O-37-24 Granting a Variation to 17.06.030, 17.07.020 and Engineering Detail LS-6 of the Lemont Unified Development Ordinance to Allow an Addition with an Attached Garage Located at 410 Singer in Lemont, IL0-3'7-,7 q 418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jamie Tate, Community Development THROUGH: Jason Berry, CEcD, AICP, Economic & Community Development Director SUBJECT: An Ordinance Granting a Variation to 17.06.030, 17.07.020 and Engineering Detail LS-6 of the Lemont Unified Development Ordinance to Allow an Addition with an Attached Garage Located at 410 Singer in Lemont, IL DATE: October 28, 2024 SUMMARY/BACKGROUND Laura Whittingham, both the applicant and property owner of 410 Singer Avenue, has applied for variance to the Unified Development Ordinance (UDO) to construct a residential home addition with an attached garage with an existing detached one -stall garage to remain. The driveway apron along Division Street to access both garages is wider than the UDO details. Public Works did not have any concerns with the driveway apron as proposed. ANALYSIS Comprehensive Plan The subject property is within the Infill Residential (INF) future land use district. Historic Preservation Commission (HPC) The HPC reviewed the proposed addition and home improvements at the HPC meeting on September 12, 2024 and unanimously granted a Certificate of Appropriateness for the project. Planning & Zoning Commission (PZC) A public hearing for the variations was held at the PZC meeting on October 2, 2024. The PZC voted (6-0) to recommend approval. Commitee of the Whole (COW) The variations for the proposed home addition at 410 Singer Avenue were discussed at the COW meeting held on October 21, 2024. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Staff is recommending approval of the attached ordinance. BOARD ACTION REQUESTED A motion to approve the attached ordinance. ORDINANCE NO. 19 -. 1 AN ORDINANCE GRANTING A VARIATION TO §17.06.030, §17.07.020 AND ENGINEERING DETAIL LS-6 OF THE LEMONT UNIFIED DEVELOPMENT ORDINANCE TO ALLOW AN ADDITION WITH AN ATTACHED GARAGE LOCATED AT 410 SINGER IN LEMONT, IL (410 Singer Avenue Addition) WHEREAS, Laura Whittingham (hereinafter referred to as "the Petitioner") is the owner of the property at 410 Singer Avenue in Lemont, IL (PIN# 22-20-317-005-0000) (hereinafter referred to as the "Subject Property"), legally described and depicted in Exhibit A; and WHEREAS, the Petitioner applied pursuant to the provisions of the Lemont, Illinois Municipal Code, Title 17 Unified Development Ordinance ("UDO") seeking a variation to § 17.06.030, § 17.07.020 and Engineering Detail LS-6 for Residential Driveways from the UDO to allow for a residential home addition with an attached garage and driveway when an detached garage is to remain in the R-4A zoning district as depicted in Exhibit B; and WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois conducted a public hearing on October 2, 2024 and voted 6-0 to recommend approval of the requested variations; and WHEREAS, a notice of the aforesaid public hearing was made in the manner provided by law and was published in the Daily Southtown, a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village have reviewed the matter herein and have determined that the requested variation is in the best interest of public health, safety, and welfare of the residents of the Village of Lemont, and hereby adopts the finding of facts as set forth in Exhibit C. NOW, THEREFORE BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois as follows: SECTION ONE: The foregoing findings and recitals are hereby adopted as Section 1 of this Ordinance and are incorporated by reference as if set forth verbatim herein. SECTION TWO: The following variations from the UDO are hereby granted: 1. A variation is granted from § 17.06.030 of the UDO to allow an attached garage with a detached garage in the R-4A district as depicted in Exhibit B. 2. A variation is granted from § 17.07.020 of the UDO allowing the attached and detached garage to be accessed from both the alley and Division Street. 3. A variation is granted from Engineering Detail LS-6 of the UDO allowing the driveway apron along Division Street to be larger than allowed by UDO as depicted in Exhibit B. SECTION THREE: The variation shall have the following condition: 1. General Conditions. Unless otherwise approved by the Village Board, the Subject Property shall be developed and maintained in accordance with the Lemont, Illinois Municipal Code and this Ordinance. SECTION FOUR: That the Village Clerk of the Village of Lemont be and is directed hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois, made and provided. SECTION FIVE: That this Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. The Lemont 2030 Comprehensive Plan's future land use map designates the subject site as Infill Residential (INF). 2. The subject property is within the R-4A zoning district and Historic Preservation District. 3. The requested variation meets the standards for granting variations within the Unified Development Ordinance.
