SUMMARY/BACKGROUND
The applicant, John Avelar of J-Ave, owner of the property, is requesting a modification to the
existing special use for an outdoor storage and container storage yard at 16430 New Avenue.
In 2020, the subject property was annexed into the Village of Lemont, rezoned to M-1, and
granted a special use to operate the J-Ave trucking business. According to §17.04.140 Special
Uses (F) in the Unified Development Ordinance (UDO), a change in the intensity of use of an
existing special use shall be deemed the same as a new special use and shall require
approval pursuant to the provisions of §17.04.140. The additional special use will allow for
Wheel 2 Wheel, a truck maintenance and tire rotation business, to rent space from J-Ave to
operate a truck maintenance and tire rotation business at 16430 New Avenue.

The Lemont 2030 Comprehensive Plan identifies the subject property as Industrial (IND).
Planning & Zoning Commission (PZC)
The PZC held a public hearing at the regularly scheduled meeting on May 1, 2024 and
recommended approval (6-0) with conditions incorporated into the attached ordinance.
Commitee of the Whole (COW)
The COW discussed the proposal at the meeting held on May 20, 2024.

WHEREAS, John Avelar, represented by Dariusz Wator of Wator & Associates,
(hereinafter referred to as "the Petitioner") is the applicant and owner of the property at 16430
W. New Avenue in Lemont (PINS# 22-30-101-048-0000, 22-30-101-043-0000 and 22-30-101-
044-0000) (hereinafter referred to as the "Subject Property") described in the Legal Description,
attached hereto as Exhibit A; and
WHEREAS, J-Ave Trucking, owned and operated by John Avelar, obtained a special use
(0-08-20) on February 10, 2020 to operate their tricking maintenance and outdoor storage
business at 16430 New Avenue following annexation into the Village of Lemont and rezoning to
M-1 at the same time; and
WHEREAS, the Petitioner applied pursuant to the provisions of the Lemont, Illinois
Municipal Code, Title 17 Unified Development Ordinance ("UDO") seeking an additional special
use for a change to the approved special use pursuant to 17.04.140 F. of the UDO to all for an
additional trick maintenance facility, Wheel 2 Wheel, to operate out of the building at 16430 New
Avenue; and
WHEREAS, the Planning and Zoning Commission of the Village of Lemont, Illinois
conducted a public hearing on May 1, 2024 and voted 6-0 to recommend approval of the special
use for the Wheel 2 Wheel trick maintenance business with conditions incorporated in this
Ordinance; and
WHEREAS, a notice of the aforesaid public hearing was made in the manner provided by
law and was published in the Daily Southtown, a newspaper of general circulation within the
Village; and
WHEREAS, the President and Board of Trustees of the Village have reviewed the matter
herein and have determined that the requested special use is in the best interest of public health,
safety, and welfare of the residents of the Village of Lemont, and hereby adopts the finding of facts
as set forth in Exhibit B.
NOW, THEREFORE BE IT ORDAINED by the Village President and Board of
Trustees of the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois as follows:
SECTION ONE: The foregoing findings and recitals are hereby adopted as Section
One of this Ordinance and are incorporated by reference as if set forth verbatim herein.
SECTION TWO: A special use is granted for a trick maintenance facility in addition
to J-Ave at 16430 New Avenue in the M-1 District.
SECTION THREE: The special use shall have the following conditions:
l . The special use is granted solely to Wheel 2 Wheel; and
2. The hours of operation shall not extend beyond 8am-7pm Monday through Saturday;
and
3. All signage must obtain permits, including existing signage located at 16430 New
Avenue, adhering to the Village's Unified Development Ordinance.
4. Additional screening in the form of landscaping or solid fencing should be provided to
shield lights and new truck traffic from adjacent residences; and
5. Sign illumination shall be turned off during non -business hours.
SECTION FOUR: That the Village Clerk of the Village of Lemont be and is directed
hereby to publish this Ordinance in pamphlet form, pursuant to the Statutes of the State of Illinois,
made and provided.
SECTION FIVE: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication as provided by law.
ADOPTED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DuPAGE, ILLINOIS, on

Plan's goals and applicable aspects of the Unified Development Ordinance.
The special use meets the standards for a special use found in § 17.04.140 with the
conditions included in this ordinance.
