RESOLUTION APPROVING THE LETTER OF AGREEMENT FOR THE
COOK COUNTY HIGHWAY DEPARTMENT FOR THE
127th STREET AND TIMBERLINE DRIVE TRAFFIC SIGNAL IMPROVEMENTS
WHEREAS, the Village of Lemont requires the Letter of Agreement be executed, related to the 127th
Street and Timberline Drive Traffic Signal Improvements project;
WHEREAS, the Village of Lemont desires to enter into an Agreement with the Cook County Highway
Department for this work;
WHEREAS, the Village has secured Federal ARU funding through the Southwest Conference of Mayors
for the improvements at this intersection for the entire project cost.
WHEREAS, the Village Board has authorized the Village President to sign the Letter of Agreement with
the Cook County Highway Department.
NOW, THEREFORE, BE IT RESOLVED, by the President and Board of Trustees that the Letter of
Agreement attached hereto as Exhibit A is hereby approved.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT,
COUNTIES OF COOK, WILL AND DuPAGE, ILLINOIS, on this 28th day of September, 2009.

Village of Lemont
This Letter of Agreement, in duplicate, has been prepared to establish project and cost
responsibilities of the Village of Lemont (hereinafter VILLAGE) and the County of Cook
(hereinafter COUNTY) for the installation of a new traffic signal at the intersection of 127th Street
(County Highway B50) at Timberline Drive. The VILLAGE has secured Federal ARU funding
through the Southwest Conference of Mayors for improvements at this intersection.
It is the practice of the COUNTY, that at intersections of County Highways and municipal
streets, the COUNTY will be responsible for the physical maintenance and timing /phasing of the
traffic signals and the municipal corporation is to bear a share of the signal's maintenance and
energy costs. This share is represented by the relative number of approaches to the intersection
for which the municipal corporation is responsible with respect to the total number of
approaches; in this case, two legs of four legs or fifty (50%) percent.
The VILLAGE and COUNTY agree to the following.
1.
The VILLAGE shall:
a) Prepare design plans, obtain the necessary approvals, including from COUNTY for
improvements along 127th Street, construct the improvements and provide
construction engineering;
b) Pay for or secure funding for one hundred (100 %) percent of the traffic signal
installation costs along 127th Street;
c) Pay for one hundred (100 %) percent of costs for a new emergency vehicle pre-
emptive device (EVPD) at 127th Street;

d) Own and operate the EVPD installed on the traffic signals at the intersection of 127th
Street at Timberline Drive;
e) Have the new traffic signals installed by an Electrical Contractor approved by the
COUNTY;
f) Furnish to the COUNTY one (1) copy of all approved catalog cuts prior to installation.
All traffic signal equipment shall be of the type and brand that is acceptable to the
COUNTY;
g)
Furnish to the COUNTY one (1) set of as -built reproducible mylars at the Final
Inspection;
h) Have the COUNTY participate in the Final Inspection of the completed improvements
at 127th Street. The COUNTY contacts are Ms. Holly Cichy, Bureau Chief of
Construction, at 312 - 603 -1613, and Mr. Richard Jezierny, Mechanical and Electrical
Division Head, at 312 - 603 -1730;
i) Pay to the COUNTY fifty (50 %) percent of the maintenance charges for the traffic
signal within thirty (30) days of County's quarterly (3 month) statement of same.
Payments to the COUNTY shall be by check payable to the Treasurer of Cook
County, for deposit into the COUNTY's Motor Fuel Tax Account 600 -600 and sent to
the COUNTY's Superintendent of Highways;
j)
Assume fifty (50 %) percent of the electrical energy charges payable directly to
ComEd in accordance with an electrical service contract to be entered into with that
Company;
k) Acknowledge, by execution of this Agreement, that it shall not have access to or on
COUNTY's traffic signal. The COUNTY will monitor the operational status of the
EVPD at no charge to the VILLAGE and will inform the VILLAGE should it detect
fault with said operations. As such, the VILLAGE agrees to: either enter into a
separate agreement with COUNTY's Electrical Maintenance Contractor to pay for
repairs to VILLAGE's EVPD; or pick up, repair, and return repaired EVPD equipment
to COUNTY's Electrical Maintenance Contractor for reinstallation as it occurs and
pay directly to COUNTY's Electrical Maintenance Contractor for removal and
reinstallation of VILLAGE's EVPD equipment on or in COUNTY's traffic signal; and,
1) coordinate and control public notification of the project scope, timing and duration.
2. The COUNTY shall:
a) Review and approve plans for improvements along 127th Street at Timberline Drive;
b) Participate in the Final Inspection of the completed improvements;

c) Upon completion and acceptance of the Traffic Signal System by representatives of
the COUNTY, cause it to be maintained and energized and be responsible for all
settings and timings at this intersection; and,
d) Bill the VILLAGE quarterly for its share of signal maintenance costs.
The parties hereto agree that the traffic signal provisions of this Agreement shall remain in effect
so long as the traffic signals covered by the terms of this Agreement or any Amendment hereto
are owned, operated and/or maintained by the COUNTY and remain in place either in their
current or some modified configuration.
Should the Village of Lemont be agreeable to the terms of this Agreement, please countersign
two copies of this letter and return them to this Department, Attention: Mr. Rodney
Bettenhausen, Advance Planning and Agreements Division, Room 2340. Enclose a certified
copy of the Village Board minutes authorizing the signatory to commit for the Village.
We will then present the Agreement to the Board of County Commissioners with a Resolution to
be attached and made part thereof, which will authorize and bind the Village of Lemont and
Cook County, their respective representatives, successors and assigns, to their respective
obligations herein.
