R-93-98 Approving an agreement with the Metropolitan water reclamation district of greater Chicago to grant an access easement between the Lemont water reclamation plant and Stephen StreetRESOLUTION a RESOLUTION APPROVING AN AGREEMENT WITH THE METROPOLITAN WATER RECLAMATION DISTRICT OF GREATER CHICAGO TO GRANT AN ACCESS EASEMENT BETWEEN THE LEMONT WATER RECLAMATION PLANT AND STEPHEN STREET WHEREAS, the Village of Lemont and Metropolitan Water Reclamation District of Greater Chicago have agreed to provide for an access easement between the right -of -way of Stephen Street and the Lemont Water Reclamation Plant; and WHEREAS, the formal easement document and legal description will be prepared following the construction of the Lemont Safety Village site; and WHEREAS, the Village of Lemont agrees to enter into a formal easement agreement in accordance with the conditions as stated in the agreement dated October 27, 1998. NOW, THEREFORE BE IT RESOLVED that the attached agreement dated October 27, 1998 is hereby approved PASSED AND APPROVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DU PAGE, ILLINOIS on this 9th day of November , 1998. Santos Patricia Young Harry 'Bus- Yourell Re: Grant of Perpetual Easement over Village of Lemont Property Situated at Stephen and River Streets in Lemont, Illinois, for Ingress and Egress to the Metropolitan Water Reclamation District Lemont Plant — Our File No. 95 H 030 Dear Mayor Kwasneski: At its meeting of May 1, 1997, the Board of Commissioners of the District authorized a 20 -year lease to the Village for the use of approximately 17,100 square feet of District land located on the southwest corner of the District's Lemont Water Reclamation Plant property and consented to a 20 -year license agreement between the Village of Lemont and the Safety Village Commission. The area of the leasehold was subsequently expanded to include 23,100 square feet as depicted on a survey prepared in accordance with a revised site plan provided by the Village. The District granted the lease in consideration of the Village of Lemont's agreement to grant a perpetual easement to the District for a permanent access road across the Village's property to the Lemont Water Reclamation Plant entrance. The easement agreement will not be executed until the legal description for the permanent access road is prepared, which will be done after the proposed improvements to the Safety Village are completed. Therefore, this letter will serve as the Village's agreement to grant the District an access road easement subject to the following: I. The Village will immediately notify the District upon completion of the construction of the improvements proposed for the Safety Village. 2. The Village will allow the District access to its property for the purpose of developing a survey of the proposed roadway, commencing at Stephen Street on the west and extending in a northeast direction to the entrance of the District's Lemont Water Reclamation Plant.
