R-60-03 Authorizing The Waiver Of Water Connection Requirements In The Lemont Plumbing CodeRESOLUTION NO. /9 k,(-) RESOLUTION AUTHORIZING THE WAIVER OF WATER CONNECTION REQUIREMENTS IN THE LEMONT PLUMBING CODE WHEREAS, the Village of Lemont felt it necessary to extend water service along Country Lane & Country Court during reconstruction of said street, and, WHEREAS, the residents along Country Lane & Country Court, were assured installation of the water main was for public service, and, WHEREAS, the Village of Lemont does not wish to force the residents of Country Lane & Country Court, to connect to the Village water system, and, WHEREAS, the Village of Lemont does not wish to cause an undue burden to be placed upon the residents of Country Lane & Country Court, and, WHEREAS, Village of Lemont Ordinance 0 -39 -01 amended the Illinois Plumbing Code requiring connection to the Village water system within one year of it being made available, and, WHEREAS, Village of Lemont Ordinance 0 -39 -01 also amended the Illinois Plumbing Code requiring elimination of private wells when connection is made to the Village water system. WHEREAS, Village of Lemont Ordinance 0 -39 -01 also established fees for connection to the Village water system. NOW, THEREFORE BE IT RESOLVED that upon Board consideration of the above stated reasons, that Section 890.170(e) of the Lemont Building Code requiring connection to the Village water system, elimination of private wells and assessment of connection water fees is hereby waived for the residential structures located on Country Lane & Country Court (addresses 1150 Country Lane thru 1178 Country Lane inclusive, and 2 Country Court thru 12 Country Court inclusive), based on the following conditions: 1. That the private well piping must maintain a physical air- gap /separation from the Village water system, and, 2. That continued operation/existence of the private well does not violate any EPA restrictions or provisions of the Illinois Plumbing Code, and, 3. That the property is inspected annually by the Village to insure that the proper air - gap /separation is maintained, and, 4. That upon failure of the well, it will be sealed and capped in accordance with code. Failure of the well being defined as requiring redrilling or replacement of the casing, and, 5. That water connection tap -on fees shall be waived.
