O- -25 AN ORDINANCE AMENDING SECTION 5.04.060 (CLASSES OF LICENSES, NUMBER OF LICENSES AND LICENSE FEES) OF CHAPTER 5.04 (LIQUOR LICENSES) OF TITLE 5 (BUSINESS LICENSES AND REGULATIONS) OF THE VILLAGE CODE OF THE VILLAGE OF LEMONT (Adding Class G Caterers retail liquor license) WHEREAS, the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, ("the Village") is a municipality in the state of Illinois with full powers to enact ordinances and adopt resolutions for the benefit of the residents of the Village; and WHEREAS, the President and Board of Trustees of the Village of Lemont (the "Corporate Authorities") may from time to time amend the text of the Village Code when it is determined to be in the best interests of the residents of the Village; and WHEREAS, the Corporate Authorities find that it is in the best interest of the Village to amend the Village Code provisions regarding liquor licenses; and WHEREAS, the Corporate Authorities find it in the best interest of the Village and its residents that Section 5.04.060 ("Classes of licenses, number of licenses, and license fees") of the Village Code provisions be amended as set forth herein. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Tnistees of the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows: SECTION 1: That the above recital is found to be true and correct and is hereby incorporated herein and made a part hereof, as if fully set forth in its entirety. SECTION 2: Section 5.04.060 ("Classes of licenses, number of licenses, and license fees") of Chapter 5.04 ("Liquor Licenses") of Title 5 ("Business Licenses and Regulations") of the Village Code is hereby amended by adding a Class G caterer's retail liquor license. A Class G caterer's retail liquor license shall authorize the sale of alcoholic liquor by a caterer or a current holder of another type of liquor license provided for in this chapter, in connection with the sale of prepared food for service at private parties, weddings, or similar private events that are not open to the general public. These events must take place at a location other than the premises leased, owned, or otherwise operated by the licensee. For the purpose of enforcement under this chapter, the location of the catered event shall be deemed the licensed premises. In addition to complying with all other requirements for licensed premises set forth in this chapter, a Class G licensee shall adhere to the following conditions: Eligibility: The Class G licensee must be a bona fide caterer or a current holder of a retail liquor license issued under this chapter. 2. Food Service Requirement: The sale and consumption of alcoholic liquor shall only be permitted at events where food is actively catered and served. 3. Revenue Requirement: Gross revenue from the sale of alcoholic liquor at any catered event shall not exceed fifty (50) percent of the total gross revenue generated from the sale of both alcohol and food at that event. If requested by the Liquor Commissioner, the Class G licensee shall submit a quarterly affidavit certifying compliance with this requirement, using a form provided by the Liquor Commissioner. 4. Contracted Food Service: If a Class G licensee contracts with another individual or entity for food service at a catered event, a copy of the contract must be available for inspection on -site during the event.
