SUMMARY/BACKGROUND
Lemont Public Works Annex -Grading, Basin, Storm & Watermain — Earth Excavation Overage
Explanation.
The attached Engineer's letter explains the difference in final quantity compared to plan
quantity for Item#1 Earth Excavation. This can be attributed to a number of areas where
additional earth excavation was needed that was not accommodated for in the plan quantity.
1. Septic Tank — the existing septic tank at the existing house was damaged/leaking. The
area was overdue in order to remove the waste.
2. Bore Pit/Receiving Pit (Archer) — a conflict with Nicor occurred where Bullseye planned
on putting their pits in at. Extra excavation was needed to accommodate.
3. Bore Pit/Receiving Pit (Derby) — another conflict occurred along Derby Road. Similar to
as noted above.
4. Derby Road Drainage Ditch — potholing by a contractor not affiliated with this project was
happening on Derby Road. Spoils were left in the ditch and Winninger was asked to remove
the spoils and re -grade the ditch to confirm proper flow.
5. Excavated & Re -graded swale between the detention basin and the existing pond to the
west.
6. Overflow weir — when excavating for the overflow weir, a lot of fill material like brick and
miscellaneous bad soils were removed and replaced with more suitable material from the site.
7. Old Footing — while installing the water main, an old large concrete footing was
encountered. Entire footing was removed and paid as earth excavation.
8. Winninger noted multiple times that it appeared that there was a notable amount of
additional material on site that was not shown in the plan elevations. The potential for
additional material to have been "fly -dumped" onto the site is high. Winninger's as-builts &
elevation checks have all been confirmed.
There was additional material that the contractor was trying to get additional payment but was
denied because it was found to be part of the detention basin pay item.

RESOLUTION NO. R--24
A RESOLUTION APPROVING PUBLIC WORKS ANNEX GRADING, BASIN, STORM
SEWER, WATER MAIN EARTH EXCAVATION OVERAGE
WHEREAS the Village of Lemont recommends that Public Works Annex Grading,
Basin, Storm Sewer, Water Main Earth Excavation Overage be accepted; and
WHEREAS, the Village awarded the contract to Winninger Excavating, Inc., 1211 Deer
Street, Yorkville, Illinois 60560 with R-34-23 on 5/8/2023; and
WHEREAS, Winninger Excavating, Inc. has completed the Public Works Annex
Grading, Basin, Storm Sewer, Water Main Earth Excavation Overage in the amount of
$106,692.20.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows:
SECTION 1:
Public Works Annex Grading, Basin, Stonn Sewer, Water Main Earth Excavation
Overage was completed by Winninger Excavation, Inc., 1211 Deer Street, Yorkville, Illinois,
60560 in the amount of $106,692.20 is hereby approved.
SECTION 2:
The Village President, Administrator, or Designee is hereby authorized to execute the
agreement and to make minor changes to the document prior to execution that do not materially
alter the Village's obligations, to execute any other agreements and documentation as well as to
take any other steps necessary to carry out this resolution.
SECTION 3:
This Resolution shall be in full force and effect from and after its passage and approval as
provided by law.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DUPAGE, ILLINOIS,
