O-22-25 Rezoning 3.99 Acres of Property at 14306 McCarthy and 14322 McCarthy Road in Lemont, IL (Seven Oaks II)i 418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jason Berry, Community Development THROUGH: SUBJECT: An Ordinance Rezoning 3.99 Acres of Property at 14306 McCarthy Road and 14322 McCarthy Road in Lemont, IL (Seven Oaks II) DATE: April 28, 2025 SUMMARY/BACKGROUND Lemont LLC, represented by attorney Alexander Domanskis, is requesting approval of an ordinance to rezone approximately 3.99 acres at 14306 and 14322 McCarthy Road to R-5 Attached Single -Family Residential District. The rezoning supports the proposed Seven Oaks II townhome subdivision and applies to the two parcels just annexed, joining the 0.4-acre parcel already zoned R-5 and annexed in 2015 as part of the original Seven Oaks development. ANALYSIS Comprehensive Plan The Lemont 2030 Comprehensive Plan envisioned the future land use as Multi -Family Mid - Rise, a residential land use designation. The proposed rezoning and associated subdivision are supported by the Comprehensive Plan. Planning_& Zoning Commission (PZC) A public hearing was held on March 5, 2025 to discuss the annexation and rezoning to R-5 for the purpose of a 24-unit townhome subdivision. The PZC voted (7-0) to approve the rezoning with conditions that have been incorporated into the forthcoming PUD ordinance. Committee of the Whole (COW) The rezoning was discussed at the COW meeting held on March 24, 2025. Comments have been incorporated into the forthcoming PUD ordinance. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Approval of the attached ordinance. BOARD ACTION REQUESTED A motion to approve the attached ordinance. O- 9�— -25 AN ORDINANCE REZONING 3.99 ACRES OF PROPERTY LOCATED AT 14306 & 14322 MCCARTHY ROAD IN LEMONT, ILLINOIS (Seven Oaks 1I) WHEREAS Lemont LLC, represented by Attorney Alexander Domanskis, (hereinafter referred to as the "Petitioners") is the owner of the subject property covering approximately 3.99- acres (PINS# 22-27-300-029-0000 & 22-27-300-027-0000) located 14306 & 14322 McCarthy Road (hereinafter referred to as the "Subject Property") described and depicted in Exhibit A; and WHEREAS the Petitioner applied pursuant to the provisions of the Lemont, Illinois Municipal Code, Title 17 Unified Development Ordinance for a zoning map amendment from R-1, the default zoning district following annexation into the Village of Lemont, to R-5 for the Subject Property; and WHEREAS the Planning & Zoning Commission of the Village of Lemont, Illinois conducted a public hearing on March 5, 2025 for the rezoning request and voted 7-0 to recommend approval of the rezoning; and WHEREAS the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, ("the Village") is a municipality in the state of Illinois with full powers to enact ordinances and adopt ordinances for the benefit of the residents of the Village; and WHEREAS, the Village and applicant have complied with the statutory procedures and requirements for rezoning of the Subject Property, defined as the 3.99 acres included in this ordinance. 2 NOW THEREFORE, be it ordained by the President and Board of Trustees of the Village of Lemont, Cook, DuPage and Will County, Illinois as follows: SECTION 1: That the above recitals and legislative findings are found to be true and correct and are hereby incorporated herein and made a part hereof as if fully set forth in their entirety. SECTION 2: The subject property, described in Exhibit A, is rezoned from R-1 to R-5 District in conformance with Village's Unified Development Ordinance. The zoning map of the Village of Lemont is hereby amended in accordance with the provision of this Ordinance. SECTION 3: General Conditions. Unless otherwise approved by the Village Board, the subject property shall be developed and maintained in accordance with the Lemont, Illinois Municipal Code, Annexation Agreement, Seven Oaks II Planned Unit Development Ordinance, and this Ordinance. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. SECTION 5: If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance.
