PUBLISHED IN PAMPHLET FORM BY AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF LEMONT, COUNTIES OF COOK, WILL AND DUPAGE, ILLINOIS, THIS 21sT OF OCTOBER, 2002 RESOLUTION 0a-- RESOLUTION GRANTING EASEMENT TO COMMONWEALTH EDISON COMPANY ALONG THE I &M CANAL RESERVE STRIP WHEREAS, the Village of Lemont is proposing to undertake public parking lot improvements on the I &M Canal Reserve Strip west of Ed Bossert Drive, and WHEREAS, portions of the Commonwealth Edison transmission lines encroach into said improvement; and WHEREAS, the Village has requested that the Commonwealth Edison Company relocate certain power poles to accommodate such improvements. NOW, THEREFORE, BE IT RESOLVED, by the President and Board of Trustees that the attached Grant of Easement to Commonwealth Edison Company is hereby approved. CHARLENE SMOLLEN, Village Clerk Approved as to form: JOHN ANTONOPOULOS, Village Attorney GRANT OF EASEMENT The Grantor(s) VILLAGE OF LEMONT, a municipal corporation in consideration of the sum of Ten Dollars and other valuable consideration, receipt of which is hereby acknowledged, hereby give(s) and grant(s) to COMMONWEALTH EDDISON COMPANY, an Illinois Corporation, its licensees, successors and assigns, an easement to construct, operate, maintain, renew, relocate and remove, from time to time, poles, wires, transformers, and other facilities used in connection with overhead transmission and distribution of electricity, sounds and signals, together with right of access to the same and the right, from time to time, to trim or remove trees, bushes and saplings and to clear all obstructions from the surface and subsurface as may be required incident to the grant herein given, in, over, under, across, along and upon the surface of property situated in Section 20, Township 37 North, Range 11, East of the Third Principal Meridian in Cook County, Illinois, described below. No structures or obstructions shall be placed over Grantee facilities or in, upon or over the Easement Area by Grantor without prior written consent of the Grantee. After installation of any facilities by Grantee, the grade of the property shall not be altered in a manner so as to interfere with the operation and maintenance thereof. THE EASEMENT AREA HEREBY GRANTED SHALL CONSIST OF A TEN (10) FOOT WIDE STRIP OF LAND, AS MEASURED AND BEING FIVE (5) FEET EACH SIDE OF GRANTEE'S FACILITES AS INSTALLED LYING WESTERLY OF ED BOSSERT DRIVE. THE AFORESAID FACILITY INSTALLATION SHALL RUN ALONG AN APPROXIMATE PATH AS DEPICTED WITHIN THE SKETCH LABELED EXHIBIT "A ", WHICH HAS BEEN ATTACHED HERETO AND MADE PART HEREOF.
