DATE OF APPROVAL 1- a, -o / RESOLUTION APPROVING AN EXTENSION FOR SPECIAL USE AND VARIATION APPROVALS ( Community Bank of Lemont, 1280 State Street) WHEREAS, the Village of Lemont has received a request for an extension for the B -3 Rezoning approval for the Community Bank of Lemont, located at 1280 State Street; and; WHEREAS, the approval expires on January 26, 2001 since no building permit has been issued for the Commercial Bank; and WHEREAS, the Petitioner, Richard Meade, is seeking an extension for the approval until January 26, 2003. NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont that the request for an Extension of the B -3 Rezoning Approval is hereby granted subject to the following condition: 1) That the Petitioner shall be required to appear before the Village Board at the January, 200„ Committee of the Whole meeting, in order to provide an update as to the progress that has been made towards the construction of the permanent commercial bank structure on the subject property. I am asking that this request be placed on the agenda for the meeting scheduled January 22, 2001 so it can be acted upon and approved by the 1/26/01 deadline. We are requesting this extension because all recent efforts have been put forth to get the Bank open in its temporary facility. The necessary capital for Community Bank of Lemont has been raised. We have secured the FDIC approval and are awaiting other regulatory approvals and the final examination process. We reasonably expect to open for business in January 2001. Meade 1229 South State Street Lemont, Illinois 60439 Phone: 630 - 257 -1900 Fax: 630 - 257 -1911 E -Mail: info@cbofl.com www.cbofl.com MIX WAIN LENDER EXHIBIT D CONDITIONS OF APPROVAL 1) the project shall be built substantially in conformance with the site plan, attached as exhibit '`E ", the landscape plan, attached as exhibit "F ", the architectural rendering, attached as exhibit "G ", and the sign plan (with the exception of the time and temperature display which requires a variation), attached as exhibit "H ", except as such plans may be changed to conform to Village Codes and Ordinances; 2) the "interim bank" to be temporarily located in the single family residence on the southeast portion of the developed site, must be removed within 60 days of the issuance of a certificate of occupancy for the commercial banking facility; 3) the petition is subject to review and approval by the Village Attorney and Village Engineer; 4) a tree preservation plan shall be submitted for review and approval by staff, prior to any site work being permitted; 5) the Landscaping plan shall be subject to review by the Village Landscape consultant; 6) fifty (50) feet of right -of -way shall be dedicated along State Street; 7) approval from the Illinois Department of Transportation will be required for access to State Street; and 8) the proposed building shall conform with the exterior facade ordinance, and shall be constructed primarily of Lemont flagstone as depicted in the architectural rendering, attached here as exhibit "G ", but the design of the structure may change with the provision that it will still be constructed of Lemont Flagstone; the zoning for the entire 5.5 acre site shall revert back to the R -1, Single Family Residential District from the B -3 Arterial Commercial District, in the event that a building permit for the commercial banking facility, as depicted in the architectural rendering, attached here as exhibit "G ", has not been issued by the Village within one (1) year of Village Board Approval of the annexation and rezone. plan has been revised since the Technical Review Meeting. Mr. Fitz said that a 20 foot buffer along the northern property line is required in order to screen the business from the abutting residential uses. Mr. Fitz said that the Comprehensive Plan designates the area as business although it is currently zoned residential. Mr. Fitz said that there are 19 trees on the site that require identification and /or preservation and 10 of those trees will be lost for the construction of the building and parking lot. Mr. Fitz said that 50 feet of right -of- way along State Street is required to be dedicated as a condition of approval. Mr. Studebaker asked about the stub street. Mr. Fitz said that it will serve as a cross access to the property to the east if it is developed. Mr. Fitz said that it is currently undecided whether or not to require easements or build out the stubs. Mr. Bruce asked if the stub access is adequate depending upon what is developed to the east. Mr. Fitz said that a 24 foot wide access would be required and it is shown that way on the plan. Mr. Fitz said that an additional stub to the north may be appropriate. Simon Batistich, the petitioner's architect, said that the plan shows an ingress /egress easement at the south end of the property which will service the bank and any possible future development. Mr. Batistich said that temporary detention is shown east of the site and if detention is abandoned at that location, another stub can be facilitated. Four drive -thru lanes are proposed at the north end of the site. Mr. Batistich said that the existing trees are mostly landscape trees and are not indigenous to the area. Mr. Batistich said that they will save about half the trees and replace the rest. Mr. Batistich said that the proposed signage meets the new zoning requirements and there are no variance requests. Mr. Batistich said that they would like to maintain an interim bank in the southem home. Mr. Batistich said that the house meets codes as far as accessibility. Mr. Bruce asked how long the interim bank will remain. Petitioner James McCreary said less than a year. Chairman Metzger asked why Lemont needs another bank. Petitioner Rich Meade, of 1001 Edgewood Court, said that the necessity of another bank in Lemont will be addressed by the FDIC and the State of Illinois and they will make a determination of the appropriateness of the request. Mr. Meade said that the review is in process. Chairman Metzger asked the petitioner to explain the concept of a "community" bank. Mr. Meade said that a community bank is there to serve the community by donating, providing community service. processing loans and being actively involved in the community.
