R-06-25 Approving Professional Services Agreement Between HR418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Ted Friedley, Public Works THROUGH: SUBJECT: A Resolution Approving Professional Services Agreement Between HR Green, Inc. and the Village of Lemont, Illinois for FY26 Water Main Improvements Design Engineering DATE: January 27, 2025 SUMMARY/BACKGROUND HR Green is assisting the Village with design engineering services for the yearly water main improvements project. Funding will come from the Water/Sewer Fund. The total lump sum, not to exceed, fees for the project is $60,000.00. As outlined in the Agreement, the streets included in this year's water main improvements project will be: • Forest Lane from Keepataw Drive (S) to Keepataw Drive (E) - Replacement • Illinois Street from Grant Street to Julia Street - Replacement • Custer Street from State Street to Walnut Street - Replacement • Young Street from Country Lane to Janas Lane - Lining ANALYSIS The FY26 Water Main Improvements project is consistent with the Village's 5-Year Capital Plan. $60,000.00 has been budgeted in FY25 for design engineering for this project. AND THE VILLAGE OF LEMONT, ILLINOIS FOR FY26 WATER MAIN IMPROVEMENTS DESIGN ENGINEERING WHEREAS the Village of Lemont, Counties of Cook, Will, and DuPage, Illinois, ("the Village") is a municipality in the State of Illinois with full powers to enact Ordinances and adopt Resolutions for the benefits of the residents of the Village; and WHEREAS, the Village and HR Green, Inc. wish to enter a professional services agreement for FY26 Water Main Improvements Design Engineering as further outlined in the professional services agreement attached hereto as Exhibit A ("Agreement"); and WHEREAS, the Mayor and Board of Trustees find that it is in the best interests of the Village to authorize the Agreement attached hereto as Exhibit A. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows: SECTION 1: That the above recitals and legislative findings are found to be true and correct and are hereby incorporated herein and made a part hereof as if fully set forth in their entirety. SECTION 2: The Mayor and Board of Trustees of the Village of Lemont hereby approve the Agreement with HR Green, Inc. in substantially the same form as attached hereto as Exhibit A, subject to attorney review. SECTION 3: The Mayor and Cleric are hereby authorized, respectively, to execute the Agreement with HR Green, Inc. SECTION 4: This Resolution, and its parts, are declared to be severable and any section, subsection, sentence, clause, provision, or portion of this Resolution that is declared invalid such decision shall not affect the validity of any other portion of this Resolution, which shall remain in full force and effect. SECTION 5: All Resolutions and Ordinances in conflict herewith are hereby repealed to the extent of such conflict. (hereafter "COMPANY"). 1.0 Project Understanding 1.1 General Understanding The CLIENT has identified a need for water main improvements on the following streets: • Forest Lane from Keepataw Drive (S) to Keepataw Drive (E) - replacement • Illinois Street from Grant Street to Julia Street - replacement • Custer Street from State Street to Walnut Street - replacement • Young Street from Country Lane to Janas Lane - lining The project is anticipated to consist of installing approximately 350 Lin Ft. of a new 8-inch, ductile iron main, 1,615 Lin Ft. of a new 10-inch ductile iron main, and 1,040 Lin Ft. of lining an existing 6" cast iron main. The project will also include full water service line installation, driveway replacement, and patching associated with the water main work under existing pavement. 1.2 Design Criteria/Assumptions • CLIENT specifications and Illinois Environmental Protection Agency (IEPA) regulations will define the Standards to be used in the design of the water main and appurtenances. • All water main replacement will be completed within CLIENT's owned right-of-way. No easements are anticipated for the project. • Service line replacement will be from the water main to a new curb stop box located at the right-of-way line unless the service line is found to be lead, then it will be replaced to the water meter as mandated by the IEPA. • Replacement of other utilities not identified above, or the entire roadway, is not anticipated. • Topographic survey and subsurface geotechnical investigation were provided by the CLIENT. 2.0 Scope of Services The CLIENT agrees to employ COMPANY to perform the following services: Preliminary and General Work 2.1 Survey - COMPANY will provide topographic survey services that will include the following: a. Right of Way Survey - COMPANY will recover existing right of way (ROW) evidence for approximately 1,300 feet along Forest Lane, Illinois Street, and Custer Street as outlined above. Topographic Survey - Topographic Survey will include that part of Forest Lane, Illinois Street, and Custer Street within the limits specified above and extend 5 feet beyond the existing ROW lines. The topographic survey will include cross - sections at 50-foot intervals. The survey will include visible existing features and improvements. Existing utilities will be surveyed from visible flags or markings. Storm sewer, sanitary sewer and water main structures will be surveyed, including rim elevation, invert pipe size, direction and elevation as observed at unlocked manholes. Trees lying within the limits described above and having a diameter of four (4) inches or greater will be located, but the species not identified. c. Planimetric Survey - Planimetric Survey will include existing visible features and improvements for approximately 1,040 feet located within the ROW within the limits specified above. Survey Base Map - COMPANY will generate a base map including one -foot contours in AutoCAD Civil 3D release 2023 for use by COMPANY for internal design. The survey will reference existing NGS control stations, Illinois State Plane Coordinate System East Zone NAD83 (2011) and NAVD88 (US Survey Feet). 2.2 Subsurface geotechnical investigation Design Phase Services 2.3 Coordinate with utility companies to resolve possible conflicts with their existing facilities within the project limits and any specific construction requirements (e.g., crossing, separation, etc.). 2.4 Prepare construction drawings anticipated as the following 22 Sheets (for 50% and 100% design stages): General 1. Provide a final Opinion of Probable Cost for the project to file with the completed documents. 2.7 Submit three (3) copies of the drawings, specifications, contract documents, and Opinion of Probable Cost at the 50% complete milestone to CLIENT for review. 2.8 Provide an internal quality assurance and quality control review of final documents. 2.9 Develop a final project schedule for advertisement, bidding, and construction completion. 2.10 Submit three (3) copies of final drawings, specifications, contract documents, and Opinion of Probable Cost for permitting by the CLIENT (please note, while this can be considered the 90% design stage, the plans will be closer to 100% complete.): a. A Construction Engineering services agreement will be assembled when the Contractor provides a schedule for construction. 2. Property boundary research, including subdivision maps, right-of-way widths, property lines, and property ownership information other than readily available property line information from the County. 4. Plat of Survey/Topography. 5. Plat of Dedication/Easement. 6. Hydraulic water modeling. 7. Storm sewer modeling. 8. Any evaluation or modification to the CLIENT's sanitary or storm sewer systems. 9. Any significant roadway replacement and/or modifications other than patching associated with the installation of the water main and curb/gutter, driveway approach, and sidewalk replacement as required. 10. These standard hourly rates are subject to change upon 30 days' written notice. Non -salary expenses directly attributable to the project such as: (1) living and traveling expenses of employees when away from the home office on business connected with the project; (2) identifiable communication expenses; (3) identifiable reproduction costs applicable to the work; and (4) outside services will be charged in accordance with the rates current at the time the service is done. 7.2 Invoices Invoices for COMPANY's services will be submitted, on a monthly basis. Invoices will be due and payable upon receipt in accordance with the Illinois Prompt Payment Act 50ILCS 505. If any invoice is not paid within these timelines, COMPANY may, without waiving any claim or right against the CLIENT, and without liability whatsoever to the CLIENT, suspend or terminate the performance of services. 7.3 Extra Services Any service required but not included as part of this AGREEMENT shall be considered extra services. Extra services will be billed on a Time and Material basis with prior approval of the CLIENT. 7.4 Exclusion This fee does not include attendance at any meetings or public hearings other than those specifically listed in the Scope of Services. These service items are considered extra and are billed separately on an hourly basis. 7.5 Payment The CLIENT AGREES to pay COMPANY on the following basis: Lump Sum fee of $60,000.00. 8.0 Terms and Conditions This Agreement is an addendum to and is considered part of the Master Agreement between CLIENT and COMPANY. All terms and conditions contained in that agreement apply to this Agreement. COMPANY's services shall be limited to those expressly set forth in this AGREEMENT and COMPANY shall have no other obligations or responsibilities for the Project except as agreed to in writing.
