A RESOLUTION ACCEPTING
DETENTION BASINS AND OTHER PUBLIC IMPROVEMENTS WITHIN
BRIARCLIFFE ESTATES SUBDIVISION IN LEMONT, IL
WHEREAS, pursuant to the subdivision regulations contained within the Lemont
Unified Development Ordinance, an owner or developer of a subdivision is required to install
certain public improvements; and
WHEREAS, R- 21 -07, approved February 12, 2007, accepted the public improvements
of Briarcliffe Estates Subdivision with the exception of the detention basins; and
WHEREAS, the required two -year maintenance period for the accepted public
improvements has expired; and
WHEREAS, Rick Raspante, on behalf of McNaughton Development, Inc., the owner
and developer of said subdivision, has requested final acceptance of the detention basins and
other public improvements in Briarcliffe Estates Subdivision and the termination of the
maintenance period Letter of Credit; and
WHEREAS, authorized engineer of the Village of Lemont, James Cainkar, inspected the
public improvements and recommends final acceptance of the detention basins and other public
improvements in the subdivision;
NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of
the Village of Lemont, that the remaining public improvements (detention basins) and other
public improvements in the Briarcliffe Estates Subdivision are accepted as final.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL, AND DuPAGE, ILLINOIS, on this
11th day of January, 2010.

KNOW ALL MEN BY THESE PRESENTS, that McNAUGHTON DEVELOPMENT, INC., an Illinois
Corporation (hereinafter referred to as the "Developer"), in consideration of TEN DOLLARS ($10.00) and
other valuable consideration, does hereby grant, sell, transfer and deliver unto the VILLAGE OF LEMONT,
an Illinois municipal corporation, the goods, chattels and other items of personal property in connection
with the BRIARCLIFFE ESTATES SUBDIVISION, namely:
All public improvements located within the Briarcliffe Estates development located in the
general vicinity of the north east corner of 127th St and Smith Road, in the Village of Lemont,
such public improvements including but not limited to all sanitary sewer and water lines, all
storm sewer lines, all street and street improvements, all curbing, all sidewalks, all lights, signs,
trees and detention basins.
The object of this Bill of Sale is to grant, sell transfer, and deliver to the Village, with the exceptions
noted, the ownership of all items of personality that comprise the sanitary sewer, water distribution
system, storm sewer system, the street system and other public improvements installed by the
Developer to date within the Briarcliffe Estates development located in the general vicinity of the north
east corner of 127th St and Smith Road, in the Village of Lemont, IL 60439.
FURTHER BE IT KNOWN: That the Developer does hereby covenant that it is the lawful owner of
the heretofore described goods, chattels, and personality; that such items are free from all
encumbrances; that it has the right to sell the same as aforesaid; and that it warrants and will defend
the act of said Corporation.
