O-18-24 Annexing 5.1 Acres at 14447 131st Street in Lemont, IL (DJK418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jamie Tate, Community Development THROUGH: Jason Berry, CEcD, AICP, Economic & Community Development Director SUBJECT: An Ordinance Annexing 5.1 Acres at 14447 131st Street in Lemont, IL (DJK Custom Homes) DATE: May 13, 2024 SUMMARY/BACKGROUND DJK Custom Homes, property owner and applicant, has requested annexation into the Village of Lemont for the 5.1-acre vacant parcel accessed via 130th Street from Magdalena Drive. The property will remain the default zoning of R-1, Detached Single -Family Residential District, for the development of one single-family home. The annexation includes an annexation agreement that has been presented to the Village Board on May 13, 2024. ANALYSIS The potential annexation of the 5.1-acre property at 14447 131st Street for the purpose of a detached single-family home was discussed at the Commitee of the Whole meeting on August 21, 2023. The annexation of the property was recommended by the Planning & Zoning Committee (6-0) on May 1, 2024. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Staff is recommending approval of the annexation. BOARD ACTION REQUESTED A motion to approve the annexation. ORDINANCE NO. 0 -1q ­ AN ORDINANCE ANNEXING TO THE VILLAGE OF LEMONT APPROXIMATELY 5.1 ACRES LOCATED AT 14447 131st STREET IN LEMONT, IL (DJK Custom Homes) WHEREAS, the Clerk of the Village of Lemont has received an Application for Annexation of certain territory into the Village pursuant to Chapter 65, Act 5, Section 7-1-1 of the Illinois Compiled Statutes; and WHEREAS, the Territory (PIN: 22-33-203-020) is described on the Plat of Annexation by Engineering Resource Associates, dated 11/02/2023, attached hereto as Exhibit A; and WHEREAS, the territory described in the Application for Annexation is not within the corporate limits of any municipality but is contiguous to the Village of Lemont; and WHEREAS, legal notices regarding the intention of the Village to annex said territory have been sent to all public bodies required to receive such notice; and WHEREAS, the legal owner of record of said territories have submitted all required petitions and documents authorizing the annexation of the territory; and WHEREAS, the President and Board of Trustees of the Village have reviewed the matter herein and have determined that the same is in the best interest of the public health, safety and welfare of the residents of the Village of Lemont. NOW THEREFORE, BE IT ORDAINED by the Village President and Board of Trustees of the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows: SECTION ONE: That the following described Territory, being indicated on an accurate map. of the annexed territory, (attached hereto as Exhibit "A") is hereby annexed to the Village of Lemont, Counties of Cook, DuPage, and Will, Illinois. SECTION TWO: That the Village Clerk is hereby directed to record with the Recorder of Deeds and to file with the County Clerk a certified copy of this Ordinance together with an accurate map of the territory annexed appended to this Ordinance. SECTION THREE: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form as provided by law. SECTION FOUR: All Ordinances or parts of Ordinances in conflict herewith shall be and the same are hereby repealed.
