A RESOLUTION AUTHORIZING AND APPROVING THE TRANSFER OF LIEN
RIGHTS TO KELLY'S CONTRACTORS
WHEREAS, the Village of Lemont has filed an Action in the Circuit Court of Cook County
against FRANK LONIELLO, individually and d/b /a KEYSON CORPORATION, and other
Defendants, captioned as Case No. 95 M5 2330; and
WHEREAS, an Injunction Order has been issued restraining the Defendant from depositing
any debris or construction material and authorizing the Village to remove any and all debris; and
WHEREAS, the Village of Lemont has engaged the services of Kelly's Contractors, Corp.,
with the consent of the Defendants, to remove all stone and debris stockpiled on the subject property;
and
WHEREAS, Kelly's Contractors, Corp. has expended substantial sums of money in
connection with the clean-up and has requested the Village to assign any and all rights it may have
as a lien holder to Kelly's Contractors, Corp. for the purpose of obtaining reimbursement.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the
Village of Lemont, Cook, Will and DuPage Counties, Illinois, that Kelly's Contractors, Corp. an
Intervener in the Cause pending in the Circuit Court of Cook County as above described, is hereby
authorized to subrogate and enforce any lien rights that it may have pursuant to 65 ILCS 5/11 -31 -1
and any other applicable provisions of the Illinois Municipal Code to recover any costs incurred
including attorneys fees.
This Resolution shall be in full force and effect from and after its passage and approval as
provided by law.
PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DU PAGE, ILLINOIS,
