AN ORDINANCE AUTHORIZING THE AWARD OF A CONSTRUCTION
CONTRACT WITH LYONS ELECTRIC COMPANY, INC.
WHEREAS, The Village of Lemont is in need of construction services related to electrical and street
lighting work in conjunction with the Stephen Street Reconstruction Project; and
WHEREAS, The Village of Lemont seeks to utilize the construction firm of Lyons Electric Company,
Inc.;
WHEREAS, The Village of Lemont desires to waive the advertisement for bid as required under
65 ILCS 5/8 -9 -1;
WHERAS; the Village of Lemont, through its construction manager, and Lyons Electric Company, Inc.
have negotiated a construction proposal and contract for the services to be provided.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BORAD OF TRUSTEES that
the Construction Proposal, attached hereto as Exhibit A is hereby approved and that the Mayor and
Clerk are authorized to sign the contract without the advertisement for bids.

Illinois Street to River Street. This is the fifth of six (6) Contracts that are being awarded for
the Stephen Street Reconstruction project. The amount of this Proposal is within the
guidelines we established for award of this section of the work on the Stephen Street
Reconstruction project. Lyons Electric Company, Inc. is highly qualified to perform this work.

1. PROPOSAL OF: LYONS ELECTRIC COMPANY, INC.
4225 LAWNDALE AVENUE — LYONS, ILLINOIS 60534
(Name and Address of Bidder)
to construct the "Electrical and Street Lighting" work for the improvement designated in
Paragraph 2 below consisting of the reconstruction of Stephen Street, from Illinois Street to
River Street, including water main; sanitary sewer and storm sewer, to be coordinated with
pavement removal; curb and gutter removal; sidewalk removal; bituminous base; binder and
surface courses; combination concrete curb and gutter; water main; sanitary sewer, storm
sewer; ornamental lighting; streetscape work; and appurtenant construction completed by
others, for a total distance of 1,830 -feet, of which 1,830 feet (.3465 miles) are to be
improved.
2. The Plans and Specifications for the proposed improvement are those prepared by
FRANK NOVOTNY & ASSOCIATES, INC., 825 Midway Drive, Willowbrook, Illinois 60527,
and which Plans and /or Specifications, including Addendum No. 1, are designated as:

3. The general requirements and covenants that will govern over this project are those
prepared by the Illinois Department of Transportation, and included in the "Standard
Specifications for Road and Bridge Construction ", adopted and in effect on the date of
invitation for Bids.
3. The undersigned agrees to complete the "Electrical and Street Lighting" work, in
conjunction with other Contractors to collectively complete all the reconstruction
improvements, within sixty (60) working days or by August 15, 2003, whichever occurs
first, unless additional time is granted in accordance with the Specifications.

4. Each pay item should have a unit price and a total price.
5. A bid will be declared unacceptable if neither a unit price nor a total price is shown
6. The undersigned firm certifies that it has not been convicted of bribery or attempting to
bribe an officer or employee of the State of Illinois, nor has the firm made an admission of guilt
of such conduct which is a matter of record, nor has an official, agent, or employee of the firm
committed bribery or attempted bribery on behalf of the firm and pursuant to the direction or
authorization of a responsible official of the firm. The undersigned firm further certifies that it is
not barred from bidding on this Contract as a result of a conviction for the violation of State
laws prohibiting bid rigging or bid rotating.
7. The undersigned submits herewith his "Schedule of Prices ", on the forms included in
this section, covering the work to be performed under this Contract; he understands that he
must show in the Schedule the unit prices for which he proposes to perform each item of
work, that the extensions must be made by him, and that, if not so done, his Proposal may be
rejected as irregular.
8. The Contractor shall provide a "Certificate of Insurance ", upon award of the Contract
as outlined in the Contract Specifications, except that an OCP Policy will not be required.

will be totally liable and responsible for any direct and /or indirect consequences arising from our
failure to comply with these Insurance Requirements.
FINALLY, I UNDERSTAND AND AGREE, that if said Insurance Requirements are not
fulfilled, we, the Contractor, will bear full responsibility for paying any and all costs of litigation,
including but not limited to, settlement costs and attorney's fees resulting from any and all claims

Pursuant to 30 ILCS 580/1, et seq. ( "Drug -Free Workplace Act "), the undersigned
Contractor hereby certifies to the contracting agency that it will provide a drug -free workplace

the grantee's or Contractor's workplace.

2) the grantee's or Contractor's policy of maintaining a drug -free workplace;
3) any available drug counseling, rehabilitation, and employee assistance
program; and
4) the penalties that may be imposed upon employees for drug violations.
C. Making it a requirement to give a copy of the statement required by Subsection A to
each employee engaged in the performance of the Contract or grant, and to post the
statement in a prominent place in the workplace.
D. Notifying the contracting agency within 10 days after receiving notice under page (D) of
paragraph 3) of Subsection A from an employee or otherwise receiving actual notice of
such conviction.
