The A-4 license classification will be amended by adding the underlined language as follows: (21) Class A-4-G Class A-4-G licenses shall authorize the retail sale of beer and wine only, for consumption on the premises if the premises are establishments commonly known as gaming cafes and which primarily serve meals or food prepared in the establishment. Video gaming as defined under the Illinois Video Gaming Act ILCS Ch. 230, Act 40 § 1 et seq.. shall be allowed in a class A-4-G licensed premises. (22) Class A-4-G+ A Class A-4-G+ license shall authorize the retail sale of alcoholic liquor for consumption on the premises if the premises is an establishment commonly known as a gaming cafe and which primarily serves meals or food prepared in the establishment. O= -24 AN ORDINANCE AMENDING SECTION 5.04.060 (CLASSES OF LICENSES, NUMBER OF LICENSES AND LICENSE FEES) OF CHAPTER 5.04 (LIQUOR LICENSES) OF TITLE 5 (BUSINESS LICENSES AND REGULATIONS) OF THE VILLAGE CODE OF THE VILLAGE OF LEMONT WHEREAS, the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, ("the Village") is a municipality in the state of Illinois with full powers to enact ordinances and adopt resolutions for the benefit of the residents of the Village; and WHEREAS, the President and Board of Trustees of the Village of Lemont (the "Corporate Authorities") may from time to time amend the text of the Village Code when it is determined to be in the best interests of the residents of the Village; and WHEREAS, the Corporate Authorities find that it is in the best interest of the Village to amend the Village Code provisions regarding liquor licenses; and WHEREAS, the Corporate Authorities find it in the best interests of the Village and it's residents that Section 5.04.060 ("Classes of licenses, number of licenses, and license fees") of the Village Code provisions be amended as set forth herein. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows: SECTION l: That the above recital is found to be true and correct and is hereby incorporated herein and made a part hereof, as if fully set forth in its entirety. SECTION 2: Section 5.04.060 ("Classes of licenses, number of licenses, and license fees") of Chapter 5.04 ("Liquor Licenses") of Title 5 ("Business Licenses and Regulations") of the Village Code is hereby amended by adding the underlined language to provide as follows: (21) Class A-4-G Class A-4-G licenses shall authorize the retail sale of beer and wine only, for consumption on the premises if the premises are establishments commonly known as gaming cafes and which 2 primarily serve meals or food prepared in the establishment. Video gaming as defined under the Illinois Video Gaming Act ILCS Ch. 230 Act 40 § 1 et seq. shall be allowed in a class A-4-G licensed premises. (22) Class A-4-G+ A Class A-4-G+ license shall authorize the retail sale of alcoholic liquor for consumption on the premises if the premises is an establishment commonly known as a gaming cafe and which primarily serves meals or food prepared in the establishment. Video gaming as defined under the Illinois Video Gaming Act ILCS Ch. 230 Act 40 § 1 et seq. shall be allowed in a class A-4-G+ licensed premises. 23. Class E-1-x, retirement facility. Retirement facility licenses shall authorize the sale of alcoholic liquor for consumption on the premises to temporary or permanent residents of a retirement facility and their bona fide guests age 21 and over. 1. On -site consumption shall be allowed within the confines of dining rooms and permitted outdoor patio areas where meals are regularly served. 2. No packaged sales of alcoholic liquor shall be allowed. 3. The facility shall not be permitted to advertise or promote the sale of alcoholic liquor nor offer alcoholic liquor for sale to the public. 4. Private functions shall be allowed in common areas as part of regular activities integral to the facility. 5. Marketing programs conducted by the facility shall be allowed provided they are private, by invitation only, and are limited to age -appropriate prospective clientele. b. Video gaming as defined under the Illinois Video Gaming Act, 230 ILCS 40/1 et seq., shall not be allowed in a class E-1-x licenses premises. 24. Class F, personal services. A Class F liquor license shall authorize the complimentary distribution by the glass of wine and beer only at any licensed business not otherwise eligible for a liquor license in the Village of Lemont. Such license shall be subject to all of the following conditions: 1. Complimentary Glass: Such license shall authorize complimentary dispensing by the glass of wine and beer only. 2. Consumption On Premises Only: The dispensing by the glass of wine and beer shall be for consumption on the premises only and shall permit live entertainment on the premises. 3. Seating: Seating for customers within the premises shall not exceed 30 seats. 4. Use Limited: Such license shall be issued only to an establishment whose principal business is not a restaurant or the retail sale of alcoholic liquors. Complimentary serving by the glass of wine and beer shall be permitted only incidental to the business of the establishment. Only a single six ounce serving of wine or a single 12 ounce serving of beer is permitted per customer per visit to the premises. 5. Establishment Size: Such license may be issued only to an establishment that does not exceed 2,500 square feet in gross customer service area. 6. Hours: Unless otherwise indicated on the liquor license, the complimentary serving of alcoholic liquor for consumption is permitted only between the hours of 11:00 a.m. and 12:00 midnight Friday and Saturday and 11:00 a.m. and 10:30 p.m. Sunday through Thursday. 7. Consumption Limited: All patrons and customers of a licensed business that is licensed for on premises consumption shall leave the premises not later than 30 minutes following the closing hours recited herein. 8. Video Gaming Prohibited: Class F liquor license holders shall not be permitted to have video gaming machines and are not entitled to apply for video gaming licenses with the State of Illinois. SECTION 5: All Ordinances, resolutions, motions or orders in conflict with this Ordinance are hereby repealed to the extent of such conflict. SECTION 6: This Ordinance shall be in frill force and effect upon its passage, approval and publications as provided by law.
