R-09-03 02/10/03i RESOLUTION NO. A RESOLUTION ENDORSING CHICAGO SOUTHLAND DEVELOPMENT, INC. AS THE COMMUNITY DEVELOPMENT BLOCK GRANT/H.O.M.E. APPLICANT AND ADMINISTRATOR OF ALL SINGLE FAMILY REHABILITATION FOR THE VILLAGE OF LEMONT WHEREAS, THE Constitution of the State of Illinois, 1970, Article VII, Section 10, authorizes units of local government to contract or otherwise associate among themselves in any manner not prohibited by law or ordinance; and WHEREAS, the Illinois Compiled Statutes, Chapter 5, Act. 220, entitled the Intergovernmental Cooperation Act, provided that any power or powers, privileges or authority exercised or which may be exercised by a unit of local government may be exercised and enjoyed jointly with any other unit of local government; and provides that any one or more units of local government may contract with any one or more units of local government to perform any governmental service, activity or undertaking which any of the local governing bodies entering into the Agreement is authorized by law to perform, provided that such Agreement shall be authorized by the governing body of each party to the Agreement; and WHEREAS, Chicago Southland Development, Inc (CSDI), an Illinois not - for - profit corporation, through its Board of Directors, has requested that the Village Board of Lemont, Illinois, support Community Development Block Grant (CDBG) and H.O.M.E. applications to be filed annually in 2003, through and including 2007, requesting single family rehabilitation funds in accordance with the rules and regulations as set forth by the Department of Housing and Urban Development and the County of Cook, Department of Planning and Development; and WHEREAS, such Village endorsement is required prior to the filing of said application with the County of Cook. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Lemont, Illinois, as follows: SECTION 1: That the preambles of this Resolution are incorporated herein by reference as if fully set forth herein. It is further acknowledged that CSDI and the Village of Lemont enter into a quasi- intergovernmental agreement to further support the mutual interests of the CDBG/H.O.M.E. single family rehabilitation program. SECTION 2: That the Village finds that the Department of Housing and Urban Development Single Family Rehabilitation Program and H.O.M.E. program available to certain municipalities which meet the criteria of the application as administered by the County of Cook, is necessary for the rehabilitation of certain qualified property within the Village of Lemont and is vital for the continuing improvement and development of specific properties within the Village of Lemont. SECTION 3: That in order to facilitate the CDBG and H.O.M.E. single family rehabilitation program to the citizens of the Village of Lemont, the Village President and the Village Board of Trustees of Lemont, Illinois, have determined that it is in the best interest of the Village to support and endorse CSDI for the purpose of preparing, presenting, and administering the aforementioned applications on behalf of the Village for the period of five (5) years, subject to termination as set forth in Section 4. SECTION 4: Both the Village and CSDI shall have the right to terminate the agreement beginning in the year 2004. The applicable party must give written notice of termination and said notice shall be sent via certified and regular U.S. Mail, postmarked no later than January 3`d of the year of cancellation. SECTION 5: That this Resolution shall be in full force and effect for HUD fiscal years 2003 through 2007 from and after its passage and approval as required by law. (CSDI) has received the application for the 2003 -04 Community Development Block Grant Program from Cook County. In order for us to complete the County's application we need an updated Fair Housing Ordinance from your village. Additionally, the Resolution authorizing CSDI as the administrator of your village's Community Development Block Grant Program has expired. Therefore, another Resolution needs to be passed and a certified copy of the Resolution sent to CSDI. Your village's Resolution and Ordinance must be included in the CSDI's (2003 -04) grant application package. The grant application needs to be received by Cook County by February 28, 2003. Consequently, we need your Resolution and Ordinance no later than February 14, 2003. As usual, time is of the essence so your personal attention to this matter will help ensure an unaffected continuation of this very needed and beneficial program for your village and it's residents. It has been a privilege for CSDI to administer your village's program for the past five years. We look forward to the beginning of another successful five -year period.
