SUMMARY/BACKGROUND
Public Works staff obtained three (3) quotes for the demolition of the home located on the new
water tower property at 12421 Archer Avenue (Archer & Derby). One quote did not contain
necessary pricing of all items. Hoppy's Landscaping provided the quote of $26,000 not
including permit fees. The building needs to be removed to proceed with the rest of the plans
on the tower site, including a salt storage dome and storage barn. Staff are requesting
approval of Hoppy's Landscaping, Inc. proposal to proceed with the demolition.

A RESOLUTION AUTHORIZING 12421 ARCHER AVENUE BUILDING
DEMOLITION AGREEMENT WITH HOPPY'S LANDSCAPING, INC.
WHEREAS it has become necessary for the building located at 12421 Archer Avenue to
be demolished; and
WHEREAS, in connection with the work to be conducted on the building demolition at
12421 Archer Avenue, the Village has researched and evaluated available options and
contractors; and
WHEREAS, upon review by Village staff, it was concluded that the greatest benefit to
the Village will be realized by waiving the bidding process and accepting the proposal for
building demolition at 12421 Archer Avenue with Hoppy's Landscaping, Inc., 15041 New
Avenue, Lockport, IL 60441, in an amount not to exceed $26,000.00; and
WHEREAS, Section 5/8-9-1 of the Illinois Municipal Code (65 ILCS 5/8-9-1) allows the
Board of Trustees of the Village ("Village Board"), upon a vote of two-thirds of the trustees then
holding office, to waive the requirements for competitive bidding; and
WHEREAS, The Village Board has determined that it is advisable, necessary, and in the
best interest of the Village to waive competitive bidding and authorize the building demolition at
12421 Archer Avenue for $26,000.00.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows:
SECTION 1:
Incorporation Recitals. The foregoing findings and recitals are hereby adopted as Section
One of this Resolution and are incorporated by reference as if set forth verbatim herein.
SECTION 2:
Waiver of Public Bid Requirements and Authority to Purchase. The Village Board hereby
waives the competitive bidding requirements otherwise applicable to the building demolition at
12421 Archer Avenue by Hoppy's Landscaping, Inc. at a price not to exceed $26,000.00 as
Exhibit A.
SECTION 3:
The Village Administrator or his designee is hereby authorized to execute any documents
and take any other steps necessary to complete the building demolition at 12421 Archer Avenue
by Hoppy's Landscaping, Inc. at a price not to exceed $26,000.00 and to otherwise carry out this
Resolution.
SECTION 4:
This Resolution shall be in full force and effect from and after its passage and approval as
provided by law.

By signing this document, the customer agrees to the services and conditions outlined in this
document.
General Conditions:
I. The Demolition Contractor agrees to hold harmless the Owner, General Contractor, or their
Agents, against damage to life or limb and property by reason of the negligence of the
Demolition Contractor, in connection with this contract, and further agrees to carry Worker's
Compensation, Employers' Liability Insurance, General Liability Insurance, within the limits of
$2,000,000.00, and excess liability umbrella of $3,000,000.00.
II. The Agreement is submitted under the assumption that the plans and specifications are
complete, and no work is to be included that is not specifically mentioned. Any extra work which
the Demolition contractor is requested to perform shall be paid for as extra work. Additional
work shall not start unless mutually approved and in writing.
III. Owner, Contractor or its Agent represent that it has authority to contract for the wrecking and
removal of the buildings and structures as herein before provided and agrees to defend and
hold harmless Master Guys Demolition Inc against all suits or actions brought against it and to
indemnify it for any and all losses (including attorney's fees and expenses) it may suffer by virtue
of any wrongful wrecking and removal of the structures described herein in violation of the
property rights of any other person or party.
IV. Master Guys Demolition Inc shall not be held liable or be required to pay any amount as
damages for delay in completion of this work, and the Owner, Contractor or their *Agents, shall
waive all claim for damages against said Master Guys Demolition Inc for its failure to complete
the work in a given time, unless this contract states a definite per diem bonus and penalty. In
such event, Master Guys Demolition Inc shall not be held liable or required to pay a penalty for
time lost for delays beyond its control, including but not limited to Acts of nature, of any
governmental body, of the Public Enemy, or Another Contractor, Fire, Flood, Epidemic, Weather,
Strikes, Riots, Civil Disturbances, etc. An extension of time for such delays to be allowed in
determining the applicability of bonus or penalty.
V. Unless otherwise covered in the body of this contract, it is assumed that no party or common
wall condition exists. This agreement is tendered on that basis. If such a condition is determined
at a later date, any and all engineering or other work involved with the restoration of said party
wall shall be considered over and above the contract price stated herein.
VI. In the event any action is instituted to enforce any of the provisions of the contract or to
collect money due hereunder, Master Guys Demolition, Inc. shall be entitled to reimbursement
for any attorney and collection fees or any related expenses that it is obligated to pay.
VII. If payment is not made within the time specified, a monthly interest charge of 9.7% will be
added to the unpaid balance. Paying with a credit card 3% charge will be applied.
VIII. Due to the weight of heavy machinery and trucks, we cannot be responsible for damage to

sidewalks and curbs. Due care will be taken to minimize any possible damage.
IX. Should Owner cancel this contract, at any point, Owner shall pay Contractor for all costs
incurred, thought date of demobilization, including but not limited to: labor, materials and
overhead costs, plus profit. Three progress payments are to be made in the amount of 33.3%
first payment is to be made upon start date, second upon 50% of completion of obtaining the
demolition permit, final payment upon completion of work.

foundations, sidewalks, driveways, fences, trees or any underground construction damage by equipment or trucks making deliveries. Pools

Excavation —Soil testing, stabilization, compaction, undercuts, additional costs due to contaminated soils or hard to handle material,
additional cost due to discrepancies between the plans, or site conditions, unforeseen underground objects, shoring unless specifically noted
above, haul off of other trades spoils, protection and repair of landscaping, sidewalks, driveways and curb and gutter from truck and machine
traffic or construction activity in the performance of the above work. We assume no liability for damages to fences due to ground conditions
and tight lots. Embankment collapses will be billed at time and materials.
Sewer, Water & Storm — Protection and repair of landscaping, sidewalks, driveways and curb and gutter from truck and machine traffic or
construction activity in the performance of the above work, damage to sidewalks and driveways from shallow directional bores, additional
labor, and material due to utility conflicts. We assume no liability for damage to foundations, sidewalks, driveways, fences, trees or any
