SUMMARY/BACKGROUND
Lincolnway Engineering and Land Surveying, on behalf of Castletown Homes, has requested
acceptance of public improvements and a reduction of their letter of credit to $86,484.53.
Pursuant to the Lemont Unified Development Ordinance of 2008 (UDO), the initiation of the
two year subdivision maintenance period shall commence upon the passage of this
resolution. The Village Engineer has inspected the public improvements and approves of this
request.

A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS
AND REDUCING THE LETTER OF CREDIT FOR
SEVEN OAKS SUBDIVISION
WHEREAS, certain real property has been dedicated to the Village, as depicted on
Seven Oaks Subdivision (attached hereto as Exhibit A), for the purpose of public
infrastructure; and
WHEREAS, pursuant to the Lemont Unified Development Ordinance of 2008
("UDO"), an owner or developer of a subdivision is required to deposit certain security or
evidence thereof with the Village of Lemont to guarantee the installation of public
improvements; and
WHEREAS, in the matter of the Seven Oaks subdivision located at 14280 McCarthy
Road in Lemont, Marquette Bank issued an Irrevocable Letter of Credit No. 2017-1630 in
the amount of $994,572.10 and was deposited with the Village of Lemont to guarantee
completion of subdivision improvements; and
WHEREAS, Matthew Dunn, P.E., P.L.S., of Lincolnway Engineering and Land
Surveying, Ltd., on behalf of Castletown Homes, developer of the Seven Oaks Subdivision,
has requested acceptance of public improvements in Seven Oaks Subdivision and provided
a Bill of Sale for the public improvements (attached hereto as Exhibit B); and
WHEREAS, Village Engineer Bruce A. Hill inspected the public improvements and
recommend acceptance of said completed public improvements located upon the dedicated
property; and
WHEREAS, pursuant to the UDO, the initiation of the two-year subdivision
maintenance period shall commence upon the passage of this resolution;
NOW, THEREFORE BE IT RESOLVED by the Village President and Board of
Trustees of the Village of Lemont, Cook, Will, and DuPage Counties, Illinois, as follows:
SECTION 1: RECITALS
That the above recitals and legislative findings are found to be true and correct and
are hereby incorporated herein and made a part hereof, as if fully set forth in their entirety.
SECTION 2:
That the required two-year maintenance period shall hereby commence and shall
expire two years from the date of passage of this Resolution.
SECTION 3:
That the public improvements at Seven Oaks and the Bill of Sale are hereby accepted
and the Irrevocable Letter of Credit No. 2017-1630 is hereby reduced to $86,484.53.

BILL OF SALE
KNOW ALL MEN BY THESE PRESENTS, that DOWNER/BUILDER], an Illinois
Corporation (hereinafter referred to as the "Developer"), in consideration of TEN DOLLARS
($10.00) and other valuable consideration, does hereby grant, sell, transfer, and deliver unto the
VILLAGE OF LEMONT, an Illinois municipal corporation, the goods, chattels and other items of
personal property in connection with the SEVEN OAKS SUBDIVISION, namely:
All public improvements located within the Seven Oaks Subdivision located generally
South of McCarthy Road and West of Derby Road in the Village of Lemont, such public
improvements including but not limited to all sanitary sewer and water lines, all storm
sewer lines, all streets and street improvements, all curbing, all sidewalks, all streetlights,
signs, and parkway trees.
The object of this Bill of Sale is to grant, sell transfer, and deliver to the Village, with the
exceptions noted, the ownership of all items of personality that comprise the sanitary sewer, water
distribution system, storm sewer system, the street system and other public improvements
installed by the Developer to date within the Seven Oaks Subdivision, located in the Village of
Lemont, IL 60439.
FURTHER BE IT KNOWN: That the Developer does hereby covenant that it is the lawful
owner of the heretofore described goods, chattels, and personality; that such items are free from all
encumbrances; that it has the right to sell the same as aforesaid; and that it warrants and will
defend the act of said Corporation.
