SUMMARY/BACKGROUND
Over the past several years, the Community Development Department has identified a need to
adopt more current building codes. The International Code Council (ICC) provides a new suite
of I -codes every three years. Lemont last adopted a building code in 2008, when it selected
the 2006 1-codes. There have been minor amendments since, but few major changes.
Working with Village consultants, including TPI, staff recommends adopting the 2021 1-codes
for the Village of Lemont, effective January 1, 2024.

ANALYSIS
Adopting new codes in has been a goal for the Community Development Department since
the Lemont 2030 comprehensive plan, which included as an implementation action adopting
the International Existing Building Code (which didn't exist when the Village adopted its
current building codes in 2008). The 2018 strategic plan also set a Community Development
initiative to update the regulatory environment, including building codes. Lastly, the Office of
the State Fire Marshall adopted new statewide fire codes in 2020, putting additional pressure
on the Building Division to take action on new development codes.

AN ORDINANCE AMENDING THE LEMONT, ILLINOIS MUNICIPAL CODE,
TITLE 15 THE BUILDING CODE OF THE VILLAGE OF LEMONT
(2021 I -Codes and Local Amendments)
WHEREAS, the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, ("the
Village") is a municipality in the state of Illinois with full powers to enact ordinances and adopt
resolutions for the benefit of the residents of the Village; and
WHEREAS, the President and Board of Trustees of the Village of Lemont (the
"Corporate Authorities") may from time to time amend the text of the Village Code when it is
determined to be in the best interests of the residents of the Village; and
WHEREAS, the Corporate Authorities find that it is in the best interest of the Village to
amend the Village Code provisions regarding the demolition of structures.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of
the Village of Lemont, Counties of Cook, Will and DuPage, Illinois, as follows:
SECTION 1: That the above recitals are found to be true and correct and are hereby
incorporated herein and made a part hereof, as if fully set forth in its entirety.
SECTION 2: The Village Code, as amended, is further amended in Title 15, Buildings
and Construction Chapter, with additions shown in underlined text and deletions shown in
*ri'��gh to Chapter 15.00. Building Administration of the Village Code as follows:
Chapter 15.00.050 Existing structures criteria; structures moved into village. Delete
in its entirety, and in lieu of, add the following:
Reserved.
Chapter 15.00.080 Building permits.
(m) Extension and expiration of a building permit.
(2) Commercial and residential remodel, swimming pools. Commercial and
residential remodel projects and swimming pools must be started within 30 days of
permit issuance and completed within six months. Where the construction process
is expected to exceed six months time in completion, a schedule of completion
shall be provided at time of application for permit and shall be provided in the
issued permit at the discretion of the village building commissioner.
a. Where, under the authority of a commercial and residential remodel
permit or swimming pool permit, work has not commenced within 30 days
after issuance of such permit, all rights under such permit shall thereupon
terminate and work may commence only after application for and issuance
of a new commercial and residential remodel permit.
(3) All pennits, excluding commercial and residential new construction permits
and commercial and residential remodel permits: Permits other than commercial
and residential new construction permits and commercial and residential remodel
permits must be completed within 4-5 90 days of permit issuance. Where the
construction process is expected to exceed 4-5 90 days time in completion, a
schedule of completion shall be provided at time of application for permit and shall
be provided in the issued permit at the discretion of the village building
commissioner.
(7) Permit issuance. Upon notification of approval by the building department, a
permittee n+ust retrieve the approved building "nziic from the v..........b
depaftment. All all building permits must be fetrieved and paid in full within 45
days of the notice date. Any building permit not paid in full and r-etfieved within
45 days shall expire and be invalidated.
15.00.110. Certificate of occupancy.
(e) Temporary occupancy permits for landscaping and exterior work. Between the dates
of November 1 and April 1, a temporary occupancy permit may be requested if the
required landscaping and exterior work cannot be completed due to adverse weather
conditions. The building official may also consider the issuance of a temporary occupancy
during other than the dates listed in the first sentence of this subsection when a written
request showing reasonable cause has been submitted in advance.
SECTION 3: The Village Code, as amended, is further amended in Title 15, Buildings
and Construction Chapter, with additions shown in underlined text and deletions shown in
str-ikethfetto to Chapter 15.04. Industrial, Commercial, and Multifamily Building Code of the
Village Code as follows:
15.04.010. Adopted.
There is adopted by reference, as if fully set out in this chapter, governing the construction
of all nonresidential and multifamily structures, that certain code known as the
International Building Code, 24 2021 edition, ineluding Appendix Chaptefs B and
thr-ough j inelusive, including appendices listed in 15.04.020, as published by the
International Code Council, Inc., together with the additions, insertions, deletions and
changes set forth in section 15.04.020, one copy of which has been for a period of more
than 30 days prior to the effective date of the ordinance from which this chapter is derived
and now is on file in the office of the village clerk.
15.04.020. Amendments. Delete in its entirety, and in lieu of, add the following:
The following additions, insertions deletions and changes are made to the International
Building Code, 2021 edition as adopted in section 15.04.010 of the Village of Lemont
Municipal Code.
Section 10 1. 1 Title: Revise section 10 1. 1 as follows:
101.1 Title. These regulations shall be known as the Building Code of the Village of
Lemont, hereinafter referred to as "the code."
Section 101.4.3 Plumbing. Delete in its entirety, and in lieu of, add the following new
section 101.4.3:
101.4.3 Plumbing. The provisions of the Illinois Plumbing Code, most current edition
shall apply to the installation alteration repair and replacement of plumbing systems
including equipment appliances fixtures fittings_and appurtenances and where connected
to a water or sewage system and all aspects of a medical gas system. The provisions of the
International Private Sewage Disposal Code shall apply to private sewage disposal
systems References to the International Plumbing Code within this or any other code
adopted by the Village of Lemont other than references to required drainage systems for
flat roofs (See the International Plumbing Code 2021 edition, Chapter 11 except for
Sections 1102 1103.1 and 1109) shall be deleted and the words "Illinois Plumbing
Code most current edition" shall be added in its place.
Section 101.4.6 Energy. Delete in its entirety, and in lieu of, add the following new
section:
101 4 6 Energy. The provisions of the most recently published version of the Illinois
Energy Conservation Code shall apply to all matters governing the design and
construction of buildings for energy efficiency.
Section 101.4.8 Electrical. Delete in its entirety, and in lieu of, add the following new
section 101.4.8:
101.4.8 Electrical. The provisions of the 2020 National Electrical Code as adopted and
amended by the Village of Lemont shall apply to the installation of electrical systems,
including alterations repairs replacement equipment appliances fixtures fittings and
appurtenances thereto References to the ICC Electrical Code within this or any other code
adopted by the Village of Lemont shall be deleted and the words, "2020 National
Electrical Code as adopted and amended herein" shall be added in its place.
Section 101.4.9 Zoning. Add new section 101.4.9 as follows:
101 4 9 Zoning. The restrictions of the Zoning Ordinance of the Village of Lemont and all
amendments thereto shall not be deemed to be modified by any provisions of this Code;
and such restrictions shall be controlling except insofar as this Code imposes rg eater
restrictions by reason of the type of construction used in which case the provisions of this
code shall control.
Section 102.4 Referenced codes and standards. Delete in its entirety, and in lieu of, add
the following:
102.4 Referenced codes and standards. Where differences occur between the provisions
of this code and referenced codes and standards the most restrictive provisions shall
apply.
Section 103.1 Creation of enforcement agency. Revise section 103.1 as follows:
103.1 Creation of enforcement agency. The Village of Lemont Building Division is
hereby created and the official in charge thereof shall be known as the building official.
The function of the agency shall be the implementation, administration and enforcement
of the provisions of this code.
105.2 Work exempt from permit. Amended as follows:
Building:
1 Delete this exemption all accessory structures require a building permit.
2. Delete this exemption all fences shall require a building permit.
4. Delete this exemption and replace as follows: Retaining Walls that are not over
24 inches in height measured from the bottom of the footing to the top of the wall,
unless supported by a surcharge.
6. Delete this exemption all sidewalks service walks, driveways, and patios shall
require a permit.
9 Delete this exemption all swimming pools over 24 inches in depth and greater
than five feet in any direction shalt require a permit.
105.3.2 Time limitation of application.
Include the following statement: The Building Official may also deem a permit
application abandoned at any time due to inactivity.
105.5 Expiration. Delete in its entirety.
113.3 Qualifications. Delete in its entirety.
507.3 Non-sprinklered, one story. Delete in its entirety.
508.2.4 (3) Fire separation between Occupancy Group B and Occupancy Group S or
Group F in the same building.
Office spaces 2,000 square feet and larger, located within buildings having the Primary
Occupancy Group S and/or F shall be separated from the warehouse area with a fire
barrier having a minimum fire resistance rating of one hour.
1011.7 (3) Stairways for buildings three stories or more.
3. Stairways in buildings of Type 3 and Type 5 construction with three or more
stories in height shall be of noncombustible materials throughout.
1809.5.2 Minimum depth for footings and foundations.
All footings postholes trench foundations etc including those for fences and dumpster
enclosure support posts shall be installed to a minimum depth of 42 inches below grade.
Chapter 29 Plumbing systems. Delete in its entirety.

The following additions insertions deletions and changes are made to the International
Residential Code for One- and Two -Family Dwelling Code, 2021 edition, adopted in
section 15.06.010:
R101 1 Title. Insert "the Village of Lemont" where name of jurisdiction is required.
R102 Applicability. Add the following new section R102.8:

R106.1.6 Deck submittal requirements.
In addition to 106.1 construction documents shall be scaled and dimensioned and shall be
of sufficient clarity to indicate the location nature and extent of the work proposed,
including, specific details on all structural members decking guardrails handrails, stairs
(including treads and risers) post holes brackets connectors hangers fasteners etc and
show in detail that it will conform to the provisions of this code and relevant laws,
ordinances rules and regulations as determined by the building official. All construction
documents for decks with a total area greater than 300 square feet or a height of more than
8'-0" above grade or a complex structure of multiple levels shall be designed, signed, and
sealed by an Illinois Licensed Architect or Structural Engineer.
Section 109.1.6 Final inspection. Delete in its entirety and in lieu thereof substitute the
following new section R109.1.6:
R109.1.6 Final inspection. Final inspection shall be requested within 30 days after the
peimitted work has been completed and prior to any occupancy. R 1091 6 1 shall remain
as published in the IRC.
R112.3 Qualifications. Delete in its entirety.

302.3.2 Two-family dwelling unit conversions. Dwelling units in two family dwelling
conversions from single family dwelling shall comply with Section R302.3
Table R302 5 Dwelling Garage Separation. Where Table R 302.6 references 'V2 gypsum
board replace the 1/2 -inch or equivalent with a UL rated 1 Hour wall assembly or
equivalent.
R303.1 Habitable rooms. Amend by adding the following new section R303.1.1:

Required by adding the following sentence to the end of the paragraph:
Rooms such as studies dens libraries offices etc., which contain closets and/or
bathrooms shall be classified as a sleeping room and require emergency escape and
opening as indicated in R310.1.
R313 Automatic Sprinkler Systems. Delete in its entirety
Section R314.1 Smoke detection and notification. Delete this section and replace as
follows:
R314 1 Smoke detection and notification. Smoke alarms shall comply with NFPA 72,
Section R314 and the latest Illinois Compiled Statute regarding smoke detection. Where
there is a conflict between these codes the most restrictive shall apply.
Section R401.4 Soil Tests. Delete in its entirety and replace as follows:
R401 4 Soil Tests A soil test shall be submitted for every new single and attached family
dwelling prior to installing any buildingfootings/foundations. ootings/foundations. This test shall be done by
an approved agency using an approved method.
R403.1.4.1 Frost protection. Delete Exceptions 1 and 2 from R403.1.4.1 and replace as
follows:
Exception 1 Protection of freestanding accessory strictures with an area of 200
square feet or less shall not be required.
R404 1 8 Rubble stone masonry. Delete in its entirety. Rubble stone masonry
foundations shall not be permitted.
R404 2 Wood foundation walls. Chapter 4 remove all references in IRC Chapter 4
regarding wood footings and foundations. Wood footings and foundations are not
permitted.
Section R408.8 Under floor vapor retarder. Delete and replace as follows:
R408 8 Crawl spaces In crawl spaces the soil shall be leveled and covered with a
minimum of two-inch (2") screed coat of concrete over a minimum of 3" of gravel and an
approved vapor barrier. Crawl spaces shall provide no less than thirty inches (30")
clearance measured from finished concrete floor to bottom of the floor joists and girders.
R506.1 General. Add new section:
R506 1 1 Garage Slabs on Grade The minimum concrete thickness for a Garage Slab
will be 4" and require the installation of metallic reinforcing bar, welded wire mesh or
fiber reinforcement.
R801 4 Roof drainage discharge For any structures over two hundred fifty square feet
(250 sq ft.), the roof water discharge in R801.3 shall not be located within three (Y) feet
of any lot line.
Section R1005.9 Factory -built fireplaces. Amend by adding the following new section
R1005.9:
R1005.9 Fireplace and chimney enclosures. All exposed exterior chimney sections shall
be enclosed in a chimney chase which provides for proper clearances per manufacturers
requirements and is constructed of masonry or approved materials consistent with the
construction of the existing structure The interior walls of the fireplace enclosure and
chimney shall be insulated with materials consistent with that required for exterior walls
and shall be fully sheathed with minimum '/zinch gypsum board at all points below the
roof line.
Delete Chapter 11• Insert: Refer to the latest published version of the Illinois State
Energy Conservation Code.
G2445 (621) Unvented room heaters. Delete Section G2445.1 through G2445.7.7 (621.1
thru 6217 Tits entirety and add the following new section G2445.1 (621.1):
G2445.1 (621.1) General Unvented appliances including room heaters and fireplaces
shall not be permitted in any dwelling unit.
Part VII—Plumbinp,. Delete Chapter 25 through 32. Residential plumbing shall
comply Section R102.9 Plumbing of 15.06020.
3303.1.5 Sump and Storm Water Discharge.
Sump discharge shall be connected with tight -joint glazed tile or approved equal to storm
sewer, sump pump dry well or other approved outlet Sump pumps not connected directly
to a storm sewer system must discharge a minimum of five feet (5') from the foundation
walls Discharge must conform to the approved grading, plan and in no case shall be
extended closer than three feet (3') from the rear or side property line. Downspout
discharge must discharge a minimum of 3' from the foundation walls and a minimum of
3' from all property lines Sump pumps may not discharge to the front yard or exterior
side yard unless specifically approved by the Village Engineer. Sump Pump and Storm
Water Discharge shall not be discharged in a manner that creates a public nuisance.
M1601 1 1 Above -ground duct systems. Delete item no. 7 in its entirety and in lieu
thereof substitute the following new item no. 7. On all residential developments, flexible
metallic air ducts shall only be used where practical difficulties are encountered subject to
review and approval by the Building Official prior to installation.
Part VIII—Electrical Delete in its entirety. Residential electrical shall comply Section

be construed to cancel modify, or set aside any provision of the Zoning Ordinance of the
Village of Lemont.
103.1 Code Compliance Agency. Insert "Village of Lemont Community Development
Department"
104.1 Fees. Delete in its entirety. and replace as follows:
Refer to Lemont Municipal Code Chapter 15.02 for pen -nit fee requirements.
302.4 Weeds. Delete the first sentence in its entirety and in lieu thereof substitute the
following new sentence:
All premises and exterior property shall be maintained free from weeds or plant growth in
excess of eight (8) inches.

outside shall be located along a wall of the principal structure or garage which does not

15.08.020. Amendments. Delete in its entirety, and in lieu of, add the following:
The following additions insertions deletions and changes are made to the National
Electrical Code 2020 edition, adopted in section 15.10.010:
Article 90 4 1 Contractors. Contractors and homeowners shall comply with Chapter 5.14
of the Lemont Municipal Code when performing electrical work within the Village of
Lemont.
Article 90.4.2 Service Protection. Electrical service will be approved only after the
service panel is adequately protected from the weather.
Article 90.4.3 Rough Inspections. Rough electrical inspection shall be approved only_
after all piping is completed and conductors have been pulled unless otherwise approved
in nwnnce
Article 90 4 4 Homeowner. The owner of a single-family residence may perform their
own electrical wiring providing they obtain a permit and prove that the dwelling has been
their primary residence for a period of not less than six months.
Article 210.12 Arc Fault Circuit Interrupter Protection. Delete in its entirety.
Delete Article 230.43 and replace as follows:
230.43 Wiring Methods for 1000 Volts, Nominal, or Less. Service -entrance conductors
shall be installed in accordance with the applicable requirements of this code covering
type of wiring method used and shall be limited to rigid metal conduit (RMC) or
intermediate metal conduit (IMC) above ground and PVC or RMC underground.
Article 250 53(D)(2) Supplemental electrode required. A metal underground water pipe
shall be supplemented by an additional electrode of a type specified in 250.52(A)(2)
through (A)(7) Where the supplemental electrode is a made electrode of the rod, pipe, or
plate type it shall comply with 250.56. The supplemental electrode shall be bonded to the
grounding electrode conductor or the grounded service entrance conductor.
Article 230.85 Emergency Disconnects. Delete in its entirety.
Article 310 3(B) 1 All conductors under 500 amp service must be copper. Conductors for
services 500 amps and higher may be aluminum under approval of the Building Official.
Article 314.27.A.3 Future Fixtures:
Any location which could reasonably have a ceiling fan (or large heavy light fixture) now
or in the future should have a fan rated box. Though many factors can influence the
location these specific factors should be considered as locations likely to have a fan and
therefore a rated box:
• A light fixture box located in or near, the center of any bedroom, living room, 3-
season room covered porch multi-purpose/recreation room multi -story foyer, etc.
• A light fixture box located at an even interval or 1/3 points along a large room
• A light fixture box located in or near the center of a table location for a breakfast
area kitchen table, dining room table, etc.
• A light fixture box located over the center of a large or "eat at" kitchen island
Additional factors that should be considered in these areas is the size of the room and the
location of any fixed book cases or cabinets that would prohibit enough space for a ceiling
fan.
A fan rated box should not be required to be installed in the following locations unless it is
known based on the plans that a fan will be installed there: bathroom, garage, laundry
room, hallway.
Article 320 Armored cable: Type AC. Delete in its entirety.
Article 324 Flat Conductor cable: Type FCC. Delete in its entirety.
Article 326 Integrated gas spacer cable: Type IGS. Delete in its entirety.
Article 330 Metal -clad cable: Type MC. I
Use of Type MC MC shall onlypermitted when installed as a manufactured product in
Article 604 or when the length of any section of MC is less than 6 feet with a dedicated

Article 410.36(B) Means of Support. Lighting fixtures two pounds and heavier installed
in or above a suspended type ceiling shall be supported from at least 2-sides or opposite
corners to the main structure of the building.

Forty (40) Space panel for dwellings under 2,500 square feet. The square footage of
dwellings is based on the living space, excluding basements and garages.

held invalid, the invalidity thereof shall not affect any other provision of this ordinance.
SECTION 16: All ordinances, resolutions, motions or orders in conflict with this
ordinance are hereby repealed to the extent of such conflict.
SECTION 17: This ordinance shall be in full force and effect upon its passage, approval
and publications as provided by law.
