R-33-98 05/11/1998RESOLUTION K-33-61 RESOLUTION AUTHORIZING ADOPTION OF SUPPLEMENT NO. 1 TO AN ENGINEERING AGREEMENT WITH TRANSYSTEMS CORPORATION FOR PHASE II DESIGN ENGINEERING ON STATE STREET (PEIFFER AVENUE TO ILLINOIS STREET) WHEREAS, the Village of Lemont has committed resources to perform Phase II design engineering services for a section of State Street; and WHEREAS, the Village of Lemont has selected TranSystems Corporation to perform design engineering on this project; and WHEREAS, the Village has received FAU funding on the construction of this project; and WHEREAS, the Village has expanded the scope of services on this project requiring additional engineering services. NOW, THEREFORE, BE IT RESOLVED, by the President and Board of Trustees that the attached Supplement No. 1 to the Engineering Agreement be approved. AMENDMENT NO. 1 FOR CONSULTANT SERVICES FOR THE STATE STREET IMPROVEMENT This AMENDMENT No. 1 to the original AGREEMENT is made this day of , 1998 by and between the Village of Lemont, hereinafter referred to as the VILLAGE, and TranSystems Corporation, 1051 Perimeter Drive, Suite 1025, Schaumburg, Illinois, 60173, as the CONSULTANT, for professional engineering services required by the VILLAGE for the preparation of contract plans and documents in connection with construction of State Street from Peiffer Avenue to Illinois Street, a distance of 1040 meters, hereinafter referred to as the PROJECT. The original agreement enacted June 9, 1997 and authorized September 8, 1997 remains in place except for the items discussed in this AMENDMENT. The circumstances which necessitate this amendment were not reasonably foreseeable at the time the agreement was signed. This AMENDMENT is to include the modifications to the contract plans and documents not previously anticipated. The limit of compensation will be increased by $22,632 to not exceed the amount of $96,476. The fixed fee shall be increased by $2,374 to $11,175. The maximum retainage shall be increased to $2,888. Rev. Stat., ch. 127, par. 152.311). The Drug Free Workplace Act, effective January 1, 1992, requires that no grantee or contractor shall receive a grant or be considered for the purposes of being awarded a contract for the procurement of any property or services from the State unless that grantee or contractor has certified to the State that the grantee or contractor will provide a drug free workplace. False certification or violation of the certification may result in sanctions including, but not limited to, suspension of contract or grant payments, termination of the contract or grant and debarment of contracting or grant opportunities with the State for at least one (1) year but not more than five (5) years. (2) Specifying the actions that will be taken against employees for violations of such prohibition. (3) Notifying the employee that, as a condition of employment on such contract or grant, the employee will: (A) abide by the terms of the statement; and (B) notify the employer of any criminal drug statute conviction for a violation occurring in the workplace no later than five (5) days after such conviction. (b) Establishing a drug free awareness program to inform employees about: (1) the dangers of drug abuse in the workplace; (2) the grantee's or contractor's policy of maintaining a drug free workplace; (3) any available drug counseling, rehabilitation, and employee assistance programs; and (4) the penalties that may be imposed upon an employee for drug violations. (c) Providing a copy of the statement required by subparagraph (a) to each employee engaged in the performance of the contract or grant and to post the statement in a prominent place in the workplace. (d) Notifying the contracting or granting agency within (10) days after receiving notice under part (B) of paragraph (3) of subsection (a) above from an employee or otherwise receiving actual notice of such conviction. (e) Imposing a sanction on, or requiring the satisfactory participation in a drug abuse assistance or rehabilitation program by, any employee who is so convicted, as required by section 5 of the Drug Free Workplace Act. (f) Assisting employees in selecting a course of action in the event drug counseling, treatment, and rehabilitation is required and indicating that a trained referral team is in place. (g) Making a good faith effort to continue to maintain a drug free workplace through implementation of the Drug Free Workplace Act. Project Description and Scope of Work Proposed improvements along the alignment are to include construction of approximately 137 meters (450 lineal feet) storm sewer in the traffic lane along Cass Avenue. This work is tied to the proposed State Street storm sewer for which SHA conducted geotechnical explorations in June 1996 and February 1997. The sewer is estimated to be constructed at a depth of 4.0 to 4.6 meters (13 to 15 feet) below the existing pavement. Method of Performance - Fie!d Work Borings will be conducted in the roadway along the proposed sewer alignment at two (2) locations as directed. The borings will be advanced through the pavement to a nominal depth of 0.46m( 1.5 ft) feet below the proposed invert elevation of the storm sewer. Split spoon samples will be obtained at 2.5 foot intervals to the extent of the boring. Where spoon refusal is encountered, we will setup and core to a nominal depth below the proposed invert elevation to verify the presence and condition of bedrock. Prior to commencement of the work we would request that the proposed storm sewer mainline invert depths (from the existing ground surface) and manhole structure locations be provided for review so that boring locations and depths be determined. CONSULTING ENGINEERS Method of Performance - Analysis and Report The boring and field test data will be summarized on boring logs. Information will include the depth from ground surface to sample refusal, Standard Penetration, N values for split spoon samples and Rock Quality Designation, RQD for core samples. A written report summarizing conditions encountered will be prepared by a Professional Engineer, licensed in the State of Illinois. Timing and Fee We will begin on work after notice to proceed. Based on our discussions we have tentatively scheduled the work for the first week of December. We plan on mobilizing and doing all the borings concurrently. We propose to provide this work at the unit rates quoted on the attached Schedule of Services and Fees, Attachments 1.1 and 1.2. These estimated quantities and unit rates are based on information as outlined in this proposal and experience on past projects. On the basis of the above information, we estimate that these services can be provided for a fee of: $ 2,700.00 General For this project, we will assign Mr. Stephen C. Schleede, P.E. as Principal in Charge and Mr. William D. Prigge, P.E. as Project Manager. They and our staff are acquainted with the local subsurface conditions and have participated in the planning, development and execution of numerous highway soil explorations in this area.
