O-42-24 Amending Title 17 of the Lemont Municipal Code, The�E1VIOIVT 0-q2­2-'f 418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jamie Tate, Community Development THROUGH: Jason Berry, CEcD, AICP, Economic & Community Development Director SUBJECT: An Ordinance Amending Title 17 of the Lemont Municipal Code, The Lemont Unified Development Ordinance of 2008 (Definitions, Uses & Awning Signs) DATE: November 25, 2024 SUMMARY/BACKGROUND Staff, the Planning & Zoning Commission (PZC), and Elected Officials regularly review the Unified Development Ordinance (UDO) to address modernization, clarify language, and align with policy goals. In summary, the following updates to the UDO are proposed in this update: • Definitions (17.02): Add definitions for Warehouse and Mixed -Use to clarify usage throughout the UDO and modify the definition for Awning Signs • Use Regulations (17.06) in Table 17-06-01: Adjustments in the Downtown District (D-D) • Signs (17.11): Limiting text for awnings to the valance. ANALYSIS Comprehensive Plan The proposed amendments align with the Lemont 2030 Comprehensive Plan, supporting balanced land use and maintaining the character of the D-D. Planning & Zoning Commission (PZC� A public hearing was held on October 2, 2024, the changes. where the PZC recommended approval (6-0) of Committee of the Whole (COW) The proposed amendments to the LIDO were discussed at the COW meeting held on November 18, 2024. Modifications based on that discussion have been incorporated. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Staff recommends approval of the attached ordinance. BOARD ACTION REQUESTED A motion to approve the attached ordinance. ORDINANCE NO. - )-2- i AN ORDINANCE AMENDING TITLE 17 OF THE LEMONT MUNICIPAL CODE, THE LEMONT UNIFIED DEVELOPMENT ORDINANCE OF 2008 (Definitions, Uses & Awning Signs) WHEREAS, the Village of Lemont approved Ordinance 0-07-08 adopting the Lemont Unified Development Ordinance of 2008 (hereinafter "the Unified Development Ordinance") with an effective date of March 15, 2008; and WHEREAS, on October 2, 2024, the Lemont Planning & Zoning Commission, in accordance with the requirements of the Illinois Combined Statutes and the Unified Development Ordinance, conducted a public hearing for the proposed amendments to the zoning and land use regulations of the Unified Development Ordinance; and WHEREAS, notice of the aforesaid public hearing was made in the manner provided by law; and WHEREAS, the Lemont Planning & Zoning Commission found that the proposed amendments are consistent with the purposes of the Unified Development Ordinance and voted (6-0) to recommend their approval with modifications incorporated into the language. NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Cook, DuPage and Will Counties, Illinois, as follows: SECTION ONE: The foregoing findings and recitals are hereby adopted as Section 1 of this Ordinance and are incorporated by reference as if set forth verbatim herein. SECTION TWO: Section 17.02 ("Definitions") of Article II ("Zoning") of Title 17 ("Unified Development Ordinance") of the Village Zoning Code is hereby amended with additions shown in underlined text, to be placed in alphabetical order, and deletions shown in stfikethfough in alphabetical order to provide as follows: WAREHOUSE. "Warehouse" means a buildingused ised primarily for the storage of goods and materials. MIXED USE. "Mixed Use" means a combination of compatible residential, commercial and/or institutional uses within a single development area, building; or district. SIGN, AWIVING. ^ * d into attaehed to an . SECTION THREE: The Lemont, Illinois Municipal Code ("Village Code"), as amended, is further amended in Title 17, Unified Development Ordinance Chapter, Table 17-06- 01 Permitted and Special Uses in the Zoning Districts, updated and replaced in its entirety, provided in Exhibit A. SECTION FOUR: The Lemont, Illinois Municipal Code ("Village Code"), as amended, is further amended in Title 17, Unified Development Ordinance Chapter, with additions shown in underlined text, to be placed in alphabetical order, and deletions shown in s-tr-ikethroug to Chapter 17.11 Signs, of the Village Code as follows: 17.11.060. — REMOVAL OF SIGNS. All illegal signs, signs that compromise health, safety or general welfare, or are otherwise in violation are subject to removal by the Village's Public Works Department or code enforcement officials. Additionally, all signage associated with a tenant, business, or occupant of a leased or owned space must be completely removed upon vacancy of the premises. Signs placed in the public right-of-way shall be subject to immediate removal without prior notice to the sign owner. 17.1 1.090. — STANDARDS FOR SPECIFIC TYPES OF SIGNS C. Awning Signs. Unless otherwise specified under the provisions of this chapter, the following shall apply: 1. Awning signs shall be allowed only directly above ground floor windows and entrances that face a public right of way,and 2. Awning signs shall be a minimum of eight feet above the sidewalk_.d 3. Awning signs shall be located below the lowest sill of the second floor or below the cornice or eave of a one-story building, 4. Awning signs shall not be internally illuminated_; —arid 5. Awning signs shall be constructed of canvas or cloth with metal or wood supports. 6. Text within an awning sign is limited to the valance, and the maximum text area shall not exceed 40% of the total linear length of the awning_ SECTION FIVE: That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION SIX: Should any Section or provision of this Ordinance be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the Ordinance as a whole or any part thereof other than the part declared to be invalid. SECTION SEVEN: This Ordinance shall be in frill force and effect from and after its passage, approval and publication as provided by law.
