(Birch Path) APPROVED BY THE PRESIDENT AND THE BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT THIS 11TH DAY OF MAY,2015 PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT,COUNTIES OF COOK,WILL AND DUPAGE,ILLINOIS,THIS 11TH DAY OF MAY,2015 VILLAGE OF LEM 1 NT RESOLUTION NO. -•„19" A RESOLUTION REPEALING R-74-14 AND APPROVING A FINAL PLAT OF SUBDIVISION FOR A PROPERTY LOCATED SOUTH OF 127th STREET AND WEST OF INTERSTATE 355 IN LEMONT,IL. (Birch Path) WHEREAS, Lemont 19, LLC herein ( after referred to as"Petitioner") is the owner of the approximately 6.5 acre subject property located south of 127th St, west of Interstate 355 (PIN#22-31-200-007)which is legally described and depicted in the Final Plat of Subdivision titled"Birch Path Planned Unit Development"attached hereto and incorporated herein as Exhibit A; and WHEREAS,the Petitioner applied for preliminary plan/plat approval, special use of a planned unit development and zoning map amendment to Lemont R-4 Single-family Residential District for a planned unit development consisting of a 19 unit single-family detached residential subdivision; and WHEREAS, said application was reviewed in accordance with the Lemont Unified Development Ordinance of 2008 and approved by the Village Board of Trustees on June 9, 2014; and WHEREAS,the Petitioner submitted the final plat of subdivision for approval for a 19 unit single-family detached residential subdivision in accordance with the requirements of the Lemont Unified Development Ordinance; and WHEREAS, said application was reviewed in accordance with the Lemont Unified Development Ordinance of 2008 and approved by the Village Board of Trustees on December 8, 2014 by Resolution R-74-14 ; and WHEREAS,the Petitioner submitted the final plat of subdivision for approval for a 17 unit single-family detached residential subdivision in accordance with the requirements of the Lemont Unified Development Ordinance; and WHEREAS, the plat of subdivision is in substantial conformance with the physical development policies and standards of the Village of Lemont and the preliminary plan/plat approved on June 9, 2014; and WHEREAS, the President and Board of Trustees have determined that the proposed plat of subdivision is in the best interest of the Village of Lemont. NOW,THEREFORE BE IT RESOLVED THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT,COUNTIES OF COOK,DUPAGE, AND WILL,ILLINOIS: SECTION 1: Incorporation of Recitals. The foregoing findings and recitals are hereby adopted as Section 1 of this Resolution and are incorporated by reference as if set forth verbatim herein. SECTION 2: Repeal of R-74-14. Resolution R-74-14 is hereby repealed in its entirety. SECTION 3: Plat Approval. The Birch Path Planned Unit Development Plat of Subdivision, which is attached hereto and made part hereof as Exhibit B, is hereby approved, which shall supersede the approval provided for in R-74-14.
