R-02-24 Approving Business District Improvement Grant for the AprilVILLAGE OF EMONT418 Main Street I Lemont, IL 60439 TO: Village Board Meeting FROM: Jason Berry, Community Development THROUGH: SUBJECT: A Resolution Approving Business District Improvement Grant for the April 2023 Cycle DATE: January 8, 2024 SUMMARY/BACKGROUND The Village of Lemont continues to show success with its business grant programs. Thanks to the success of the program, there is a consistent queue of applications for support among businesses and property owners. Matt's Barbecue, LLC, had their grant application reviewed and approved by the Historic Preservation Commission in March, 2023. Due to materials delays, the permit from February 2023 had to be extended twice, to June and July 2023. The project was completed in September 2023. The project has been reviewed and found to meet the Village's grant eligibility requirements for reimbursement. The grant total is $25,000.00 ANALYSIS The Lemont 2030 Comprehensive Plan recommends implementing a comprehensive incentives policy. The current policy has remained consistent and was last discussed on May 15, 2022. Consistency with Village Policy Lemont 2030 Comprehensive Plan STAFF RECOMMENDATION Approve the Resolution. R- -24 A RESOLUTION APPROVING BUSINESS DISTRICT IMPROVEMENT GRANT FOR THE APRIL 2023 CYCLE IN LEMONT, IL WHEREAS the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, ("the Village") is a municipality in the state of Illinois with full powers to enact ordinances and adopt resolutions for the benefit of the residents of the Village; and WHEREAS, the Lemont 2030 Comprehensive Plan recommends establishing a community -wide facade and site improvement program; and WHEREAS, to support economic growth within Village's commercial districts the Board of Trustees has established a Business District Improvement Grant and Downtown Retail Recruitment Incentive programs (the "Program") and approved funding for applications within the Village in the FY23 Budget; and WHEREAS, said Program is administered by the Village and is funded from General Fund and TIF District Revenues for purposes of control and prevention of blight, dilapidation and deterioration of designated areas within the District; and WHEREAS, pursuant to said Program the Village has agreed to participate, subject to its sole discretion, in sharing the costs of building, sign, and site improvements to commercial and institutional establishments within the Village; and WHEREAS, applications were reviewed by the Historic Preservation Commission at the regular meeting of March 9, 2023 and the proposed work was found to meet the requirements for a certificate of appropriateness as necessary and as the grant review committee the proposed work was found to be eligible for a grant under the criteria of the Program; and WHEREAS, the Owner/Lessee desires to participate in the Program pursuant to the terms and provisions of the Village; and WHEREAS, the Mayor and Board of Trustees find that it is in the best interests of the Village to authorize eleven Business District Improvement Grants totaling $25,000.00 NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows: SECTION 1: RECITALS. That the above recitals and legislative findings are found to be true and correct and are hereby incorporated herein and made a part hereof as if frilly set forth in their entirety. SECTION 2: The Mayor and Board of Trustees of the Village of Lemont hereby approve the following Business District Improvement Grant Agreements in substantially the same form as attached hereto as Exhibit A, subject to attorney review: a) Matt's Barbecue, LLC for 308 Canal Street (pergola and lighting), in the amount of $25,000 SECTION 3: EFFECTIVE DATE. This Resolution shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. ADOPTED this 8th day of January, 2024. Use of Funds The Village of Lemont ("the Village") shall reimburse the Owner/Lessee for the shared cost of property improvements, as described in the Business District Improvement Grant application ("Grant"). The maximum amount of reimbursement shall not exceed $ 2. Verification of Expenses Within 90 days of the below acceptance date, applicants must submit verification in the form of receipts or other records of payments made for the approved eligible expenses. 3. Failure to Complete Work If the Owner/Lessee or their contractor fails to complete the building, sign, or site improvements in conformity with the plans provided for in application, this Grant shall terminate and the financial obligation on the part of the Village shall cease and become null and void. 4. Village and General Indemnification The Owner/Lessee agrees to defend and hold harmless the Village from all claims which may arise out of said owners' construction activities under this Grant. In the event that, as a result of this Grant, or actions taken as required hereunder, the Village is made a party defendant in any litigation arising by reason of this Grant, and development activities contemplated hereunder, the owners agree to defend and hold harmless the Village, the mayor, trustees, officers and agents thereof, individually and collectively, from any suits and from any claims, demands, setoff or other action including but not limited to judgments arising therefrom. Certification: The undersigned certifies that to the best of my knowledge and belief, all information contained in the grant application is true, complete and correct. The undersigned agrees to provide the Village with verification of expenses and agrees to furnish any additional information to the Village as needed. Failure to comply with these conditions may require the return of funds.
