SUMMARY/BACKGROUND
As part of the Building Division's process to maintain and audit old permit files we will often
find open permits with deposits paid to the Village.
The Village Attorneys drafted a letter that was sent to each outstanding permit holder, allowing
30 days to comply with village codes or risk cancellation of the permit, the release of liability
for non -permitted work, and the forfeiture of any fees or deposits held by the village. Over 80
open permits will be canceled with the Village retaining $4,500 for deposits. These permits
were issued in 2022 and earlier.

RESOLUTION NO. R--24
A RESOLUTION DECLARING THE FORFEITURE OF
CERTAIN PERMIT FEES AND DEPOSITS
WHEREAS, the Village has received permit fees and other deposits in connection with
various building permits issued by the Village, and
WHEREAS, some of the building projects have not received formal approval by the
Village; and
WHEREAS, the Village has notified the permitees of the fact that the building project a
have not been completed;
WHEREAS, a number of the permitees have not responded to correspondence sent on
behalf of the Village in connection with the outstanding permits; and
WHEREAS, the President and Board of Trustees have determined that any permit fees
or deposits issued in connection with those building permits shall be forfeited to the Village.
NOW THEREFORE BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont, Cook, DuPage and Will County, Illinois as follows:
SECTION l: The foregoing preambles are restated and incorporated herein by reference
as though fully set forth herein.
SECTION 2: Any permit fees or other deposits paid in the possession of the Village in
connection with building permits that have not received final approval from the Village are
hereby declared forfeited.
SECTION 3: The forfeited fees and other deposits shall be deposited in the Village's
General Fund.
SECTION 4: If any section, paragraph, clause or provision of this resolution shall be
held invalid, the invalidity thereof shall not affect any of the other provisions of this resolution.
SECTION 5: All resolutions in conflict herewith are hereby repealed to the extent of
such conflict.
SECTION 6: This resolution shall be in full force and effect from and after its passage,
approval and publication as provided by law.
ADOPTED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF LEMONT. COUNTIES OF COOK, WILL, AND DUPAGE, ILLINOIS,
