SUMMARY/BACKGROUND
Lemont LLC, represented by attorney Alexander Domanskis, is requesting approval of an
ordinance granting Preliminary Planned Unit Development (PUD) approval for a 24-unit
townhome development at 14306 and 14322 McCarthy Road and 12514 Archer Avenue.
While the project —referred to as Seven Oaks II —completes the extension of Lacey Drive and
features architectural elements consistent with the original Seven Oaks subdivision, it is a
separate development with different ownership.The PUD includes stormwater detention, open
space amenities, required concrete driveways, and durable construction materials.
ANALYSIS
Comprehensive Plan
The Lemont 2030 Comprehensive Plan envisioned the future land use as Multi -Family Mid -
Rise, a residential land use designation.
Planning & Zoning Commission (PZC)
A public hearing was held on March 5, 2025 and the PZC voted (7-0) to approve the PUD with
conditions that have been incorporated into the ordinance.
Committee of the Whole (COW)
The PUD was discussed at the COW meeting held on March 24, 2025. Comments from this
meeting have been incorporated into the ordinance.

WHEREAS, Lemont LLC, represented by attorney Alexander Domanskis, (hereinafter referred
to as "the Petitioner") is the owner of the 4.39-acre property on three parcels located at 14306 and 14322
McCarthy Road, and 12514 S Archer Avenue (PINS# 22-27-300-029-0000, 22-27-300-027-0000, 22-
27-300-084-0000) (hereinafter referred to as the "Subject Property"), legally described and depicted in
Exhibit A; and
WHEREAS, the 0.4-acre parcel (PIN#) was annexed and zoned R-5 in 2015, included in the
Final Planned Unit Development (PUD) and Final Plat of Subdivision for Seven Oaks Townhomes,
approved as 0-20-15; and
WHEREAS, the 0.4-acre parcel is now incorporated into this PUD ordinance and Plat of
Subdivision, granting authority over its development and voiding its role in the Seven Oaks PUD (0-20-
15); and
WHEREAS, the Petitioner applied pursuant to the provisions of the Lemont, Illinois Municipal
Code, Title 17 Unified Development Ordinance ("UDO") seeking a preliminary plat of subdivision and a
special use for a preliminary planned unit development, consisting of the following (hereinafter referred
to as "Seven Oaks II Preliminary PUD");
1. Site Plan for Seven Oaks II Subdivision by Design Tek Engineering Inc., dated 2-05-2025 with
a final revision date of 3-27-2025, attached hereto and incorporated herein as Exhibit B; and
2. Preliminary Engineering Plan for Seven Oaks II prepared by DesignTek Engineering, Inc.
dated 2-05-2025 and a final revision date of 3-27-2025, attached hereto and incorporated
herein as Exhibit C; and
3. Preliminary Landscape Plan for Seven Oaks II Subdivision by Heritage Oak Studios, LLC
dated 2-07-2025 and revised 4-01-2025, attached hereto and incorporated herein as Exhibit
D; and
4. Tree Survey for Seven Oaks II by Design Tek Engineering Inc., dated 2/17/2025, attached
hereto and incorporated herein as Exhibit E; and
5. Seven Oaks Subdivision Phase I14-Unit Townhomes for Lemont, LLC by Ideal Designs
Architects dated 4-06-2021 and revised 5-10-21, attached hereto and incorporated herein as
Exhibit F.
6. Preliminary Plat for Seven Oaks II Subdivision by Design Tek Engineering Inc., dated
4/22/2025, attached hereto and incorporated herein as Exhibit G.
WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois conducted
a public hearing on March 7, 2025 for the annexation, rezoning, Preliminary Planned Unit Development
and Preliminary Plat Approval request for the Seven Oaks II Subdivision and voted 7-0 to recommend
approval of the requested rezoning to R-5 with associated Planned Unit Development (PUD) and
Preliminary Plat with conditions either remediated or incorporated into this ordinance; and
WHEREAS, a notice of the aforesaid public hearing was made in the manner provided by law
and was published in the Daily Southtown, a newspaper of general circulation within the Village; and
WHEREAS, the President and Board of Trustees of the Village have reviewed the matter herein
and have determined that the requested Preliminary PUD and Plat are in the best interest of public health,
safety, and welfare of the residents of the Village of Lemont, and hereby adopts the finding of facts as set
forth in Exhibit H.
NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the
Village of Lemont, Counties of Cook, DuPage, and Will, Illinois as follows:
SECTION ONE: Incorporation of Recitals. The foregoing findings and recitals are hereby
adopted as Section 1 of this Ordinance and are incorporated by reference as if set forth verbatim herein.
SECTION TWO: Special Use. A special use for a planned unit development is granted as
provided and conditioned in this Ordinance.
SECTION THREE: Conditions. The special use for a planned unit development shall have
the following conditions:
1. General Conditions. Unless otherwise approved by the Village Board the Subject Property
shall be developed and maintained in accordance with Village Code, the approved plans, the
Annexation Agreement and Amendment to Annexation Agreement, pertaining to the
Subject Property and the exhibits to this Ordinance.
2. Prior to final plat approval the following plans/permits shall be applied for and submitted for
approval to the Village:
a) final engineering plan,
b) tree protection and preservation plan,
c) final landscape plan, and
d) subdivision plat/plans.
3. Specific Conditions. The following specific conditions shall apply:
a) Submit Final PUD Plat/Plan; and
b) Departures from Zoning Standards. The following departures from the Unified
Development Ordinance are a part of this PUD:
i. § 17.07.010 and Table 17-07-0. The interior side yard setbacks are 10.25-feet
and 20.5-feet between buildings. The Lacey Drive corner side yard setback is
19.85-feet at the closest point, as depicted in Exhibit B.
ii. § 17.08.030 D. There is less than 10% open space as defined by the UDO. This
is supported by § 17.08.030 E. with the addition of a gazebo, benches and
increased landscaping on Outlot 2.
iii. § 17.26 The right-of-way width is 60-feet.
c) Homeowner's Association Establishment. The Petitioner shall establish a
Homeowner's Association (HOA) for the subdivision prior to the issuance of a site
development permit, which shall be binding upon the Subject Property, recorded against
the Subject Property, and in accord with the provisions of this ordinance. The HOA shall
have the obligation and responsibility at its own sole cost and expense to ensure the
upkeep, landscaping and maintenance of the common areas that are not dedicated and
accepted by the Village in a first-rate condition at all times. The common areas, include
but are not limited to Outlot 1 and Outlot 2. The HOA declarations shall include the
following statements:
i. All driveways shall be constructed of concrete and replaced with only
concrete in the future.
ii. Vinyl siding is prohibited at the time of construction and for future
replacement.
iii. Patios or decks cannot be enlarged beyond the size at time of initial
construction.
d) Open Space Amenities. The Petitioner is hereby required to install benches with gazebo
on Outlot 2 as indicated in the Preliminary Landscape Plans shown in Exhibit D; and
e) Outstanding Comments. The Petitioner must address and remediate all comments and
issues as noted by the Consulting Planner, Village Engineer, Village Arborist, Village
Ecologist, Village Plumber, Village Traffic Consultant and Fire Marshal prior to final
PUD approval; and
f) Townhome Design. Vinyl siding is prohibited. Driveways shall be constructed of
concrete. Final architectural plans shall be provided with the Final PUD.
SECTION FOUR: The planned unit development (PUD) approval shall lapse in the event the
Petitioner does not file a complete application for Final PUD approval within two (2) years of the effective
date of this ordinance, unless otherwise extended by the President and Board of Trustees of the Village.
SECTION FIVE: That the Village Clerk of the Village of Lemont be and is directed hereby to
publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and
provided.
SECTION SIX: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication as provided by law.
ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
LEMONT, COUNTIES OF COOK, WILL, AND DuPAGE, ILLINOIS, on this 28th day of April,
