ORDINANCE NO. 0 "63 77 ORDINANCE AMENDING THE ZONING MAP OF THE VILLAGE OF LEMONT AND APPROVING A PLANNED UNIT DEVELOPMENT KNOWN AS MEYER'S SUBDIVISION WHEREAS, Alan Meyer, hereinafter referred to as "the Petitioner ", is the owner of an 10.3 acre parcel, hereinafter referred to as "the subject property ", located at Archer Avenue & 131st Street, west of the Chestnut Crossing Subdivision, in Lemont, Illinois and legally described in Exhibit WHEREAS, the Petitioner made application under the provisions of the Lemont Zoning Ordinance of 1980 (No.426) for a residential Planned Unit Development to be known as Meyer's Subdivision; and WHEREAS, the Planning & Zoning Commission of the Village of Lemont, Illinois (the "Village ") did heretofore commence and conduct a Public Hearing on June 3, 1997 and a Workshop Meeting July 15, 1997 for approval of a Planned Unit Development known as Meyer's Subdivision; and WHEREAS, a notice of the aforesaid Public Hearing was made in the manner provided by law and was published in the Lemont Reporter Progress, a newspaper of general circulation within the Village; and WHEREAS, the President and Board of Trustees of the Village of Lemont, after a public hearing as required by law, approved a Planned Unit Development;and WHEREAS, the President and Board of Trustees of the Village have determined that the best interests of the Village will be served by the adoption a Planned Unit Development ordinance as described herein; and WHEREAS, the President and Board of Trustees of the Village approve the development of the subject property as a Planned Unit Development pursuant to I11.Rev.Stat.Ch.24, 11- 13 -1.1. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, DuPAGE, AND WILL, ILLINOIS: 2 SECTION 1: Planned Unit Development Approval. That a Planned Unit Development be and is hereby approved and granted to allow the Owner or successors or assigns, (collectively referred to as the "Owner ") to construct a Planned Unit Development upon the subject property legally described above pursuant to Owners Preliminary Plans attached hereto as Exhibit "B" and subject to the following conditions: 1.That the zoning classification of the subject property shall be amended from Village of Lemont R -1 Single - family Detached Residence District, to R-4, Single - family Detached Residence District; 2.That the Planned Unit Development shall substantially conform to the Preliminary Plat, attached hereto as Exhibit `B ", except as such plans may be changed to conform to the Village codes and ordinances; 3.That Turnberry Trail be extended as a fully dedicated paved and curbed street, with right - of -way of 50 feet and a meandering sidewalk on one side of the street; 4. That the cul -de -sacs islands are the sole responsibility of the Developer and/or Property Owners Association. The islands shall be maintained, replaced and/or removed by the sole discretion of the Developer and/or Property Owners Association. The Village waives all responsibility associated with said cul -de -sac islands for the life of the islands. 5.That all final engineering plans be approved by the Village Engineer; 6. That the corner side yard abutting Lots 16 and 17 adjacent to Turnberry Trail shall not be less than 15 feet wide. Homes on these lots shall not face Turnberry Trail; 7. A revised tree survey and preservation plan shall be submitted for review and approval prior to Village board approval of the final plat of subdivision; 8. Cash in lieu of sidewalks along Archer Avenue shall be submitted in an amount approved by the Village Engineer, prior to approval of the Plat of Subdivision; 9. Land cash donations shall be submitted in accordance with Ordinance No. 902 prior to recording of the Plat of Subdivision; 10. Approvals are contingent on the Final Plat approval within one (1) year from the date of the Preliminary Plat approval date. 3 SECTION 2: Zoning District Change and Variations. The subject property described above be and the same is hereby rezoned from its present Village of Lemont R -1, Single - family Detached Residence District, to Planned Unit Development, with an underlying zoning of R-4, Single - family Detached District, to allow the construction of single - family detached residences, in accordance with the Preliminary Plat, attached hereto as Exhibit `B" and the conditions identified above. The zoning map of the Village of Lemont is hereby amended in accordance with the provisions of this Ordinance. Under the Planned Development provisions of the Lemont Zoning Ordinance, the following variances are hereby granted: 1. Reduction in the street right -of -way from 66 feet to 50 feet and a reduction in the cul -de- sac right -of -way from 120 feet to 110 feet in diameter, pursuant to Section VIII -B -1 -c and Section VIII -B -8 of the Lemont Subdivision Regulations; 2. Reduction in the street centerline radius from required 250 feet to 125 feet on the eastern interior roadway, pursuant to Section VIII-B -2 of the Lemont Subdivision Regulations; 3. Elimination of sidewalks along one side of the internal streets and along Archer Avenue, pursuant to Section 3.02 -C -2 of the Subdivision Design Standards Ordinance 992. Sidewalks will be provided along cul -de -sac bulbs according to Village standards; 4. Increase in the allowable cul -de -sac length from 500 feet to 700 feet for the western internal street, pursuant to Section VIII -B -8 of the Lemont Subdivision Regulations; 5. Variance to allow for a waiver of rear yard easements to locate all easement in the front yard adjacent to the street right -of -way, pursuant to Section 1.05 -B -1 of the Subdivision Design Standards Ordinance 992; 6. Variances to the sideyard setback requirements for Lots 16 and 17: the sideyard setback standards shall be reduced from the minimum 25 foot setback to 15 feet on both setbacks fronting Turnberry Trail. 4 THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND E14 'ECT FROM AND AFTER ITS PASSAGE, APPROVAL AND PUBLICATION IN A MANNER PROVIDED BY LAW.
