SUMMARY/BACKGROUND
Jerry Kulhanek is requesting approval of a Final Planned Unit Development for Phase I to
redevelop the building and property at 46 Ed Bossert Drive into an indoor golf destination.
Included in the attached Final PUD ordinance are plans for:
• Installation of water main and sprinklers; and
• Build out interior with five golf simulator bays, a kitchen and bar; and
• Enhanced front elevation with new entry, windows, balconies and canopies; and
• Upgraded parking at the north end of Ed Bossert Drive.
ANALYSIS
Comprehensive Plan
The Lemont 2030 Comprehensive Plan's future land use map designates the subject property
as Mixed Use (MU). The proposal is generally in line with the goals and objectives of the
Comprehensive Plan.
Planning & Zoning Commission (PZC)
A public hearing was held at the October 2, 2024 regular meeting of the PZC. The PZC
recommended approval of the Final PUD for Phase I with conditions remediated or
incorporated into the attached ordinance.
Committee of the Whole (COW)
The COW reviewed the proposal on October 21, 2024. Comments and feedback from this
meeting have been remediated or incorporated into this ordinance.
Consistency with Village Policy
Lemont 2030 Comprehensive Plan

AN ORDINANCE GRANTING A FINAL PLANNED UNIT DEVELOPMENT (PUD)
FOR THE CLUB PHASE I AT 46 ED BOSSERT DRIVE IN LEMONT, ILLINOIS.
(The Club Phase I)
WHEREAS, Jerry Kulhanek of 308 Canal LLC, (hereinafter referred to as the
"Petitioner"), is the owner of the subject property comprised of three parcels covering
approximately 1.7-acres located at 46 Ed Bossert Drive (PINS# 22-20-300-006, 22-20-300-
005 and 22-20-300-027), legally described in Exhibit A (hereinafter referred to as the
"Subject Property"); and
WHEREAS, the Petitioner submitted an application signed on July 24, 2024 pursuant
to the provisions of the Lemont, Illinois Municipal Code, Title 17 Unified Development
Ordinance ("UDO") seeking approval of a Final Planned Unit Development (PUD),
(hereinafter referred to as "The Club PUD Phase I"); and
WHEREAS, the indoor recreation, restaurant, and tavern uses associated with The
Club PUD Phase I are permitted in the D-D, Downtown District, the UDO directs any the
remodeling of an existing building on a lot of 10,000 square feet or more within the D-D
meets the mandatory threshold for review and approval as a Planned Unit Development; and
WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois
conducted a public hearing on October 2, 2024 for The Club PUD request and voted 6-0 to
recommend approval of the Phase I Final Planned Unit Development (PUD) with conditions
that have been incorporated into this Ordinance; and
WHEREAS, said The Club PUD Phase I consists of the following:
1. ALTA Survey by Ruettiger, Tonelli & Associates dated September 3, 2021,
attached as Exhibit A; and
2. Phase I Elevations dated11/8/2024, attached as Exhibit B; and
3. Site Plan depicting Phase I area dated 11/8/2024, attached as Exhibit C.
WHEREAS, The Club PUD Phase I includes improvements occurring exclusively
on Parcel 2 and Parcel 3, as depicted in the ALTA survey in Exhibit A, including:
• Creation of five indoor golf simulator bays, a kitchen, bathrooms and bar; and
• Installation of a watermain and sprinkler system; and
• Enhanced new entry with windows; and
• Addition of balconies, doors, and canopies to the front elevation; and
• Upgrades to parking at the north end of Ed Bossert Drive; and
WHEREAS, the Petitioner anticipates Phase II and Phase III that will encompass
the redevelopment of the entire property (Parcel IA, Parcel 1B, Parcel 2, and Parcel 3), as
depicted on the ALTA survey; however, future phases and any associated plans are not
included in this ordinance. Future phases shall follow all Village procedures and processes
for approval. Anticipated future phased improvements may include:
• A three-story restaurant, bar, and third -floor rooftop addition; and
• A rear outdoor seating, dining, and entertainment area; and
• A paved rear parking area; and
• An interior elevator.
NOW, THEREFORE BE IT ORDAINED by the Village President and Board of
Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois as follows:
SECTION ONE: Incorporation of Recitals. The foregoing findings and recitals are
hereby adopted as Section One of this Ordinance and are incorporated by reference as if set
forth verbatim herein.
SECTION TWO: Subject to the conditions below, the following documents are
hereby approved in substantially the form attached hereto:
1. ALTA Survey by Ruettiger, Tonelli & Associates dated September 3, 2021,
attached as Exhibit A; and
2. Phase I Elevations dated11/8/2024, attached as Exhibit B; and
3. Site Plan depicting Phase I area dated 11/8/2024, attached as Exhibit C.
SECTION THREE: Conditions. The approvals set forth in this Ordinance are
contingent upon the following conditions:
1. General Conditions. Unless otherwise approved by the Village Board, the
Subject Property shall be developed and maintained in accordance with the
Village Code, the approved plans, and the exhibits to this Ordinance.
2. If the subject property redevelopment intentions modify, all new development
and new uses must adhere to the codes and standards of the Village.
3. The outdoor storage located on the subject property is subject to the following:
a. The outdoor storage and cargo storage containers related to the
landscaping business shall be removed within three (3) months of the
adoption of this ordinance.
b. The outdoor storage and cargo containers unrelated to the Subject
Property's interior tenant (Carl's Septic) or property owner, must be
entirely removed prior to occupancy of Phase I of the Club (ACOM-24-
24) or December 31, 2025, whichever occurs first.
c. Trucks, storage containers, equipment, and materials associated with the
existing interior tenant (Carl's Septic) may remain on the property until
the completion of Phase II but must be removed before Phase II
occupancy.
d. Any new business or tenant of the Subject Property, with exception to the
Club and Carl's Septic, must obtain all required Village approvals and
comply with the Unified Development Ordinance.
e. Outdoor storage of any kind must cease prior to Phase II occupancy.
SECTION FOUR: The Village Clerk of the Village of Lemont be and is directed
hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of
Illinois, made and provided.
SECTION FIVE: This Ordinance shall be in full force and effect from and after its
passage, approval and publication provided by law.
