O-30-24 Rezoning 7.19-Acres of Property Located at 12935 MainVILLAGE OF E.M.UNT 418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jamie Tate, Community Development THROUGH: Jason Berry, CEcD, AICP, Economic & Community Development Director SUBJECT: An Ordinance Rezoning 7.19-Acres of Property Located at 12935 Main Street in Lemont, Illinois (Gas N Wash) DATE: July 22, 2024 SUMMARY/BACKGROUND Gas N Wash, owner of the property, has applied for rezoning from M-1 (Light Manufacturing District) to B-3 (Arterial Commercial District) for the 7.19-acre parcel adjacent to their fuel station development located at 12935 Main Street. They intend to construct an ancillary parking lot to serve the existing fuel station development that can park large vehicles such as trucks, trailers and RVs. Large vehicle parking is allowed in the B-3 zoning district with hour restrictions when it is accessory to an allowed use. ANALYSIS Comprehensive Plan The subject property is Community Retail (CR) in the Lemont 2030 Comprehensive Plan. The rezoning is in line with the Comprehensive Plan. Planning & Zoning Commission (PZC) The PZC held a public hearing to discuss the rezoning for the parking lot on July 10, 2024. The PZC recommended (4-0) to approve the rezoning with conditions incorporated into the ordinance. Committee of the Whole The rezoning of the subject property was discussed at the COW Meeting held on July 15, 2024. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Staff is recommending approval of the attached ordinance. BOARD ACTION REQUESTED A motion to approve the attached ordinance. O- � -24 AN ORDINANCE REZONING 7.19 ACRES OF PROPERTY LOCATED AT 12935 MAIN STREET IN LEMONT, ILLINOIS (GAS N WASH) WHEREAS Len Mcenery of Gas N Wash (hereinafter referred to as the "Petitioner") is the owner of the subject property covering approximately 7.19-acres located at 12935 Main Street (hereinafter referred to as the "Subject Property") described and depicted as Lot 3 in Exhibit A; and WHEREAS the Petitioner applied pursuant to the provisions of the Lemont, Illinois Municipal Code, Title 17 Unified Development Ordinance for a zoning map amendment from M- 1 to B-3 for the Subject Property; and WHEREAS the Planning & Zoning Commission of the Village of Lemont, Illinois conducted a public hearing on July 10, 2024 for the rezoning request and voted 4-0 to recommend approval with conditions incorporated into this ordinance; and WHEREAS the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, ("the Village") is a municipality in the state of Illinois with full powers to enact ordinances and adopt ordinances for the benefit of the residents of the Village; and WHEREAS, the Village and applicant have complied with the statutory procedures and requirements for rezoning of the Subject Property, defined as the 7.19 acres included in this ordinance. NOW THEREFORE, be it ordained by the President and Board of Trustees of the Village of Lemont, Cook, DuPage and Will County, Illinois as follows: SECTION 1: That the above recitals and legislative findings are found to be true and correct and are hereby incorporated herein and made a part hereof as if fully set forth in their entirety. SECTION 2: The subject property, described as Lot 3 in Exhibit A, is rezoned from M-1 to B-3 District in conformance with Village's Unified Development Ordinance. The zoning map of the Village of Lemont is hereby amended in accordance with the provision of this Ordinance. SECTION 3: The rezoning to B-3 for the Gas N Wash ancillary parking lot shall have the following conditions: 1. General Conditions. Unless otherwise approved by the Village Board, the subject property shall be developed and maintained in accordance with the Lemont, Illinois Municipal Code and this Ordinance. 2. Specific Conditions. Appropriate signage approved by the Economic & Community Development Director indicating `no idling', maximum parking hours and no overnight parking shall be installed prior to completion/certificate of occupancy for the large vehicle parking lot. A safe pedestrian path from the parking lot to the Gas N Wash convenience store shall be provided/installed with the site development permit for the parking lot. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. SECTION 5: If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance. 3 SECTION 6: All ordinances in conflict herewith are hereby repealed to the extent of such conflict.
