R-(3,98- DATE OF APPROVAL ca— 013 -61 A RESOLUTION OF OBJECTION FOR THE RECORD OF THE COOK COUNTY ZONING BOARD OF APPEALS REGARDING A REQUEST FOR REZONING FROM R -4 to R -6 GENERAL RESIDENCE DISTRICT TO ALLOW A MULTIPLE FAMILY DEVELOPMENT AT 14800 KOTLIN ROAD N LEMONT TOWNSHIP WHEREAS, The Village of Lemont is a zoned municipality with limits near the property which is the subject of a request for a rezoning in the cause known as Docket Number 6636 before the Cook County Zoning Board of Appeals, said property being described as follows: LOT 40 (EXCEPT THE EASTERLY 50 FEET THEREOF MEASURED ALONG THE NORTH LINE OF SAID LOT 40 EXCEPT THE WESTERLY 118 FEET OF SAID LOT 40 MEASURED ALONG THE NORTHERLY LINE OF SAID LOT 40) IN THE COUNTY CLERK'S DIVISION IN THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 21, TOWNSHIP 37 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, (EXCEPT LOTS 1, 11 AND THE SOUTHERLY 50 FEET OF LOT 2 IN SKELLY'S SUBDIVISION IN THE SOUTHWEST CORNER OF THE NORTHEAST QUARTER OF SAID LOT SECTION 21) IN COOK COUNTY, ILLINOIS. COMMONLY KNOWN AS 14800 KOTLIN ROAD; and WHEREAS, the entire boundary of the subject property is within 1 '/ miles of the corporate limits of the Village of Lemont; and WHEREAS. the proposed rezoning would constitute `'spot" zoning as no other property nearby is zoned for multiple family uses, but rather for single family development; and WHEREAS, the new Cook County Comprehensive Plan indicates that this area is designated for single family uses, not multiple family; and WHEREAS, the petitioner has not secured any water or sewer services for the development, and under Section 4.69 -6 of the Cook County Zoning Ordinance, the development must have a sanitary sewer connection and a water distribution system; and WHEREAS, in order to secure water and sewer services, the petitioner would be required to annex the property into the Village of Lemont and be subject to the Lemont Zoning and Subdivision Ordinances; and WHEREAS, the petitioner would be subject to the Village of Lemont Subdivision requirements prior to dividing (assessors division or otherwise) the subject property for a new development lot; and WHEREAS, the petitioner has not proposed substantial improvements to Kotlin Road which is a narrow, substandard street in poor condition which cannot handle additional vehicular traffic without significant improvement; and WHEREAS, the Village will require such improvement as part of the Lemont Subdivision Regulations which are enforceable because the subject property is within 11/2 miles of the Village of Lemont; and WHEREAS, additional right -of -way will need to be dedicated to allow the road widening, which right- of-way has not yet been acquired; and WHEREAS, the neighborhood is predominantly single family in nature; and WHEREAS, the rezoning would substantially alter the character of the neighborhood and may cause harm to the values of property within the vicinity of the proposed rezoning; and WHEREAS. the straight zoning change would allow for any use under the R -6 District, not just townhouses as previously proposed; and WHEREAS, the Village of Lemont Planning and Zoning Commission at a May 20, 1997 pre - application meeting did not convey a favorable recommendation for the project when proposed to the Commission. NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage and Will, State of Illinois, that the Village of Lemont hereby objects to the request for rezoning from R-4 to R -6 General Residence District, which is the subject of Cook County Zoning Board of Appeals Docket Number 6636.
