SUMMARY/BACKGROUND
M/I Homes has requested the reduction of letters of credit for grading and the units listed
below and Village acceptance of the public improvements in these units following the
maintenance period. The Village Engineer and Public Works have performed their punch list
walkthrough and recommend acceptance by the Village Board. The following letters of credit
are requested for release:
• Phase 1 Grading - US Bank LOC #SLCLSTL10553
• Phase 2 Grading - US Bank LOC #SLCLSTL11074
• Phase 1 Unit 1 - US Bank LOC #SLCLSTL10690
• Phase 1 Unit 3 - US Bank LOC #SLCLSTL10691
• Phase 2 Unit 4 - US Bank LOC#SLCLSTL11190
• Phase 2 Unit 5 - US Bank LOC#SLCLSTL11191
These units will be fully turned over to the Village upon approval by the Village Board.

A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS AND
REDUCING THE LETTER OF CREDIT FOR KETTERING
SUBDIVISION
WHEREAS, certain real property has been dedicated to the Village, as depicted on
Kettering Subdivision (attached hereto as Exhibit A), for the purpose of public infrastructure; and
WHEREAS, pursuant to the Lemont Unified Development Ordinance of 2008 ("UDO"),
an owner or developer of a subdivision is required to deposit certain security or evidence thereof
with the Village of Lemont to guarantee the installation of public improvements; and
WHEREAS, in the matter of the Kettering subdivision, owned and developed by M/I
Homes Chicago Division, located generally south of 131" Street, and west of Parker Road, in the
Village of Lemont, US Bank National Association issued Irrevocable Letter of Credit
#SLCLSTL10553, #SLCLSTL11074, #SLCLSTL10690, #SLCLSTL10691 #SLCLSTL11190
and #SLCLSTL 11191 which were deposited with the Village of Lemont to guarantee completion
of public improvements in said subdivision; and
WHEREAS, Michael Ricklefs, Land Development Manager for M/I Homes Chicago
Division, developer of the Kettering subdivision, has requested acceptance of public
improvements in Kettering Phase 1 Grading, Phase 2 Grading, Phase 1 Unit 1, Phase 1 Unit 3,
Phase 2 Unit 4 and Phase 2 Unit 5 and provided a Bill of Sale for the public improvements
(attached hereto as Exhibit B); and
WHEREAS, Village Engineer Bruce A. Hill inspected the public improvements and
recommend acceptance of said completed public improvements located upon the dedicated
property; and
WHEREAS, pursuant to the UDO, the two-year subdivision maintenance period
associated with the Letters of Credit shall terminate upon the passage of this resolution.
NOW, THEREFORE BE IT RESOLVED by the Village President and Board of
Trustees of the Village of Lemont, Cook, Will, and DuPage Counties, Illinois, as follows:
SECTION ONE: RECITALS
That the above recitals and legislative findings are found to be true and correct and are
hereby incorporated herein and made a part hereof, as if fully set forth in their entirety.
SECTION TWO:
That the required two-year maintenance period for said Letters of Credit shall hereby
terminate following the passage of this Resolution.
SECTION THREE:
That the public improvements at Kettering and the Bill of Sale are hereby accepted.

• US Bank LOC #SLCLSTL11074 is hereby reduced to $0.
• US Bank LOC #SLCLSTL10690 is hereby reduced to $0.

• US Bank LOC #SLCLSTLI 1191 is hereby reduced to $0.

BILL OF SALE
KNOW ALL MEN BY THESE PRESENTS, that M/I Homes of Chicago, an Illinois
Corporation (hereinafter referred to as the "Developer"), in consideration of TEN DOLLARS
($10.00) and other valuable consideration, does hereby grant, sell, transfer, and deliver unto the
VILLAGE OF LEMONT, an Illinois municipal corporation, the goods, chattels and other items of
personal property in connection with the Kettering SUBDIVISION, namely:
All public improvements located within the Kettering Subdivision located generally South
of 131st Street and East of Parker Road in the Village of Lemont, such public improvements
including but not limited to all sanitary sewer and water lines, all storm sewer lines, all
streets and street improvements, all curbing, all sidewalks, all streetlights, signs, and
parkway trees.
The object of this Bill of Sale is to grant, sell transfer, and deliver to the Village, with the
exceptions noted, the ownership of all items of personality that comprise the sanitary sewer, water
distribution system, storm sewer system, the street system and other public improvements
installed by the Developer to date within the [Name ofJ Subdivision, located in the Village of
Lemont, IL 60439.
FURTHER BE IT KNOWN: That the Developer does hereby covenant that it is the lawful
owner of the heretofore described goods, chattels, and personality; that such items are free from all
encumbrances; that it has the right to sell the same as aforesaid; and that it warrants and will
defend the act of said Corporation.
