R-53-11 Res. Support S.B. 83and RESOLUTION P – J — I RESOLUTION IN SUPPORT OF SENATE BILL 83 WHEREAS, on June 28, 2011, Senate Bill 83 was sent to the Governor for his signature; WHEREAS, among other provisions, Senate Bill 83 amends certain language in 65 ILCS 5/11 -124 -5 to read as follows: (b) Where a water system that is owned by a public utility (as defined in the Public 16 Utilities Act) provides water to customers located in 2 or more municipalities, the system may be acquired by a majority of the municipalities by eminent domain. If the system is to be acquired by more than one municipality, then there must be an intergovernmental agreement in existence between the acquiring municipalities providing for the acquisition; and WHEREAS, the Mayor and Board of Trustees of the Village of Lemont believe, and hereby declare, that the enactment of Senate Bill 83 into law is in the best interests of the Village and its residents; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COOK, WILL AND DU PAGE COUNTIES, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove shall be and are hereby incorporated as findings of fact as if said recitals were fully set forth within this Section One. SECTION TWO: The Mayor and the Board of Trustees urge the Governor to promptly sign Senate Bill 83 so that this legislation shall become the law in the State of Illinois. SECTION THREE: The Village Clerk is hereby directed to forward a copy of this resolution to the Office of the Governor of the State of Illinois and to all of the sponsors of Senate Bill 83. SECTION FOUR: All resolutions in conflict shall be and the same are hereby repealed to the extent of any such conflict. SECTION FIVE: This resolution shall be in full force and effect from and after its passage and approval in the manner provided by law.
