R-459-96 10/14/96VILLAGE OF LEMONT RESOLUTION NO. 4715Y DATE OF APPROVAL l —/f/l6 RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE WEST SUBURBAN NEIGHBORHOOD PRESERVATION AGENCY FOR THE ADMINISTRATION OF A SINGLE - FAMILY RESIDENTIAL REHABILITATION PROGRAM WHEREAS, Cook County has been designated as an "Urban County" by the Department of Housing and Urban Development under the provisions of the Housing and Community Development Acts of 1974, as amended (hereinafter referred to as the "Acts ") and receives and allocates an entitlement of funds for the Rehabilitation of Single- Family Residences pursuant to said Acts; and WHEREAS, the Village of Lemont as a recipient of said funds, has administered a single - family rehabilitation program; and WHEREAS, The President and Board of Trustees of the Village of Lemont have elected to participate in an agreement with the West Suburban Neighborhood Preservation Agency to execute the Village program for single - family rehabilitation. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont that the President and the Clerk be and are hereby directed and authorized to execute the agreement with West Suburban Neighborhood Preservation Agency to administer the Single - Family Rehabilitation Block Grant Program for the Village of Lemont. SMOLLEN, Village Clerk October 4, 1996 Ms. Dana Jenkins Community Development Village of Lemont 418 Main Street Lemont, Illinois 60439 -3788 Dear Ms. Jenkins, As requested in your letter of July 10, 1996, following is a proposal for services which will also serve as a letter of agreement to administer rehabilitation actions for single family homes in the Village of Lemont based on the Administration Procedures Handbook for Residential Rehabilitation by the Cook County Department of Planning dated May 1, 1996. The Village of Lemont will perform and provide the W.S.N.P.A. Consultant the following information. 1. Provide the file of the Applicant. 2. Update the necessary qualifications of the household. 3. The Building Department will provide personnel to inspect properties with the W. S.N.P.A. Consultant. The following is the scope of services provided for each residential unit to be performed by and payments to the W. S.N.P.A. Consultant. A. Scope of Services 1. Visit the site to determine the scope of work to be done. 2. Prepare specifications and submit them to the Construction Management Division of Cook County Department of Planning and Development for Approval. Ms. Dana Jenkins Page Two October 4, 1996 3. Bid the approved specifications on behalf of the owner. 4. Inform the owner of the bidder with the lowest responsible bid, and assist in the Award of Contract. 5. Order the Title Commitment, prepare loan documents, including but not limited to, the Participation Agreement, Note, Mortgage and Construction Contract when the W.S.N.P.A. Consultant request it. 6. Make periodic visits to assure the work is proceeding in an appropriate fashion. Each visit will be documented with a written description of actions, activities and status of the work. 7 Prepare the necessary 29A's to draw funds from the County to be deposited into the Village of Lemont CDBG Rehabilitation Account. 8. Prepare request for each pay -out for the Village for payment to the Contractor. 9. Prepare the necessary paperwork to close out the project, obtain a loan modification agreement signatures. 10. Prepare required documentation to the Village for payment to the W.S.N.P.A. Consultant from time to time based on the following: a. The maximum payment per unit shall be Three Thousand, Seven Hundred and Fifty Dollars ($3,750.00). The method of payment will be as follows: 1. Upon completion of the initial phase including inspection, specification writing and bidding, fifty percent (50 %) will be due. Ma. Dana Jenkins Page Three October 4, 1996 2. Inspection of progress of work to be done, not to exceed three visits, twenty -five percent (25 %) will be due. If the project requires more than three visits the cost of $50.00 per visit will be assessed, and all visits will be documented by written statements. 3. Upon completion of the project twenty -five percent (25 %) will be due. 11. All per - construction costs, such as, but not limited to, Credit Reports, Title Commitments, and Appraisals if necessary, will be the responsibility of the Village of Lemont using CDBG Administrative Costs. Term of this Agreement: or Termination of this Agreement This Agreement shall be on an ongoing, "as needed ", basis but shall continue only so long as the Village of Lemont needs the services of the W.S.N.P.A. Consultant as set out above. The Village of Lemont may terminate this Agreement upon five (5) days written notice if it determines that it no longer needs or desires the services of the W.S.N.P.A.
