O-27-25 Granting a Special Use for a Final Planned Unit Development (PUD) for a Mixed Use Building at 801 State Street in Lemont, IL418 Main Street ( Lemont, IL 60439 FROM: Jason Berry, Community Development THROUGH: SUBJECT: An Ordinance Granting a Special Use for a Final Planned Unit Development (PUD) for a Mixed Use Building at 801 State Street in Lemont, IL DATE: April 28, 2025 SUMMARY/BACKGROUND The applicant and property owner, Airius Prialgauskis, is requesting approval of a Final Planned Unit Development (PUD) for 801 State Street to enable preservation and rehabilitation of the historic mixed -use structure. Zoned R-4A Single -Family Preservation and Infill District, which encourages detached single-family dwellings and prohibits commercial use, has prevented reuse of the building in a manner consistent with its historical function. The PUD process provides a mechanism to allow for adaptive reuse while ensuring redevelopment remains in character with the neighborhood. ANALYSIS Comprehensive Plan The proposed rehabilitation of 801 State Street aligns with the Lemont 2030 Comprehensive Plan's vision, supporting multiple Plan goals, including historic preservation, adaptive reuse, housing variety, and revitalization of underutilized properties. Planning & Zoning Commission (PZC). A public hearing was held at the PZC meeting on April 9, 2025 to discuss the proposed PUD for 801 State Street. The PZC voted (6-0) to recommend approval with conditions that have been remediated or incorporated into the ordinance. Committee of the Whole (COW) The proposed PUD was discussed at the COW meeting held on April 21, 2025. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Approval of attached ordinance. BOARD ACTION REQUESTED Motion to approve the attached ordinance. ORDINANCE NO. () _ 21 AN ORDINANCE GRANTING A SPECIAL USE FOR A FINAL PLANNED UNIT DEVELOPMENT (PUD) FOR 801 STATE STREET MIXED USE BUILDING IN LEMONT, ILLINOIS. (801 State Street Mixed Use PUD) WHEREAS, Airius Prialgauskis of Lemont Builders LLC, (hereinafter referred to as the "Petitioner"), is the owner of the subject property covering approximately 0.22-acres located at 801 State Street (PIN# 22-29-224-001), legally described in Exhibit A (hereinafter referred to as the "Subject Property"); and WHEREAS, the Petitioner submitted an application on March 7, 2025 pursuant to the provisions of the Lemont, Illinois Municipal Code, Title 17 Unified Development Ordinance ("UDO") seeking approval of a Final Planned Unit Development (PUD), (hereinafter referred to as "801 State Street PUD"); and WHEREAS, the subject property is zoned R-4A, Single -Family Preservation and Infill District, prohibiting multi -family and non-residential uses, therefore preventing the reuse of the historically mixed -use structure on the subject property; and WHEREAS, the 801 State Street PUD allows for the preservation and adaptive reuse of the historic building while ensuring neighborhood compatible uses tailored in this ordinance; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois conducted a public hearing on April 9, 2025 for 801 State Street PUD request and voted 6-0 to recommend approval of with conditions that have been incorporated into this Ordinance; and WHEREAS, said the 801 State Street PUD consists of the following: 1. Plat of Survey for 801 State Street by Kabal Surveying Company dated 10/10/2024, incorporated hereto and attached as Exhibit A; and 2. Interior Alterations with Site Plan depicting parking by n. Batistich, architects, dated 12/15/2024, incorporated hereto and attached as Exhibit B; and 3. Landscape Plan by n. Batistich, architects, dated 4/23/2025, incorporated hereto and attached as Exhibit C. NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois as follows: SECTION ONE: Incorporation of Recitals. The foregoing findings and recitals are hereby adopted as Section One of this Ordinance and are incorporated by reference as if set forth verbatim herein. SECTION TWO: Special Use. A special use for a planned unit development is granted as provided and conditioned in this Ordinance. SECTION THREE: Conditions. The approvals set forth in this Ordinance are contingent upon the following conditions: 1. General Conditions. Unless otherwise approved by the Village Board, the Subject Property shall be developed and maintained in accordance with the Village Code and the exhibits to this Ordinance. 2. If the subject property redevelopment intentions modify, all new development and new uses must adhere to the codes and standards of the Village. 3. One (1) of the following uses may occupy the 872 square -foot storefront space on the first floor, meeting off-street parking minimums, following all other permits and licenses are granted by the Village: a. One multi -family dwelling; or b. Cafe, coffee shop or soda fountain; or c. Florist; or d. Specialty food shop/carry-out; or e. Embroidery shop; or f. Hardware store; or g. Professional office; or h. Personal service; or i. Retail business. 4. The maximum number of residential units permitted within the existing building shall be limited to a maximum of two (2), one [possible] unit on the first floor and one unit on the second floor. 5. The maximum non-residential commercial uses permitted within the existing building shall be limited to one (1), on the first floor only in the front facade area, if a residential use does not occupy this space. 6. The 872 square -foot first floor unit shall be either one (1) residential unit or one (1) non-residential unit/tenant. 7. The first floor 1,255 building storage area, as indicated in Exhibit B, shall remain storage only and cannot be modified. 8. All uses and improvements outside the scope of this ordinance shall be regulated by the Village's UDO and codes, or obtain a major PUD amendment. SECTION FOUR: The Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication provided by law.
