R-36-01 Objection for the Record of the Cook County Zoning Board of Appeals Regarding a Request for a Zoning Map Ammendment (Docket #7129) and Planned Unit Development Approval (Docket #7130) (south of 131st Street, west of Parker Road)VILLAGE OF LEMONT RESOLUTION NO. R^ Of A RESOLUTION OF OBJECTION FOR THE RECORD OF THE COOK COUNTY ZONING BOARD OF APPEALS REGARDING A REQUEST FOR A ZONING MAP AMENDMENT (DOCKET #7129) AND PLANNED UNIT DEVELOPMENT APPROVAL(DOCKET #7130) (south of 131st Street, west of Parker Road) WHEREAS, the Village of Lemont is an incorporated municipality within one and one - half (1 ' /2) miles of the property which is the subject of a request for Rezoning from R -3 Single - family Residence District to R -5 Single Family Residence District, R -7 General Residence District and C -4 General Commercial District, and a Special Use for 339 Single Family Homes, 105 townhome units, and four acres of commercial use, on 132 acres, which is legally described as follows: PARCEL 1: SOUTH 1/2 OF SOUTHEAST 1/4 AND EAST 5 ACRES OF SOUTH 1/4 OF SOUTHWEST 1/4 OF SECTION 34, TOWNSHIP 37 NORTH, R11, EAST OF THIRD PRINCIPAL MERIDIAN; PARCEL 2: THAT PART OF SOUTHEAST 1/4 OF SOUTHWEST 1/4 OF SECTION 34 AFORESAID; PARCEL 3: LOT 1 AND EAST 1/2 OF LOTS 6 AND 7 IN COUNTY CLERK'S DIVISION OF SOUTH 1/2 OF SECTION 34, TOWNSHIP 37 NORTH, R11, EAST OF THIRD PRINCIPAL MERIDIAN, EXCEPT 5 ACRES OF LAND; PARCEL 4: THAT PART OF LOT 6 IN COUNTY CLERKS DIVISION OF SOUTH 1/2 OF SECTION 34, TOWNSHIP 37 NORTH, R11, EAST OF THE THIRD PRINCIPAL MERIDIAN. WHEREAS, the entire boundary of the subject property is within one and a half (11/2) miles of the corporate limits of the Village of Lemont; and WHEREAS, the Village Comprehensive Plan indicates that this area is designated for low density residential uses, not multiple family uses; and WHEREAS, the new Cook County Comprehensive Plan indicates that this area is designated for single family uses, not multiple family and commercial uses; and WHEREAS, the petitioner has failed to demonstrate compliance with the procedural requirements and standards for Planned Unit Developments as enumerated in the Cook County Zoning Ordinance; and WHEREAS, the predominant land use pattern in unincorporated Lemont Township adjacent to and within one mile of the site is low - density single - family development; and WHEREAS, the rezoning would substantially alter the character of the neighborhood and may cause harm to the values of property within the vicinity of the proposed rezoning. NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage and Will, State of Illinois, that the Village of Lemont hereby objects to the requests for rezoning and special use which is the subject of Cook County Zoning Board of Appeals Docket #7129 and Docket #7130.
