O-08-24 Renewing a Moratorium for Non-Retail Land Uses in the State & 127th Economic Activity Center418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jason Berry, Community Development THROUGH: SUBJECT: An Ordinance Renewing a Moratorium for Non -Retail Land Uses in the State & 127th Economic Activity Center DATE: February 26, 2024 SUMMARY/BACKGROUND The Village of Lemont approved a moratorium on non -retail used in the B-1 and B-3 zoned properties inside the State and 127th Street economic activity center, as mapped by the Village's comprehensive plan. Following discussion at the February Committee of the Whole, the moratorium will be restated for an additional 180 days. ANALYSIS Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Approve the Ordinance. BOARD ACTION REQUESTED Motion to Approve the Ordinance. O- -24 AN ORDINACE RENEWING A MORATORIUM FOR NON -RETAIL LAND USES IN THE STATE & 127TH ECONOMIC ACTIVITY CENTER WHEREAS, on June 26, 2023 the President and Board of Trustees adopted Ordinance No. 0-25- 23 entitled "An Ordinance Establishing A Moratorium for Non -Retail Land Uses in the State & 127"' Economic Activity Center" ("Ordinance"); and WHEREAS, the purpose of the Ordinance was to establish a moratorium period ("Moratorium Period") of 120 days on all applications, review and approvals of any zoning application, building permit, business license, for any land use principally comprised of non -retail sale tax generating uses in the State & 1271' EAC; and WHEREAS, the President and Board of Trustees have determined that it is necessary to extend the Moratorium Period. NOW THEREFORE, be it ordained by the President and Board of Trustees of the Village of Lemont, Cook, DuPage and Will County, Illinois as follows: SECTION l: That the above recitals and legislative findings are found to be true and correct and are hereby incorporated herein and made a part hereof as if fully set forth in their entirety. SECTION 2: The Moratorium Period set forth in the Ordinance is extended an additional 120 days from the adoption of this ordinance. SECTION 5: This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law. SECTION 6: If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance SECTION 7: All ordinances in conflict herewith are hereby repealed to the extent of such conflict.
