O-25-25 Granting a Variation to §17.07.020 and §17.10.020 of the Lemont Unified Development Ordinance to Allow for a Detached Garage and Parking Pad at 16 E Custer Street in Lemont, IL418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jason Berry THROUGH: Jason Berry, CEcD, AICP, Economic & Community Development Director SUBJECT: An Ordinance Granting a Variation to §17,07.020 and §17.10.020 of the Lemont Unified Development Ordinance to Allow for a Detached Garage and Parking Pad at 16 E Custer Street in Lemont, IL DATE: April 28, 2025 SUMMARY/BACKGROUND The applicant and property owner, Mark Sredin, is requesting a variation to construct a new 600-square-foot detached garage to replace the existing one -stall garage. The proposal includes continued use of the existing driveway access from Custer Street instead of shifting access to the adjacent alley, as required by the Village's Unified Development Ordinance. A parking pad with alley access is also proposed, replacing the current pad with one of a smaller footprint. ANALYSIS Comprehensive Plan The future land use in the Comprehensive Plan is Infill Residential. Planning & Zoning Commission (PZC) A public hearing to discuss the variation was held on April 9, 2025. The PZC recommended (6-0) to approve the variations for 16 E Custer. Committee of the Whole (COW) The variations were discussed at the COW meeting held on April 21, 2025. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Approval of attached ordinance. BOARD ACTION REQUESTED Motion to approve attached ordinance. AN ORDINANCE GRANTING A VARIATION TO §17.07.020 AND §17.10.020 OF THE LEMONT UNIFIED DEVELOPMENT ORDINANCE TO ALLOW A DETACHED GARAGE IN R-4A WITHOUT ALLEY ACCESS AND PARKING PAD LOCATED AT 16 E CUSTER STREET IN LEMONT, IL (16 E Custer Variations) WHEREAS, Mark Sredin (hereinafter referred to as "the Petitioner") is the owner of the property at 16 E Custer Street in Lemont, IL (PIN# 22-29-105-005-0000) (hereinafter referred to as the "Subject Property"), legally described in Exhibit A; and WHEREAS, the Petitioner applied pursuant to the provisions of the Lemont, Illinois Municipal Code, Title 17 Unified Development Ordinance ("UDO") seeking a variation to § 17.07.020 and § 17.10.020 from the UDO to allow for a detached residential garage without access using the alley in the R-4A zoning district and a parking pad with alley access, as depicted in Exhibit B; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois conducted a public hearing on April 9, 2025 and voted 6-0 to recommend approval of the requested variations; and WHEREAS, a notice of the aforesaid public hearing was made in the manner provided by law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village have reviewed the matter herein and have determined that the requested variation is in the best interest of public health, safety, and welfare of the residents of the Village of Lemont, and hereby adopts the finding of facts as set forth in Exhibit C. NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois as follows: SECTION ONE: The foregoing findings and recitals are hereby adopted as Section 1 of this Ordinance and are incorporated by reference as if set forth verbatim herein. SECTION TWO: The following variations from the UDO are hereby granted: 1. A variation is granted from § 17.07.020 of the UDO allowing the detached garage to be accessed from Custer Street via the existing driveway. 2. A variation is granted from § 17.10.020 of the UDO to allow a parking pad adjacent to the new detached garage, accessed from the alley. SECTION THREE: Conditions. The following conditions apply: 1. Unless otherwise approved by the Village Board, the Subject Property shall be developed and maintained in accordance with the Lemont, Illinois Municipal Code and this Ordinance. 2. The parking pad shall remain open with no structures on it or in replace of it. SECTION FOUR: That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
