Road,
owned by Raymond and Angel Wallin. The property is currently located in unincorporated
Cook County and is not within the boundaries of any other municipality. The agreement
outlines the terms under which the parcel will be annexed into the Village of Lemont.
Upon annexation, the property will be zoned R-5A Residential District. The agreement does
not include any immediate development proposal. Any future development of the property will
be required to comply with all Village ordinances, including the Unified Development
Ordinance (UDO), building codes, and permitting procedures in effect at that time.
The Village has confirmed it has sufficient water and sanitary sewer capacity to support
residential development on the property, although any future utility extensions or public
improvements will be at the owner's expense. No variances or special considerations have
been granted as part of this agreement. The agreement will be recorded with the Cook County
Recorder of Deeds and will remain in effect for a period of twenty (20) years.
ANALYSIS
There are no unique development considerations or policy deviations in the agreement. The
document follows the Village's standard annexation framework, establishing clear
expectations for zoning, utility service, and future permitting. The proposed zoning aligns with
the Lemont 2030 Comprehensive Plan and mirrors adjacent residential zoning patterns. No
fiscal incentives or development guarantees are included.

WHEREAS, the Village Lemont desires to enter into an Annexation Agreement with
Raymond Wallin and Angel Wallin for the territory described in Exhibit A attached hereto and
incorporated herein by reference; and
WHEREAS, Raymond Wallin and Angel Wallin are the owners of record of the territory,
which is the subject of the Annexation Agreement, are ready, willing and able to enter into the
Annexation Agreement and to perform the obligations as required hereunder; and
WHEREAS, the statutory procedures provided for in the Illinois Municipal Code for the
execution of the Annexation Agreement have been fully complied with.
NOW THEREFORE, be it ordained by the President and Board of Trustees of the Village
of Lemont, Counties of Cook, DuPage and Will, State of Illinois, as follows:
Section 1: The recitals set forth above are incorporated herein by reference and made a
part hereof.
Section 2: The Annexation Agreement, a copy of which is attached hereto as Exhibit B
and made a part hereof is approved subject to such amendments as may be approved by the Village
Administrator. The Village President and Village Clerk are authorized to execute the Annexation
Agreement on behalf of the Village.

Section 3: If any section, paragraph, clause or provision of this ordinance shall be held
invalid, the invalidity thereof shall not affect any other provision of this ordinance.
Section 4: All ordinances, resolutions, motions or orders in conflict with this ordinance
are hereby repealed to the extent of such conflict.
Section 5: This ordinance shall be in full force and effect upon its passage, approval
and publications as provided by law.
ADOPTED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DUPAGE, ILLINOIS, ON

ANNEXATION AGREEMENT
This Annexation Agreement ("Agreement") is made and entered into as of the (9� day of
,kblri , 2025 ("Effective Date", between the Village of Lemont, an Illinois municipal
co oration located in Cook, DuPage, and Will Counties, Illinois ("Village") and Raymond
Wallin and Angel Wallin ("Owner") individually "Party" and collectively "Parties."
WITNESSETH
WHEREAS, the Owner is the owner of the property commonly known as 12100 Bell
Road and which is legally described on Exhibit A attached hereto and made a part hereof
("Property"), which property is the subject of this Agreement; and
WHEREAS, the Owner has submitted to the Village a petition for annexation of the
Property as shown on the Plat of Annexation attached hereto as Exhibit B and made a part
hereof; and
WHEREAS, the Property is contiguous to the Village, and none of the Property is
presently within the corporate limits of any other municipality; and
WHEREAS, the Parties hereto wish to enter into this Agreement with respect to the
annexation of the Property to the Village, and to other related matters pursuant to 65 ILCS 5111-
15.1-1 et seq., upon the terms and conditions contained in this Agreement; and
WHEREAS, all public hearings as required by law have been held by the appropriate
departments, commissions, boards, and other governmental bodies of the Village; and
WHEREAS, the annexation of the Property to the Village will be beneficial to the
Village, will properly and beneficially extend the corporate limits and the jurisdiction of the
Village, and will otherwise promote the proper growth and general welfare of the Village; and
WHEREAS, the Village is a Municipal Corporation of the State of Illinois and has in full
force and effect various ordinances and amendments thereto relating to the development and
zoning of real estate including, but not limited to, the Village's Unified Development Ordinance
("UDO"); and
WHEREAS, the Village has agreed to zone the Property to R-5A Residential District
upon annexation; and
WHEREAS, the Parties hereto desire the Property to be annexed to the Village on the
terms and conditions hereinafter set forth;
NOW, THEREFORE, for and in consideration of the foregoing preambles and mutual
covenants and agreements contained herein, the Parties hereto agree as follows:
1. RECITALS. The Recitals are incorporated herein and constitute a part of
this Agreement.
2. LEGAL CONFORMANCE WITH LAW. This Agreement is made pursuant
to, and in accordance with, the provisions of the Lemont Municipal Code
and the applicable provisions of the Illinois Compiled Statutes.
3. PETITION TO ANNEX. The Owner has filed with the Village Clerk a duly
executed petition pursuant to 65 ILCS 5/7-1-8 to annex the Property to the
Village.
4. ANNEXATION. The Village hereby agrees to annex the Property upon the
terms and conditions of this Agreement, and the Parties respectively agree
to do all things necessary and appropriate to cause the Property to be
annexed to the Village including the passage of necessary ordinances by the
Village.
5. ZONING. Upon annexation, the Property shall be zoned R-5A Residential
District in accordance with the Village's Unified Development Ordinance
("UDO"). No development is proposed at this time by the Owner. Any
future development of the Property shall comply with all applicable Village
ordinances and approval processes in place at the time of such
development.
6. DEVELOPMENT STANDARDS. The Owner acknowledges that any
future development of the Property will be subject to the Village's UDO,
Building Code, and all other applicable ordinances, regulations, and
requirements, and that no variations from these requirements have been
requested or granted as part of this Agreement. The Village represents and
warrants to the Owner that it has sufficient potable water and sanitary
sewer capacity to serve the Property as an R-5A Residential District.
7. UTILITIES AND PUBLIC IMPROVEMENTS. The Village shall not be
obligated to provide utilities or public improvements as part of this
annexation. Any extension of utilities or construction of public
improvements necessary for future development shall be at the sole cost of
the Owner and subject to all applicable permitting, design, and approval
standards of the Village and other applicable agencies.

S. FEES. The Owner shall be required to pay all applicable fees, including but
not limited to permit, license, and inspection fees, at the time of future
development of the Property, in accordance with Village ordinances in
effect at that time.
9. RECORDING. This Agreement shall be recorded by the Village Clerk in
the Office of the Recorder of Deeds of Cook County, Illinois, at the
expense of the Owner.
10. TERM. This Agreement shall be binding upon the Parties for a full term of
twenty (20) years from the date of execution.
11. INVALIDITY. If any provision of this Agreement is held invalid, the
validity of the remainder shall not be affected.
12. BINDING EFFECT. This Agreement shall inure to the benefit of, and be
binding upon, the successors and assigns of the Owner and the Village.
13. APPROVAL. This Agreement shall not be effective until it is signed by all
Parties and recorded.
14. HOLD HARMLESS. The Owner agrees to defend and hold harmless the
Village from any claims or legal actions arising out of or related to this
annexation.
15. NO LIABILITY OF VILLAGE OFFICIALS. No agreement or
undertaking of the Village contained in this Agreement shall be deemed to
be a personal covenant, agreement or undertaking of any officer, employee
or agent of the Village and no officer, employee or agent of the Village
shall be personally liable under this Agreement or be subject to any
personal liability in connection with or arising out of the execution,
delivery and performance or nonperformance of this Agreement.
