AGREEMENT WITH BEAM, LONGEST & NEFF, INC. FOR PHASE III
ENGINEERING RELATED TO MAIN STREET IMPROVEMENT
WHEREAS, the Illinois Department of Transportation and Village of Lemont have
committed resources to reconstruction of Main Street from Lemont Road overpass
to Illinois Street; and
WHEREAS, the Illinois Department of Transportation and Federal Highway
Authority have committed to fund 85% of this project, with the Village funding the
remaining 15 %; and
WHEREAS, the Illinois Department of Transportation has reviewed and approved
the supplement in the amount of $19,939.62.
NOW, THEREFORE, BE IT RESOLVED, by the President and Board of Trustees
that the attached Local Agency Agreement be approved.

SUPPLEMENT NO. 2
TO THE
CONSTRUCTION ENGINEERING SERVICES AGREEMENT
WHEREAS, The VILLAGE OF LEMONT, hereinafter known as the "VILLAGE ", has entered
into an AGREEMENT with BEAM, LONGEST AND NEFF, INC., hereinafter known as the
"CONSULTANT ", dated March 11, 1996, and authorized by the Illinois Department of
Transportation, hereinafter known as the "DEPARTMENT ", on April 2, 1996, and Supplement
No. 1, dated October 13, 1997, to perform Phase III construction engineering services for
reconstruction of Main Street in the Village of Lemont, the PROJECT, and,
WHEREAS, the VILLAGE, and the DEPARTMENT desire that the CONSULTANT
provide additional construction inspection, documentation and change orders for extra work
along Main Street and engineering services beyond the thirteen calendar months that the original
agreement was based on, in conjunction with the PROJECT; and
WHEREAS, the above items require that the CONSULTANT perform Phase III
construction engineering services, whereby said work constitutes a change in the scope of work
and requires extra work which includes:
• Time and Material daily monitoring of the contractor's work on the proposed
permanent traffic signal installation at Main Street/Stephen Street.
• Process Authorizations and Extra Work invoices for the above referenced work.
• Provide construction inspection services for ongoing work while waiting for
approvals of changes to the permanent signal installation and changes resulting in
material delivery delays, plus delays while waiting for approvals on the railroad
interconnection with the Illinois Commerce Commission.
• Documentation of the contractor's daily progress.
• Provide final Contract Records.

WHEREAS, said Extra Work requires an increase in the upper limit of compensation to the
CONSULTANT, for work which was not identified in the AGREEMENT and could not have
been reasonably anticipated; and,
WHEREAS, the circumstances which necessitate this Supplement were not within the
contemplation of the agreement as signed; and,
NOW, THEREFORE, BE IT RESOLVED THAT the parties hereto do mutually agree as
follows:
A. Scope of Work
The CONSULTANT shall provide the following Extra Work:
• Implement redesigned traffic signal installation as directed by the Bureau of Traffic.
• Inspection of contract signal work at Main Street/Stephen Street, and preparation of
Contract Change Orders for quantity adjustments.
• Inspect traffic signal equipment for material in storage allowance requests by the
contractor.
• Inspect on -going punchlist work on Main Street.
• Material inspection of added contract work.
• Prepare final as -built drawings for new signals at Main Street/Stephen Street.
• Review force account billing and inspect added signal equipment at Main
Street/Stephen Street intersection.
• Evaluate and process authorization for signal changes.
• Construction documentation of contractor's daily progress.
• Finalization of all contract documents.
• Provide inspection for miscellaneous construction activities while waiting for IDOT's
resolution for installation of the permanent signal installation which directly delayed
progress on the controlling item of work.

B. Prime Compensation
In accordance with Sections 4.2 and 4.3 of the AGREEMENT, the Prime Compensation shall be
increased as follows:
Subject to an Upper Limit of Compensation of $19,939.62, the CONSULTANT shall receive as
full payment for completing the work required under this SUPPLEMENT NO. 2, reimbursement
of his eligible actual costs in accordance with Section 2.45 of the STAM•'DARD PROVISIONS,
plus a Net Fixed Fee of $2,280.48. The upper limit of compensation and net fee are a result of
Exhibits A, B, C D and Exhibit E, the Cost Estimate of Consultant Services, all attached herein.
With the addition of this SUPPLMENT NO. 2 to the AGREEMENT, the Prime Compensation
for the Phase III Engineering increases from $246,854.68 to an Upper Limit of Compensation of
$266,794.30.
IN WITNESS WHEREOF, the parties have executed this Supplement pages numbered 1
through 10 as of this day of August, 1998 for the uses and purposes set forth herein.

DRUG FRET: WORKPLACE CERTIFICATION
This certification is required by the Drug Free Workplace Act (III. Rev. Stat., ch.
127, par. 152.311). The Drug Free Workplace Act, effective January 1, 1992, requires
that no grantee or contractor shall receive a grant or be considered for the purposes of
being awarded a contract for the procurement of any property or services from the State
unless that grantee or contractor has certified to the State that the grantee or contractor
will provide a drug free workplace. False certification or violation of the certification
may result in sanctions including, but not limited to, suspension of contract or grant
payments, Iernunation of the contract or grant and debarment of contracting or grant
opportunities with the State for at least one (I) year, but not to be more than five (5)
years.
For the purpose of this certification, -grantee' or "contractor- means a corporation,
partnership, or other entity with twenty -five (25) or more employees at the time of
issuing the grant, or a department, division, or other entity with twenty -five (25) or more
employees at the lime of issuing the responsible for the specific performance under a
contract or grant of $5,000 or more from the State.
The contractor /grantee certifies and agrees that it will provide a drug free workplace
by:
A.
Publishing a statement:
I. notifying employees that the unlawful manufacture, distribution, dispensing,
possession or use of a controlled substance, including cannabis, is prohibited in
the grantee's or contractor's workplace;
2. specifying the actions that will be taken against employees for violations of
such prohibition;
3. notifying the employee that, as a condition of employment on such contract or
grant, the employee will:
a. abide by the terms of the statement; and
b. notify the employer of any criminal drug statute conviction fora violation
occurring in the workplace no later than five (5) days after such conviction;
It. Establishing a drug free awareness program to inform employees about:
1. the dangers of drug abuse in the workplace;
2. the grantee's or contractor's policy of maintaining a drug free workplace;

3. any available drug counseling, rehabilitation, and employee assist
programs; and
4. the penalties that may be imposed upon an employee for drug violations.
C. Providing a copy of the statement required by sub - paragraph (a) to each empl

prominent place in the workplace.
D. Notifying the contracting or granting agency within ten (10) days after recei
notice under pad (b) of paragraph (3) of subsection (a) above from an employ
otherwise receiving actual notice of such conviction.
E. Imposing a sanction on, or requiring the satisfactory participation in a drug a
assistance or rehabilitation program by, an employee who is so convicte
required by section 5 of the Drug Free Workplace Act.
F. Assisting employees in selecting a course of action in the event drug counse
treatment, and rehabilitation is required and indicating that a trained referral
is in place.
G. Making a good faith effort to continue to maintain a drug free workplace thr
implementation of the Drug Free Workplace Act.
