R-37-01 Objection For Record of Cook County Zoning Board of Appeals Regarding Request for a Zoning Map Ammendment (Docket #7131) Planned Unit Development Approval (Docket #7132) (131st Street, west of Bell Road)VILLAGE OF LEMONT RESOLUTION NO. A RESOLUTION OF OBJECTION FOR THE RECORD OF THE COOK COUNTY ZONING BOARD OF APPEALS REGARDING A REQUEST FOR A ZONING MAP AMENDMENT (DOCKET #7131) AND PLANNED UNIT DEVELOPMENT APPROVAL(DOCKET #7132) (131st Street, west of Bell Road) WHEREAS, the Village of Lemont is a zoned municipality within one and one -half (11/2 ) miles of the property which is the subject of a request for a zoning map amendment from R -3 Single - family Residence District to R -5 Single Family Residence District, R -7 General Residence District and C -4 General Commercial District, and a Special Use for a 202 dwelling -unit Planned Unit Development, which is legally described as follows: PARCEL 1: SOUTH 'A OF EAST 1/7 OF WEST 'A OF NORTHEAST 1/4 OF SECTION 35, TOWNSHIP 37 NORTH, R11, EAST OF THIRD PRINCIPAL MERIDIAN; PARCEL 2: SOUTH 'A OF EAST 1/8 OF WEST 'A OF NORTHEAST 1/4 (EXCEPT EAST 30'); PARCEL 3: WEST 'A OF NORTHEAST 1/4 OF SECTION 35, TOWNSHIP 37 NORTH, Ri 1, EAST OF THIRD PRINCIPAL MERIDIAN (EXCEPTING THEREFROM SOUTH 175' OF NORTH 'A AND EXCEPTING THAT PART OF NORTH 'A THEREOF). WHEREAS, the Cook County Zoning Board of Appeals did conduct a public hearing on dockets 7131 and 7132 on May 21, 2001; and WHEREAS, the entire boundary of the subject property is within one and a half (11/2) miles of the corporate limits of the Village of Lemont; and WHEREAS, the Village Comprehensive Plan indicates that this area is designated for low density residential uses, not multiple family and commercial uses; and WHEREAS, the new Cook County Comprehensive Plan indicates that this area is designated for single family uses, not multiple family and commercial uses; and WHEREAS, the petitioner has failed to demonstrate compliance with the procedural requirements and standards for Planned Unit Developments as enumerated in the Cook County Zoning Ordinance; and WHEREAS, the proposed development will be a burden on local and county public facilities and services; and WHEREAS, the petitioner's proposal is not in full compliance with the Subdivision Regulations of the Village of Lemont; and WHEREAS, the predominant land use pattern in unincorporated Lemont Township adjacent to and within one mile of the site is low- density single - family development; and WHEREAS, the rezoning would substantially alter the character of the neighborhood and may cause harm to the values of property within the vicinity of the proposed rezoning; and WHEREAS, the Section 13.15 of the Cook County Zoning Ordinance provides that the Board of Trustees of a zoned municipality may submit a written protest to the Secretary of the Zoning Board of Appeals; and NOW THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, Counties of Cook, DuPage and Will, State of Illinois, that the Village of Lemont hereby objects to the requests for rezoning and special use which is the subject of Cook County Zoning Board of Appeals Docket #7131 and Docket #7132.
