RESOLUTION AUTHORIZING ADOPTION OF SUPPLEMENT NO. 2 TO
AN ENGINEERING AGREEMENT WITH BEAM, LONGEST AND NEFF FOR
PHASE II DESIGN ENGINEERING ON
MAIN STREET (ILLINOIS TO STATE STREET OVERPASS)
WHEREAS, the Village of Lemont has committed resources to perform a Phase II
design study for a section of Main Street; and
WHEREAS, the Village of Lemont has selected BEAM, LONGEST AND NEFF to
perform design engineering on this project; and
WHEREAS, the Village has received FAU funding on the construction of this
project; and
WHEREAS, the Village has expanded the scope of services on this project requiring
additional engineering services.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
that the attached Supplement No. 2 to the Engineering Agreement be approved.

SUPPLEMENT NO. 2
TO THE
AGREEMENT FOR CONSULTANT'S SERVICES
WHEREAS, The VILLAGE OF LEMONT, the VILLAGE, has entered into an AGREEMENT with
BEAM, LONGEST AND NEFF, INC., the CONSULTANT, dated January 23, 1995 and authorized
by the Illinois Department of Transportation, the DEPARTMENT, on June 2, 1995; and Supplement
No. 1 executed on November 27, 1995 and authorized by IDOT on April 17, 1996 to perform Phase II
design engineering services for reconstruction of Main Street in the Village of Lemont, the PROJECT,
and,
WHEREAS, the VILLAGE and the DEPARTMENT desire that the CONSULTANT modify
the plan drawings to eliminate three bored and jacked utility installations due to costly bid prices
received in the first advertisement; and to have plans readied for the April 19, 1996 bulletin; and;
WHEREAS, the VILLAGE and the DEPARTMENT desire that the CONSULTANT expand
the lighting design and analysis to include both sides of the railroad crossing at the intersections of
Lemont Street, Stephen Street and Holmes Street and to prepare plan drawings for adding lighting
along Lemont Street, Stephen Street and Holmes Street, in conjunction with the PROJECT; and
WHEREAS, the VILLAGE and the DEPARTMENT desire that the CONSULTANT
redesign the gravity wall at the southeast corner of Main Street/Stephen Street to provide for a
monolithic traffic signal foundation due to new information becoming available regarding the suitability
of the existing signal foundation not previously known; and
WHEREAS, the above items require that the CONSULTANT perform Phase II design
engineering for preparing additional plans, specifications and addendum's, whereby said work
constitutes extra work and includes:
• Redesign and evaluation of the sanitary and watermain crossing under the IC Railroad.
• Field reconnaissance, inspection and survey of existing lighting and roadway geometrics
along three routes.
• Development of plans, specifications, change order documents and estimates for lighting
on three routes.
• Coordination with I.C. Railroad
• Design engineering and plan changes for including a monolithic traffic signal foundation
with the gravity wall at the southeast corner of Main St. /Stephen St.

WHEREAS, said Extra Work requires an increase in the upper limit of compensation to the
CONSULTANT, for work which was not identified in the AGREEMENT and could not have been
reasonably anticipated; and,
WHEREAS, the circumstances which necessitate this Supplement were not within the
contemplation of the agreement as signed; and,
NOW, THEREFORE, BE IT RESOLVED THAT the parties hereto do mutually agree as
follows:
A. Scope of Work
The CONSULTANT shall provide the following Extra Work:
• Perform additional data collection, field survey and inspections of the existing lighting and
roadway conditions along Lemont Street from Illinois Street to Canal Street, along
Stephen Street from Illinois Street to Talcott Avenue and along Holmes Street from Illinois
Street to Talcott Avenue, a total distance of approximately 425 meters.
• Develop photometric calculations for the railroad crossings per I.E.S. RP -8 Manual.
• Prepare detail plans, specifications and cost estimates for lighting on three cross streets,
including wiring plan, foundation locations and controller details..
• Hold meeting with Illinois- Central Railroad and prepare permit applications for the
proposed conduit crossings.
• Prepare plan drawing changes for the monolithic traffic signal foundation on the gravity
wall plans and submit to IDOT- Springfield for review and approval.
• Change traffic signal plans for the new signal foundation.
• Develop photometric calculations, prepare Luminaire Performance Tables and evaluate
additional luminaire manufacturers for the Main Street lighting.
• Evaluate and identify options for eliminating the boring and jacking procedures shown in
the plans at three locations due to costly bid prices.
• Modify and make plan changes to six drawings, including the summary of quantities, the
Engineer's estimate of costs and contract specifications to eliminate the boring and jacking
construction procedure and make ready for the April 19, 1996 Service Bulletin.

B. Prime Compensation
In accordance with Sections 4.2 and 4.3 of the AGREEMENT, the Prime Compensation shall be
increased as follows:
Subject to an Upper Limit of Compensation of $43,708, the CONSULTANT shall receive as full
payment for completing the work required under this SUPPLEMENT NO. 2, reimbursement of his
eligible actual costs in accordance with Section 2.45 of the STANDARD PROVISIONS, plus a Net
Fee of $5,340. The upper limit of compensation and net fee are a result of Exhibits A, B, C, D and
Exhibit E, the Cost Estimate of Consultant Services, all attached herein. With the addition of this
SUPPLEMENT NO. 2 to the AGREEMENT, the Prime Compensation for the Phase II Engineering
increases from $118,349 to an Upper Limit of Compensation of $162,057.
IN WITNESS WHEREOF, the parties have executed this Supplement pages numbered 1
through 12 as of this day of Mav, 1996 for the uses and purposes set forth herein.

STATE OF ILLINOIS
DRUG FREE WORKPLACE CERTIFICATION
This certification is required by the Drug Free Workplace Act (Ill. Rev. Stat., ch.
127, par. 152.311). The Drug Free Workplace Act, effective January 1, 1992, requires
that no grantee or contractor shall receive a grant or be considered for the purposes of
being awarded a contract for the procurement of any property or services from the State
unless that grantee or contractor has certified to the State that the grantee or contractor
will provide a drug free workplace. False certification or violation of the certification
may result in sanctions including, but not limited to, suspension of contract or grant
payments, termination of the contract or grant and debarment of contracting or grant
opportunities with the State for at least one (1) year, but not to be more than five (5)
years.
For the purpose of this certification, "grantee" or "contractor" means a corporation,
partnership, or other entity with twenty -five (25) or more employees at the time of
issuing the grant, or a department, division, or other entity with twenty -five (25) or
more employees at the time of issuing the responsible for the specific performance under
a contract or grant of $5,000 or more from the State.
The contractor /grantee certifies and agrees that it will provide a drug free workplace
by:
A. Publishing a statement:
1. notifying employees that the unlawful manufacture, distribution, dispensing,
possession or use of a controlled substance, including cannabis, is prohibited
in the grantee's or contractor's workplace;
2. specifying the actions that will be taken against employees for violations of
such prohibition;
3. notifying the employee that, as a condition of employment on such contract or
grant, the employee will:
a. abide by the terms of the statement; and
b. notify the employer of any criminal drug statute conviction for a violation
occurring in the workplace no later than five (5) days after such
conviction;
B. Establishing a drug free awareness program to inform employees about:
1. the dangers of drug abuse in the workplace;
2. the grantee's or contractor's policy of maintaining a drug free workplace;

3. any available drug counseling, rehabilitation, and employee assistance
programs; and
4. the penalties that may be imposed upon an employee for drug violations.
C. Providing a copy of the statement required by sub - paragraph (a) to each employee
engaged in the performance of the contract or grant and to post the statement in
a prominent place in the workplace.
D. Notifying the contracting or granting agency within ten (10) days after receiving
notice under part (b) of paragraph (3) of subsection (a) above from an employee
or otherwise receiving actual notice of such conviction.
E. Imposing a sanction on, or requiring the satisfactory participation in a drug abuse
assistance or rehabilitation program by, an employee who is so convicted, as
required by section 5 of the Drug Free Workplace Act.
F. Assisting employees in selecting a course of action in the event drug counseling,
treatment, and rehabilitation is required and indicating that a trained referral team
is in place.
G. Making a good faith effort to continue to maintain a drug free workplace through
implementation of the Drug Free Workplace Act.
